Box 83720 Boise, ID 83720-0054 RE: H0156, amending Section 67-8203, Relating to Definition of Impact Fee Eligible Equipment Dear Chairman Mendive, On behalf of the Idaho Chapter of the American Planning Association (APA Idaho), I am writing to register my organization's support regarding House Bill 110, the amendment to Section 67-8204A regarding Impact Fee Intergovernmental Agreements. Our organization represents more than 250 local planning officials, private-sector planners, and planning commission members statewide. We are the technicians, professionals, policy and decision makers who represent the public interest in carrying out the authorities vested with local government under Idaho’s Local Land Use Planning Act, Title 67, Chapter 65 of the Idaho Statutes and regularly use the Impact Fee provisions found in Idaho Code Title 67, Chapter 82. APA Idaho strongly supports any clarifications that can be made in Idaho Code Title 67, Chapter 82 to ensure impact fees are being utilized in a responsible, effective and efficient way. The clarification that impact fees can be used for fire apparatus is an important clarification. At this time, we would ask that an additional clarification be made. The proposed bill adds “fire apparatus”, but we would like to also include “ambulances”. Specifically, we ask for the following inclusion- (24) "Public facilities" means: (f) Public safety facilities, including law enforcement, fire stations and apparatus, emergency medical and rescue stations and ambulances, and street lighting facilities. This simple addition will clarify that fire apparatus AND ambulances, with a useful life of 10 years1 , are system improvements that impact fees can be used for. We feel this is a very positive change in the impact fee enabling legislation. 1 67-8203- (3) "Capital improvements" means improvements with a useful life of ten (10) years or more, by new construction or other action, which increase the service capacity of a public facility.
