COMMISSIONERATE OF LABOUR The Commissionerate of Labour is effectively enforcing various Central and State Labour Legislations with a greater focus on protecting the interests of the workers engaged in both organized and unorganized sectors. The department is implementing various labour legislations to maintain good industrial relations, protecting the welfare of workers, promoting social security and redress the grievances of consumers. The Commissionerate of Labour is functioning in the Tamil Nadu Labour Welfare Board Building at D.M.S. Compound, Teynampet, and Chennai-6. The Commissioner of Labour is the Head of the Department with three Additional Commissioners of Labour working to discharge administration, conciliation and legal metrology functions and two Joint Commissioners of Labour at the Head quarters. There are four Zonal Additional Commissioners of Labour and ten Regional Joint Commissioners of Labour who are entrusted with the implementation of various welfare Schemes for unorganized workers and enforcement of various Labour laws for organized workers and Quasi judicial functions within their respective territorial jurisdiction. At the district level, Assistant Commissioners of Labour (Enforcement) are appointed to enforce the various Labour Legislations including the Legal Metrology Act. The Deputy Inspectors of Labour, Assistant Inspectors of Labour and Stamping Inspectors are enforcing the legislations at sub-district level. Conciliation Officers in the cadre of Deputy Commissioner of Labour / Assistant Commissioner of Labour are appointed in each district to settle industrial disputes. The Plantations Labour Act, 1951 and its rules have been framed to provide for the welfare of the plantation labour and to regulate the conditions of work in plantations. The Additional Commissioner of Labour (Administration) / Chief Inspector of Plantations is supervising and 2 monitoring the enforcement of Plantations Labour Act 1951. Chief Inspector of Plantations is assisted by ten Assistant Commissioners of Labour (Plantations) Ooty, Coonoor, Kothagiri, Gudalur, Panthalur, Valparai, Yercaud, Batlagundu, Theni and Nagercoil. The offices of the two Assistant Surgeons (Plantation) are situated in Ooty and Nagercoil. This Department from 1.4.2017 is taking various rehabilitative measures for rescued bonded labour. The Assistant Commissioner of Labour (Women Welfare) enforce the Labour Legislations with particular reference to Women/Child Labour in establishments other than factories. The Assistant Commissioners of Labour (Women Welfare) have been notified as Inspectors under the various Labour Legislations, which apply to Women and Child Labour. The offices of these Assistant Commissioners of Labour (Women Welfare) are located in Chennai, Tirunelveli and Coimbatore. The Commissionerate of Labour is implementing the following Acts and Rules to protect the interests of the consumers. 1. The Legal Metrology Act, 2009 2. The Legal Metrology (Packaged Commodities) Rules, 2011 3. Tamil Nadu Legal Metrology (Enforcement) Rules, 2011 Some of the important State and Central labour legislations enforced by the Labour Department are as follows: ❖ The Payment of Wages Act, 1936 ❖ The Minimum Wages Act, 1948 ❖ The Payment of Bonus Act, 1965 ❖ The Equal Remuneration Act, 1976 ❖ The Trade Unions Act, 1926 ❖ The Industrial Employment (Standing Orders) Act, 1946 ❖ The Industrial Disputes Act, 1947 ❖ The Tamil Nadu Shops and Establishments Act, 1947 ❖ The Tamil Nadu Catering Establishments Act, 1958 3 ❖ The Tamil Nadu Industrial Establishments (National, Festival and Special Holidays) Act, 1958 ❖ Contract Labour (Regulation and Abolition) Act, 1970 ❖ The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979. ❖ The Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act, 1981 ❖ The Motor Transport Workers Act, 1961 ❖ The Working Journalists and Other Newspaper Employees (Conditions of Service and Miscellaneous Provisions) Act, 1955 ❖ The Plantations Labour Act, 1951 ❖ The Tamil Nadu Payment of Subsistence Allowance Act 1981 ❖ The Child and Adolescent Labour (Prohibition and Regulation) Act, 1986 ❖ Beedi and Cigar Workers (Conditions of Employment) Act, 1966 ❖ The Sales Promotion Employees [Conditions of Service] Act, 1976 ❖ The Payment of Gratuity Act, 1972 ❖ The Maternity Benefit Act, 1961 ❖ The Employees’ Compensation Act, 1923 ❖ The Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 ❖ The Bonded Labour System (Abolition) Act, 1976 LEGALMETROLOGY ACT, 2009 AND RULES:- In order to protect the interest of the consumers, the Government of India have enacted The Legal Metrology Act, 2009 and The Legal Metrology (Packaged Commodities) Rules, 2011. The Tamil Nadu Government have enacted Tamil Nadu Legal Metrology (Enforcement) Rules, 2011. All the above Act and rules came into force with effect from 1.4.2011.The Legal Metrology Act regulate and check the use of Weights & Measures in Trade and Commerce. 