Underthe provisionsof the Secretary of theNavyMemorandum dated 29 July 2004, Implementationof CombatantStatusReviewTribunalProcedures for EnemyCombatants Detainedat GuantanamoBay NavalBase Cuba, a Tribunal has beenappointedto reviewthe detainee's designationas an enemy combatant. 2. An enemy combatanthas been defined as “ an individualwho was part ofor supporting the Talibanor al Qaeda forces, or associatedforces that are engaged inhostilities againstthe United States or its coalitionpartners. This includesany person who committeda belligerentact or has directly supported hostilities in aid ofenemy armed forces. 3. The United States Government has previously determined that the detainee is an enemy combatant . This determination is based on information possessed by the United States that indicates that the detainee is member of al Qaeda. a . The detainee is a member of al Qaeda 1. The detainee traveled to Afghanistan via Kyrgyzstan to receive training at a trainingcamp/safe housein Kabul. 2. The detainee arrived in Kabulon 26 July 2001 to begin training. 3. The detainee training on the AK-47 rifle and a Makarovpistol while at the Kabul Uighur training camp/safe house . 4. When the bombingbegan in Kabul, the detainee and all of the Uighurs ran in all directions for safety 5. The detainee to Pakistan where he and three others were arrested by the Pakistani police while trying to evade detection ( dressed in burkas). 4. The detainee has the opportunity to contest his designation as an enemy combatant. The Tribunal will endeavor arrangeforthepresence of any reasonably available witnesses or evidence that the detainee desires to call or introduce to prove that heis not an enemy combatant.
