GEORGIA COMPOSITE MEDICAL BOARD MINUTES JUNE 2-3, 2011 The Georgia Composite Medical Board (GCMB) held its regular meeting on June 2-3, 2011, at 2 Peachtree Street, NW, 36th Floor, Atlanta, Georgia 30303, to consider Medical Board matters. Board Members in attendance on Thursday, June 2, 2011, were: Alexander S. Gross, MD., Chairperson Charles White, DO., Vice-Chairperson John S. Antalis, MD William Butler, MD Eddie R. Cheeks MD Alice House, MD Kathy Kinlaw, Consumer Member Marion O’Neil Lee, MD John T. Perry, MD William S. Sightler, DO David W. Retterbush, MD Roland S. Summers, MD Jean Rawlings Sumner, MD Richard Weil, MD Board members absent on Thursday, June 2, 2011 were: Kathy Kemle, PA, Ex-Officio Board Member Rhonda Kunes, Consumer Member Representatives from the Attorney General’s Office: Janet Wray, Senior Assistant Attorney General Amelia Baker, Senior Assistant Attorney Wylencia Hood Monroe, Assistant Attorney General Daniel Strowe, Assistant Attorney General Dr. Gross called the meeting to order at 8:00 a.m. AGENDA Dr. Summers moved to approve the agenda of the June 2-3, 2011 GCMB meeting. Dr. Weil seconded and it carried unanimously. MINUTES Dr. Perry moved to approve the minutes of the May 5-6, 2011 meeting as amended. Dr. Retterbush seconded and the motion carried unanimously. Dr. Summers moved to approve the minutes of the May 20, 2011 teleconference call, Dr. Perry seconded and the motion carried unanimously. GEORGIA COMPOSITE MEDICAL BOARD MINUTES JUNE 2-3, 2011 EXECUTIVE DIRECTOR’S REPORT LaSharn Hughes, Executive Director, presented the following to the Board: 1. Request from Sidney Welch of Arnall Golden Gregory, LLP for a declaratory statement that medical decision-making must be provided by a licensed physician or an advanced practice registered nurse or physician assistant operating under appropriate protocols or job descriptions. The Board responded that it agreed that such decisions must be made by a licensed physician, or an advanced practice registered nurse or physician assistant operating under an appropriate protocol or job description. 2. Letter from Kellie Raydon-Feeney seeking a waiver of the education, testing, and training requirements for licensure as a Naturopathic Physician. The Board denied the request because there is no licensure provision for Naturopathic Physicians in Georgia, and the Board does not have the authority to waive the law. 3. Letter from Kenneth J. Lazarus, M.D., Ph.D. asking if the Board approves or endorses the use of marijuana by a board certified addictionologists in a patient managed with opioids for chronic pain. The Board responded that it does not approve or endorse this practice. 4. Letter from Belinda Schuder asking whether a registered cardiovascular invasive specialist (RCIS) can give medication during cardiac procedures in a cardiac cath lab. The Board responded that since RCIS is not a licensed profession, a physician must administer all medications or must supervise the administration of medication. A physician may delegate the authority to assess patients to a physician assistant or advanced practice registered nurse. 5. Letter from request whether a New York State licensed pathology laboratory and licensed physician would need a Georgia license to issue reports and findings in Georgia. The Board responded yes according to Official Code of Georgia Annotated Section 43- 34-31. 6. Letter from Laura Gibson inquiring if a medical assistant can perform a tibial nerve stimulation treatment for incontinence. The Board responded that this is the practice of acupuncture, which requires a license to practice acupuncture, and referred her to the laws and rules concerning the duties a medical assistant can perform. 7. Letter from Carla Powe asking if a physician licensed in another state can proctor a physician in Georgia, if the proctoring activity included no patient contact. The Board responded that the physician proctor does not need a licensed in Georgia, but the physician being proctored must be licensed in Georgia. GEORGIA COMPOSITE MEDICAL BOARD MINUTES JUNE 2-3, 2011 8. Letter from Jim Lower regarding retro payments for physician services. The Board tabled the matter until the next meeting. 9. Letter from Joanava McDaniel regarding whether an ordering physician must have an original signature or can the signature can be faxed later for home care agency orders. The Board directed Ms. McDaniel to CMS for guidance since this is not covered by the medical practice act. The Board accepted the following correspondence as information: 1. Letter from L. John de Albuquerque, MD. 2. Article, “Medical Regulatory Bills Abound in 2011 Legislative Session,” from the Federation of State Medical Board (FSMB). 3. Article from the Federal Trade Commission regarding Texas legislation for the regulation of Advanced Practice Nurses. 4. Article ,“State Board took Fewer Disciplinary Actions against Doctors in 2010.” 5. Article, “Georgia is Latest State to Pass Law Tracking Prescription Pain Drugs.” 6. Article, “Optometrists seek surgery rights in more states after Kentucky victory.” 7. FSMB Highlights of its Board of Directors Meeting. ELECTION OF OFFICERS Dr. Summers made a motion, seconded by Dr. Perry, to nominate Dr. Charles White as Chairperson of the Board. The motion carried. Dr. Summers made a motion, seconded by Dr. Sumner, to close the nominations for Chairperson. The motion carried, and Dr. White was elected to the Chair for Fiscal Year 2012. Dr. Perry made a motion, seconded Dr. Lee, to nominate Dr. Butler as Vice-Chairperson. The motion carried, and Dr. Butler was elected to the position of Vice-Chairperson of the Board for Fiscal Year 2012. CLOSED SESSION Dr. Antalis made a motion, seconded by Dr. Sightler, to go into Closed Session to conduct investigative interviews. The motion carried. Dr. Gross then declared that the meeting would be in open session upon completion of the investigative interviews. The Board accepted the following quarterly reports: Karns, Jenny Van Horn, Mariah Whelchel, Noel 2. The Board approved the following applicant for licensure: Goodrich, Reginald Gilman 3. The Board approved the following physician for Acupuncture Privileges under the current Physician License: Parrado, Carlos M. (MD) 4. Other Business: 1. The committee reviewed the list of Limited Licensees and Supervisors. GEORGIA COMPOSITE MEDICAL BOARD MINUTES JUNE 2-3, 2011 PHYSICIAN LICENSING COMMITTEE Dr. Butler presented the report for the Physician Licensing Committee. Dr. House seconded the committee’s recommendations, and the motion carried. The Board took the following actions: Invited the following applicants for interviews 1. TS 2. DK 3. WS 4. TD Other Business: 1. Told H.S.L that the USMLE has the final say of whether he can retake the examinations. 2. Allowed W.C. to renew 3. Denied A.C.’s request for a copy of Dr. S.D.’s licensure file. 4. Approved requests from R.C., D.R., and H.D. to waive the USMLE 7-year rule. 5. R&L – no regarding foreign medical schools and refer R&L to the laws & rules 6. Accepted Dr. D.N.’s copy of her medical school transcript. 7. Denied Dr. Olugbenga Ogunsanwo’s application for licensure because he does not meet the licensure requirements. 8. Referred Dr. S.W. to the Wellness Committee. 9.
