You have the following rights: 1. You have the right to admit or deny the allegations in the motion/complaint. 2. You have the right to bail and to be advised of the amount and conditions of your bail. 3. Any plea or admission that you make must be knowing, intelligent, and voluntary and not the result of undue influence or coercion. 4. You have an absolute right to remain silent and need not make any statement to anyone. If you choose to make a statement, it can and may be used against you in court. The Prosecution may call you to testify at a revocation hearing, and if you refuse to testify, that refusal may be used against you. 5. You are presumed innocent until proven guilty. If you ask for a hearing, the prosecution must prove the allegations against you by a preponderance of the evidence. However, if the allegation is that you committed a new law violation, the prosecution must prove that charge beyond a reasonable doubt. 6. You are entitled to have an attorney represent you in these proceedings. If you so request, you will be given a reasonable opportunity to consult with an attorney. If you cannot afford an attorney, you may apply to the Public Defender’s Office to determine if you qualify for their representation. 7. You have the right to cross-examine witnesses called by the prosecution and to compel the attendance of witnesses to testify on your behalf and to present any other evidence in your defense. 8. If the Court determines that you have violated the terms of your probation, your probation may be revoked. If your probation is revoked, you may be resentenced to the penalty ranges of the offenses for which you were originally convicted or pleaded guilty. If your probation is revoked, you may be resentenced to probation on the same terms as you were previously sentenced or to new terms. 9. If the Court determines that you have violated a suspended sentence, that sentence may be imposed in whole or in part. 10. If the Court determines that you have violated a deferred sentence, a judgment for conviction will enter and the Court may sentence you to probation or to any other sentence according to the penalty ranges of the offenses for which you were convicted or pleaded guilty.
