MINUTES OF THE STANDING COMMITTEE ON AGRICULTURE Wednesday, November 28, 2012 9:00 a.m. Room 307 House Office Building, Lansing Representative Daley, Chair, called the meeting to order. MEMBERS PRESENT: Representatives Daley, Denby, Kurtz, Tyler, Glardon, Johnson, LaFontaine, McBroom, Outman, Rendon, Muxlow, Callton, Brunner, Oakes, Talabi, Hovey- Wright, Segal, Smiley. Representative Tyler made a motion to adopt the minutes of the meeting of September 19, 2012. No objections being offered, the minutes were accepted as presented. Representative Kurtz made a motion to excuse absent members. No objections being offered, absent members were excused. The Chair laid the following bills before the Committee. HB 5852 (Daley) Transportation; other; motor fuel sold at a roadside retail location; regulate certain advertising requirements. SB 1236 (Casperson) Animals; other; reference to certain contact with large carnivore over 20 weeks of age; modify and make other general revisions. SB 210 (Hune) Animals; other; facilities accredited by the zoological association of America; exempt from large carnivore act. SB 703 (Hune) Animals; other; importation requirements for large carnivore; implement. Derek Bajema, representing the Michigan Department of Agriculture and Rural Development (MDARD), reviewed the provisions of HB 5852 with the Committee and indicated support for the bill. Mark Griffin and Devin Corn, representing the Michigan Petroleum Association and Citgo, spoke in support of HB 5852. Larry Julian, representing the Michigan Soybean Association and Michigan Corn Growers, submitted a card indicating support for the bill. The Chair stated that the Committee would begin to receive testimony on SB 210 and SB 703. Senator Hune reviewed the provisions of the bills with the Committee. John Wortman, representing the Zoological Association of America (ZAA), spoke in support of the bills. The following individuals spoke to the Committee regarding SB 210 and SB 703: Carrie Cramer, representing the Zoological Association of America, the DeYoung Family Zoo and Michigan Private Zoos, in support Tara Harrison, DVM, representing Association of Zoos and Aquariums (AZA)/Potter Park Zoo, in opposition to SB 210 Scott Carter, representing the AZA/Detroit Zoological Society, in opposition to SB 210 Dalen Agnew of Williamston, Michigan, in opposition to SB 210 Holly Hunt, representing the International Animal Exchange, in support of SB 210 and SB 703 Cards for SB 210 and SB 703 were submitted by: Derek Bajema and Dr. Steve Halstead, representing MDARD (SB 210) Derek Bajema and Dr. Steve Halstead, representing MDARD, in support of SB 703 Dennis Laidler, representing Potter Park Zoo, in opposition to SB 210 and SB 702 Kirk Profit, representing the Detroit Zoo, in opposition to SB 210 and SB 703 Dean and Monte Oswald, representing Oswald's Bear Ranch, in support of SB 210 and SB 703 Jill Fritz, representing the Humane Society of the United States, in opposition to SB 210 The Committee returned to receive additional testimony on SB 1236. The following individuals spoke to the Committee regarding SB 1236: Dean and Monte Oswald, representing Oswald's Bear Ranch, in support of SB 1236 Jill Fritz, representing the Humane Society of the United States, in opposition Jennifer Barnett, representing the AZA/Binder Park Zoo, in opposition Greg Geise, representing AZA/Binder Park Zoo, in opposition Derek Bajema and Dr, Steve Halstead, representing MDARD, neutral on the bill Chair Daley stated that the Committee would stand at ease, the time being 10:44 a.m. The Chair reconvened the meeting at 10:50 a.m. The Chair announced voting would take place on the bills before the Committee. Representative Denby made a motion to adopt HB 5852 (H-1). Standing Committee on Agriculture Minutes of Meeting of November 28, 2012 Page 4 Representative LaFontaine made a motion to amend SB 703 as follows: 1. Amend page 2, line 3, by striking out all of enacting section 1 and inserting: "Enacting section 1. This amendatory act does not take effect unless Senate Bill No. 1236 of the 96th Legislature is enacted into law.". FAVORABLE ROLL CALL: Yeas: Representatives Daley, Denby, Kurtz, Tyler, Glardon, Johnson, LaFontaine, McBroom, Outman, Rendon, Muxlow, Brunner, Smiley. Representative Denby made a motion to report SB 703 with recommendation as amended.
