r ORDINANCE NO. 278 3 AN ORDINANCE AMENDING ORDINANCE NO. 27432, PASSED BY THE CITY COUNCIL ON DECEMBER 10, 2008, TO AMEND THE GEOGRAPHIC AREA OF TAX INCREMENT FINANCING REINVESTMENT ZONE NUMBER SEVENTEEN, CITY OF DALLAS, TEXAS (THE “TOD TIF DISTRICT”) TO REMOVE CERTAIN PROPERTIES FROM THE MOCKINGBIRD/LOVERS LANE SUB-DISTRICT, MOVE PROPERTIES LOCATED IN THE EXISTING BOUNDARY IN THE 8TH AND CORINTH AREA FROM THE CEDARS WEST SUB-DISTRICT TO THE LANCASTER CORRIDOR SUB-DISTRICT, AND INCREASE THE GEOGRAPHIC AREA BY ADDING PROPERTY TO THE MOCKINGBIRD/LOVERS LANE, CEDARS WEST, AND LANCASTER CORRIDOR SUB-DISTRICTS, AND CREATING A NEW CEDAR CREST SUB-DISTRICT; ESTABLISHING AN EFFECTIVE DATE; PROVIDING A SEVERABILITY CLAUSE; AND ENACTING OTHER MATTERS RELATED THERETO. WHEREAS, on December 10, 2008, the City Council authorized the adoption of Ordinance No. 27432 which created Tax Increment Financing Reinvestment Zone Number Seventeen, (the “TOD TIE District”) in accordance with V.T.C.A. Tax Code, Chapter 311 (“Act”); and WHEREAS, the TOD TIF District was created to encourage transit-oriented development (TOD) around DART stations in the central portion of the City and help create a series of unique destinations, as well as foster the construction of structures or facilities that will be useful or beneficial to the development of transit stations along the DART light rail system in the central portion of the City; and WHEREAS, the TOD TIE District Board of Directors recommended a TIF District boundary amendment on January 20, 2010, consistent with the requirements and limitations of the Act; and WHEREAS, on March 10, 2010, the City Council, per Resolution No. 10-0688, and in accordance with the Tax Increment Financing Act, as amended, V.T.C.A Texas Tax Code, (Chapter 311), called a public hearing to be held on April 14, 2010, to hear citizen comments and concerns regarding the proposed TOD TIE District boundary amendment. That public hearing was duly held and closed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DALLAS: 1fl’ - 27853 SECTION 1. That Ordinance No. 27432, approved by the City Council on December 10, 2008, is hereby amended for the geographic area of the Tax Increment Financing Reinvestment Zone Number Seventeen (TOD TIE District) to remove certain properties from the Mockingbird/Lovers Lane Sub-District, move the properties located in the existing boundary at the 8th and Corinth DART station area from the Cedars West Sub-District to the Lancaster Corridor Sub-District and increase the geographic area of the TIE District by adding property to the Mockingbird/Lovers Lane, Cedars West, and Lancaster Corridor Sub-Districts, and creating a new Cedar Crest Sub-District as depicted in the new attached Exhibit A-i and A2-A8 (Perimeter Description and Maps). SECTION 2. That the facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct. SECTION 3. That Section 3, paragraph F, of Ordinance No. 27432 shall be amended to read as follows: (2) The Cedars West and 8th and Corinth areas forms a Sub-District in the Trinity River Corridor area that havc land uses that are incompatible with a transit station and/or are predominately industrial in nature with aging or inadequate infrastructure. (3) The Lancaster Corridor Sub-District that includes the 8 and Corinth Station, Illinois Station, Crest Shopping Center area, Kiest Station, aci4 VA Medical Center Station, and Ledbetter Station areas have land uses that are incompatible with a transit station, underutilized properties, and functionally obsolete retail structures. L4 The Cedar Crest Sub-District includes a 200-acre planned development for the former Kiest landfill site and adiacent property east of Kiest Boulevard alonQ Southerland Road lackinci infrastructure for redevelopment, the Cedar Crest Golf Course as a regional asset, and some land uses incompatible with long term growth in the area. SECTION 4. That Exhibit A-i and A2-A7 of Ordinance No. 27432 shall be completely deleted and the new attached Exhibit A-i and A2-A8 shall be substituted therefore. SECTION 5. That amendments to the boundaries of the TOD TIE District will result in benefits to the City and the property including in the TIE District. 