INVITATION 1.1 Intent The intent of these Terms of Reference (TOR) is to invite prospective consultants to submit proposals for engineering consulting services for the completion of a Flood Hazard Mapping project for Bunibonibee Cree Nation (BCN). 1.2 Method of Submission and Closing Date Proposals are to be submitted as PDF files by way of email to [email protected]. The technical submission and the cost summaries are to be provided as separate, non-alterable PDF documents. Both documents may be sent in the same email. In lieu of the hard copy time stamp when physically received, the document will be deemed received at the email received date and time, set as 14:00 local time February 16, 2021. The Proponents must also submit four hard copies to the Bunibonibee Cree Nation by regular mail or courier for their use. The proposal submission envelope should read: “Engineering Consulting Services for the Bunibonibee Cree Nation (BCN) Flood Hazard Mapping Project” and be addressed to: Bunibonibee Cree Nation Flood Hazard Mapping Project General Delivery Oxford House, MB R0B 1C0 Attention: Horace Crane Lands Manager Hard copies must be received by BCN within seven days of the closing date. 1.3 Project Description The Scope of Work is presented in detail in Section 5.0 of this document. The engineering Consultant will perform the work outlined in a substantial, cost-effective, complete and professional manner. The Consultant must furnish everything necessary for undertaking the work and shall not omit any details necessary for its proper performance and completion, even if specific mention of such details is not made in these TOR. It is expected that the Consultant shall employ scientifically defensible, appropriate and most reliable investigative practices. The Consultant is defined as a person, firm or corporation with a successful record of providing engineering services related to environmental projects to an approved scope of work, schedule and budget. The Consultant firm engaged for this work must hold a Certificate of Authorization issued by the Engineers and Geoscientists Manitoba (EGM) a condition of which is holding professional liability insurance. In addition, the lead engineer assigned to this work must be registered or licensed to practice engineering with the EGM. Proof of the firm’s Certificate of Authorization, the lead engineer’s registration, and the firm’s professional liability insurance are - 4 - GCDOCS # 87714611 mandatory requirements for the Consultant’s proposal as outlined in Appendix “A”. The terms of a contract for this work will be negotiated with the Consultant with the highest rated proposal. This TOR and the Consultant’s proposal shall form the part of the contract between BCN and the successful Consultant. This TOR shall govern in the event of discrepancies or conflicts between the two documents. Consultant selection shall be by a competitive proposal process in response to these TOR with the Project Team agreeing on the selection. 1.4 Consultant’s Questions 1.4.1 A Consultant may submit a question by email and request that the question and answer not be circulated to other Consultants. If the question points to an error or shortcoming in this request for proposal, the Project Evaluation Team reserves the right to ignore the request and notify all interested Consultants of the error and associated correction. If the information is not critical, but the Evaluation Team judges it fair to circulate the answer to all, the enquiring Consultant will be given the opportunity to withdraw the question. i) If none of the above conditions exist, and the question reveals a Consultant’s unique proposal strategy, then the Project Evaluation Team will honor the request and respond only to the enquiring Consultant. 1.4.2 Questions can be directed to Patricia Mitchell at [email protected] 1.4.3 The last day for questions is [February 9, 2021]. 2. BACKGROUND Bunibonibee Cree Nation (BCN) is a First Nation in Manitoba, Canada. The First Nation’s homeland is ABC Reserve, located approximately 185 kilometres Southeast of Thompson Manitoba and located on Oxford Lake, part of the Hayes River. The current Bunibonibee Cree Nation Chief and Council are as follows: Chief Richard Hart Councillor 1 Howard Grieves Jr Councillor 2 Donald Hart Councillor 3, Marion Wood Councillor 4, Anthony Wensum Councillor 5 Gabriel Hart Councillor 6 Paul Weenusk Sr. The community’s geographic zone classification is Zone 4. The First Nation has no year-round - 5 - GCDOCS # 87714611 road access to a service centre and, as a result, experiences a higher cost of transportation. As of 2020, the current registered First Nation on-reserve membership is approximately 2,500-3,000 people. The community is concerned about how the community’s public buildings, services, facilities and roads appear to be at risk to climate change impacts such as flooding around oxford lake. A summary of community concerns related to flooding was gathered in summer 2020. • Hydro poles are falling, swaying, due to the increased water which could be a major danger if the live hydro lines hit the water; there is no hydro office nearby BCN to disconnect live wires if compromised • Housing foundations on several homes are compromised or at risk of being compromised and becoming unstable as the foundations get weaker due to rising water levels reaching homes and entering crawl spaces; on a daily basis residents are attempting to remedy the flooding by using pumps to drain or divert the water away from their homes or by digging ditches • Road infrastructure connecting certain parts of the community are completed under water, forcing community members to risk driving and walking through two (or more feet) of water just to get to the main reserve where the local stores are located; • The water treatment plant situated near the rising water may also be compromised; and/or is unintentionally releasing chemicals into the water • Flooding is causing skin reactions to children; the health centre spoke of increased skin related issues that have been seen prior to the water levels rising; • Flooding is affecting overall residents health especially on senior residents or residents with compromised immune systems; –i.e.; having to walk through water to access other areas of the community while wet on cold days may cause serious health related issues, and dealing with flooding in their homes It is anticipated that climate change may lead to an increase in riverine flooding through changes in precipitation patterns, snow and ice melting patterns and thawing permafrost. BCN is seeking flood hazard mapping to support future decision making, including infrastructure planning, land use planning, emergency management and adapting to the impacts of climate change. The Flood Hazard Mapping Project (the “Project”) requires the following components: • Community Participation, Engagement and Indigenous Knowledge • Survey and Base Data Collection • Hydrologic Analysis • Hydraulic Modelling • Naturalized and regulated Flow Comparison • Flood Hazard Map Production • Flood Risk Assessment and Mitigation Planning: • Hydrogeological Assessment • Reporting - 6 - GCDOCS # 87714611 3. OBJECTIVE Bunibonibee Cree Nation requires flood hazard maps to be produced to identify areas of the community at risk of flooding on their main reserve, Oxford House 24 IR and the adjacent Oxford Lake North Shore IR. The maps will support community planning and the future development of flood mitigation measures. The purpose of the TOR is to outline the services required of the Consultant relative to the provision for a Flood Hazard Mapping project. 4. PROJECT TEAM CONTACT INFORMATION The contract resulting from this RFP will be between the successful proponent and BCN.
