A Public Hearing was held by the Town Board of the Town of Wallkill on October 9, 2008 at 7:25 pm at Wallkill Town Hall, 99 Tower Drive, Middletown NY. Members present were Supervisor Ward, Councilman King, Councilman Valentin, Councilman Mulqueen and Councilwoman Neighmond. Councilman. The Clerk read the following notice: TOWN OF WALLKILL, ORANGE COUNTY, NEW YORK NOTICE OF PUBLIC HEARINGREGARDING THE PROPOSED CREATION OF THE WALLKILL COMMERCIAL CENTER BUSINESS IMPROVEMENT DISTRICT AND THE PROPOSED ADOPTION OF THE DISTRICT PLAN PLEASE TAKE NOTICE that pursuant to a Resolution adopted by the Town Board of the Town of Wallkill on September 25, 2008, a Public Hearing will be held by the Town Board of the Town of Wallkill on October 9, 2008 at 7:25 p.m. at Wallkill Town Hall, 99 Tower Drive, Building A, Middletown, NY 10941 regarding the proposed creation of the Wallkill Commercial Center Business Improvement District (“the District”) in the Town of Wallkill and the proposed adoption of the District Plan for the District. The proposed District encompasses a geographic area bounded roughly by the City of Middletown boundary line on the west, the Wallkill River on the south, Goshen Turnpike on the east (including certain properties just south of Route 211 East on the east side of Goshen Turnpike) and Route 211 East (including properties along Fitzgerald Drive and Maltese Drive and properties on both sides of Route 211 East) on the north, and most of the properties in between those boundary lines, encompassing the primary commercial corridors known as Route 211 East and East Main Street/Crystal Run Road from the City of Middletown border on the west to Goshen Turnpike on the East. Other properties in the District are certain properties north of Route 211 East and on either side of New York State Route 17 (the future Interstate Route 86) and certain properties on both sides of Tower Drive proceeding north from Route 211 East, as well as certain properties south of East Main Street between Interstate Route 84 and New York State Route 17 and near the Wallkill Cemetery. The District’s geographic area and boundary lines are more particularly described in the District Plan and map, which is on file with the Town Clerk of the Town of Wallkill at the office listed below. The primary purpose of the District is to provide enhanced police services to property owners and businesses and to enhance public safety and security. The District will contract with the Town of Wallkill Police Department to provide a lieutenant, three sergeants, two detectives and thirteen patrol officers who will be dedicated to patrolling and protecting properties and businesses in the District. Those police officers will commit their time and efforts exclusively to the District. They will be assisted by two full time dispatchers and a full time Administrator and will be supplied with the necessary equipment and up to six police vehicles to be used solely in the District’s geographic area. The maximum cost of such services during the first year of the District’s existence will be $2,597,216.07, and the maximum cost of such services during subsequent years will be $2,405,220.45, subject to increases based on the Consumer Price Index (or similar index) and the impact of subsequent police contracts. The cost of providing such services will be raised by a special assessment imposed on properties in the District based on the percentage that the assessment of the particular property bears compared to the total assessed valuation of all parcels within the District, all of which is described in the District Plan. Copies of the Resolution calling for the Public Hearing, as well as copies of the District Plan, may be examined at the Office of the Town Clerk of the Town of Wallkill at the office listed below, and copies of both the Resolution and the District Plan are available free of charge from the Office of the Town Clerk of the Town of Wallkill at the office listed below. In addition, a October 9, 2008 1 copy of the Resolution and the District Plan are available for viewing on the Town’s website at www.townofwallkill.com. Any owner of real property, deemed benefitted and therefore within the proposed District, objecting to the District Plan must file an objection at the office of the Town Clerk, Town of Wallkill within thirty days of the conclusion of the Public Hearing on forms made available by the Town Clerk. In addition, if owners of at least fifty-one percent of the assessed valuation of all the benefitted real property situated within the boundaries of the proposed District, as shown upon the latest completed assessment roll of the Town of Wallkill, or at least fifty-one percent of the owners of benefitted real property within the area included in the proposed District, so file their objections, the District will not be established Persons receiving a copy of this Notice by mail are either owners of real property located within the District or tenants of owners of real property located within the District. Any resident of the Town of Wallkill is entitled to be heard at such Public Hearing upon said proposed creation of the District and proposed adoption of the District Plan. As noted above, the Public Hearing will be held on October 9, 2008 at 7:25 p.m. at Wallkill Town Hall, 99 Tower Drive, Building A, Middletown, NY 10941. The Town of Wallkill will make every effort to assure that the hearing is accessible to persons with disabilities. Jaques, Building Inspector I am requesting permission to send Walter Barrett to the Capital District Education Conference to be held in Albany NY. The conference dates are Oct. 21,22,23. The cost will be $265.00 for the courses and $336.00 for lodging. This will count as 24 hrs of the mandatory 24 for service credit.