27853 100914 SECTION 6. That the expansion of the geographic area of the TOD TIE District will not cause the total appraised value of all taxable real property in the TOD TIE District, according to the most recent appraisal rolls of the City, together with the total appraised value of all other existing reinvestment zones within the City, to exceed 15 percent of the current total appraised value of taxable real property in the City and the industrial districts created by the City, if any. SECTION 7. That improvements in the TOD TIE District will significantly enhance the value of all taxable real property in the TOD TIE District. SECTION 8. That Ordinance No. 27432 will remain in full force and effect, save and except as amended by this ordinance. SECTION 9. That if any section, paragraph, clause or provision of this ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this ordinance. SECTION 10. That this ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Dallas, and it is accordingly so ordained. The DART Rail Line links these station areas, or “sub-districts” together to form the TIE District. The sub-districts are described in more detail below: 1) Mockingbird/Lovers Lane Sub-District is generally bounded on the north by Lovers Lane, to the east by Amesbury Drive and Greenville Avenue, to the south by Mockingbird Lane, and on the west by North Central Expressway, including a property located at the southwest corner of the intersection North Central Expressway southbound frontage road and Mockingbird Lane. 2) Cedars West Sub-District is generally bounded by the DART light rail line to the east and north, the Trinity River to the south, and Cadiz Street and R.L. Thornton Freeway to the west. 3) Lancaster Corridor Sub-District includes: • 8th & Corinth area is generally bounded by Canyon Street at its northernmost boundary, the DART light rail line and Corinth Street to the east, Fayette Street and adjacent creekbed at its southernmost boundary, and Moore Street to the west. • Illinois Station area is generally bounded by Iowa Street to the north, Illinois Street to the south, Ozona Street to the east, and Denley Drive to the west. • Crest Shopping Center area is generally bounded by Elmore Street to the north, Lancaster Road to the east, Saner Avenue to the south, and Den ley Drive to the west. • Kiest Station area is generally bounded by the rear property line of residential properties fronting onto Cove Drive to the north, Easter Avenue and Biglow Street to the east, Stovall Drive to the south, and Lancaster Road and Den ley Drive to the west. • VA Station area is generally bounded by Ann Arbor Avenue to the north, Lancaster Road to the east, Atlas Drive to the south, and Gracey Road to the west. • Ledbetter Station area is generally bounded by Ledbetter Drive to the north, Lancaster Road to the east, Wagon Wheels Trail to the south, and Denley Drive and Arden Road to the west, including three properties at the northeast corner of Lancaster Road and Ledbetter Drive. 4) Cedar Crest Sub-District is generally bounded by Southerland Avenue, Kiest Boulevard, and Rector Street to the north; MKT Railroad to the east; Van Cleave Drive, Magna Vista Drive, Old Bonnie View Road, Sutter Street, Illinois Avenue to the south; and Ozona Street to the west. 27853 10c914 Exhibit A-I (page 2) Boundary Description TOD TIF District See Exhibit A2-A8 for detailed boundary maps. Boundaries that follow public streets and highways shall be construed to extend to the far sides of such rights-of-way. Boundaries that approximate property lines shall be construed as following such property lines. The boundary of this District follows the DART light rail lines and right-of-way. If at any time during the life of the TOD TIF, rail lines should be reconfigured or moved, the boundary of the TOD TIF District will follow the new location of the rail line. In some instances rail lines or right-of-way may cross parcels. In this case, if the particular parcel bisected by the rail line was not originally included in the boundary of the District or the boundary has not been amended to include the parcel, the parcel will not be considered as within the TOD TIE District.
