Proceedings of 225th Meeting of ERC-NCTE held on 16th -18th November, 2016 PROCEEDINGS OF 225th MEETING OF THE ERC-NCTE HELD ON 16th -18th November, 2016 The 225th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 16th-18th November, 2016 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 225th ERC Meeting. Dutta - State Representative of Assam Dr. Tilottama Senapati - State Representative of Odisha Shri Mukesh Kumar - Regional Director (I/C), ERC & Convener At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Mukesh Kumar (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. The institution shall comply with the additional facilities required (additional built-up area, additional staff, additional funds etc) for the SECOND UNIT as prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014 before 31.10.2015. 6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 7. The Committee suggested to prepare Data Bank for the teachers. 8. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. Shri Mukesh Kumar (RD/Convener, ERC, NCTE) Prof. Brajanath Kundu (Chairperson ERC, NCTE) 1 Proceedings of 225th Meeting of ERC-NCTE held on 16th -18th November, 2016 ER-225.1 Confirmation / review of 222nd Meeting held on 14th – 16th September 2016 Ushangini College of Education for Women, Plot No-265, 267, 268, Street No- SH 60, Vill- Kuli Chowrasta, PO- Kuli Kandi, Tehsil/Taluka- Berhampur, 1. 225.1.2 Town/City- Kuli Chowrasta, Dist- Murshidabad, West Bengal- 742168 (B.Ed.-Additional Course) (Private) (The West Bengal University of Teachers Training, Education Planning and Administration) (ERCAPP3891) The ERC in its 222nd meeting held on 14th – 16th September, 2016 has considered the reply of Letter of Intent and decided to issue formal permission order under clause 7(16) of the NCTE Regulation 2014 for applied B.Ed. programme with an intake 50 (one basic unit) from the academic session 2017-18 to the institution. During issuance of formal permission order, it is observed that the institution has not submitted the original FDRs of Rs. 5.00 lakhs & Rs. 7.00 lakhs into joint name of institution /trust/society and RD ERC NCTE. In view the above, the committee decided as under: The institution is directed to submit the FDRs of Rs. 5.00 lakhs and Rs. 7.00 lakhs into joint name of RD ERC NCTE and institution/society/trust within 7 days. ER-225.2 Court Case Basundhara Teacher Training College, Plot/Khasra No. 924-29-26-15-23-13-14-28-22- 26, Vill- Silout Bishnupur Jainarayan, P.O-Silout, Tehsil/Taluka-Kurhnl, 2. 225.2.1 Dist-Muzaffarpur, Bihar-843119 (4 Year B.A. B.Sc. B.Ed. Integrated Course) (Private) (Babasaheb Bhimrao Ambedkar Bihar University) (ERCAPP3468) That the institution namely Basundhara Teacher Training College, Plot/Khasra No. 924-29-26-15-23-13-14-28-22- 26, Vill- Silout Bishnupur Jainarayan, P.o-Silout, Tehsil/Taluka-Kurhnl, Dist-Muzaffarpur, Bihar-843119 had submitted online application on 17.06.2015 for 4 year B.A. B.Sc. B.Ed. Integrated course and the hard copy of the application was received in ERC, NCTE on 29.06.2015. That the matter was placed before the ERC in its 210th meeting held on 7th-9th April, 2016, the committee discussed the matter in detail and decided formal permission order under clause 7(16) of the NCTE Regulation, 2014 for applied 4 years B.A. B.Sc. B.Ed. Integrated course with an intake 50 (one basic unit) from the academic session 2016-17 be issued to the institution. Accordingly, permission order dated 28.04.2016 was issued to the institution. That the institution preferred a writ petition bearing No W.P. ( C ) No. 8217 of 2016 challenging the order dated 28.04.2016 passed by the ERC, NCTE before the Hon‟ble High Court of Orissa at Cuttack. The Hon‟ble High Court of Orissa at Cuttack disposed of the matter on 26.09.2016 with the following directions: “In the facts and circumstances of the case, we dispose of the writ petition with the direction that in case the petitioner files a fresh comprehensive representation before opposite party No. 1, the NCTE along with certified copy of this order annexing therein all the documents that the petitioner relies upon, the same shall be considered and decided by the said opposite party in accordance with law by reasoned and speaking order as expeditiously as possible, preferably within a period of four weeks of filing the same”. The institution has submitted its representation received by this office on 04.10.2016 along with the certified copy of the order of the Hon‟ble High Court of Orissa along with the faculty list. The Committee discussed the matter in detail and observed as under: That on verification of the copies of the mark sheets & certificates of the 16 faculties appointed by the institution, the appointment of 11 faculties were found valid. The appointments of 5 teachers found invalid for the reason mentioned below: (i) That as per requirement the institution fell short of one faculty member each of (Math), Language (Hindi) and faculty member of Science in terms of the distribution of the teacher in the subject areas of Mathematics, Science, Social Science and Language as stipulated in norms of NCTE Regulation, 2014 under point 5.1 of clause (iii) of Appendix-13 two faculties in each of the above subjects. Moreover the mark sheet has been downloaded with an endorsement that “this information should not be treated as mark sheet”, hence her appointment treated as invalid. (iii) That the faculty list submitted by the institution does not reflect actual qualification of the one lecturer namely Anamika Kumari. Hence, her appointment treated as invalid. That as per the Norms & Standards as envisaged in Appendix-13 of Regulation, 2014, 11 faculty members are valid which is not sufficient for conducting the 4 Year B.A. B.Sc. B.Ed. Integrated programme with two units and keeping in view the cut of date i.e. 2nd May, 2016 for granting recognition/permission for the session 2016-2017, the committee decided in greater interest of the institute to grant 4 years B.A B.Sc. B.Ed. Integrated programme of four years duration with an intake of 50 (one basic unit) instead to issue show cause notice for two units. That as per direction of the Hon‟ble Apex Court in I.A No 9 of 2016 in W.P. (S) civil No 276/2012 Maa Vaishno Devi Mahila MahaVidlaya Vs State of U.P. &ors vide order dated 28.03.2016 the cut of date for granting recognition was 02.05.2016 for the session 2016-2017. That the Committee keeping in view that the cut of date i.e. 2nd May, 2016 for granting recognition/ permission for the session 2016-2017 decided not to issue show cause notice amounting to complete loosing of enrolment of students for the session 2016-2017. That the above decision has been taken fairly in terms of the stipulation in the NCTE Regulation 2014 and best of its fitness any allegation to the contrary is unfounded and imaginary. In view of the above, the committee decided as under: The prayer of the petitioner to accord revised recognition for the required another one unit is not at all possible at present as the cut of date for grant of recognition is over for the session 2016-2017 and in no circumstances, the same can be taken for consideration.