4 Under the Legal Metrology (Packaged Commodities) Rules, 2011, the packages for retail sale shall contain the following declarations. 1. Name and Full Address of the Manufacturer/ Packer/Importer along with consumer care number and e.mail address. 2. Common or Generic name of the Commodity. 3. Net quantity in terms of weight / Measure /Number. 4. Month & Year of packing. 5. Best before /use by date 6. Maximum Retail Sale Price.(inclusive of all taxes) These declarations should be legible and clear on the Packaged Commodities. TN LMCTS, a user friendly Mobile App has been developed to redress the grievances of the consumers on Legal Metrology and Packaged Commodities and it was launched on 04.03.2017 by the Hon’ble Chief Minister. The consumers can download the app through Google play store and give their complaint through this app. TAMIL NADU LABOUR WELFARE BOARD The Tamil Nadu Labour Welfare Board deals with the welfare of organized workers and maintains the Labour Welfare Fund under the Tamil Nadu Labour Welfare Fund Act 1972, which is applicable to all Factories, Plantations, Motor Transport Undertakings, Shops and Catering Establishments. Labour Welfare Schemes 5 1. Labour Welfare Centres Have facilities like Tailoring Section and Pre-school. 2. Scholarships for various Post Graduate Course Rs.12,000/-, courses Graduates Course Rs.8,000/-, Diploma Course Rs.5,000/-, Higher Secondary Course Rs.4,000/- I.T.I. Course Rs.4,000/-. 3. Educational Incentive For first 10 Rank Holders in each Educational District - 10th Standard - Rs.2,000/- 12th Standard - Rs.3,000/- 4. Book Allowance Post-Graduate Course Rs.3,000/-, Graduate Course Rs.2,000/-, Diploma Course Rs.1,500/- Higher Secondary Course Rs.1000/- (For Private School students only) 5. Assistance for Basic Rs.1000/- for five employees / Computer Training dependants in each District. 6. Marriage Assistance Rs,10,000 for both male/female workers and their wards. 7. Spectacles Assistance Upto Rs.1000/- for workers 8. Typewriting /Shorthand Typewriting Higher Rs.600/-, Assistance Typewriting Lower Rs.1000/-, Shorthand Inter/High speed Rs.750/- Shorthand Lower /Higher Rs.1500/-. 9. Natural Death Natural Death Assistance of Rs.25,000/- Assistance and Funeral and Funeral Expenses of Rs.5,000/- to Expenses the Legal Heir of the worker. 10. Accident Death Accident Death Assistance of Assistance and Funeral Rs.1,00,000/- and Funeral Expenses of Expenses Rs.5,000/- to the Legal Heir of the worker. 11. Hearing Aid, Artificial Upto Rs.1000/- for Hearing Aid, Limbs and Three Government prescribed price for artificial Wheelers limbs and free supply of three wheelers. 12. Holiday Homes for Mamallapuram, Courtallam and Valparai. workers 13. Jeeva Illam A Rest House for Trade Union Representatives. 14. Uzhaippavar Ulagam- The Board brings out a monthly 6 Magazine for Workers magazine “Uzhaippavar Ulagam”, which consists of Court Judgements, Labour Acts, question and answers, Consumer Price Index for the benefit of the workers, employers and also to the public. The price of the magazine is Rs.10/- per copy and an annual subscription Rs.100/-, Life subscription Rs.1000/-. UNORGANISED WORKERS WELFARE BOARDS (TAMIL NADU CONSTRUCTION WORKERS WELFARE BOARD & TAMIL NADU MANUAL WORKERS WELFARE BOARD AND OTHER 15 BOARDS). TAMIL NADU MANUAL WORKERS (REGULATION OF EMPLOYMENT AND CONDITIONS OF WORK) ACT, 1982 Tamil Nadu Government enacted Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 to regulate the conditions of Work and to provide Social Security to Manual Workers In exercise of the powers conferred by sub-section (1) of section 32 of the Act, the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Rules, 1986 were framed. TAMIL NADU CONSTRUCTION WORKERS WELFARE BOARD In the year 1994, the Government of Tamil Nadu established the Tamil Nadu Construction Workers Welfare Board for the welfare of manual workers engaged in construction industry. The Scheme framed for this purpose lists 53 categories of workers involved in construction activities. TAMIL NADU MANUAL WORKERS SOCIAL SECURITY WELFARE BOARD AND OTHER 15 WELFARE BOARDS 7 Under the above said Act, Government of Tamil Nadu constituted Tamil Nadu Manual Workers Social Security and Welfare Board on 17.03.1999 and framed Tamil Nadu Manual Workers Social Security Welfare Scheme 2001 which has been replaced in 2006, to provide various welfare assistance to the manual workers.
