ADJOURNMENT Report To: Board of Directors Subject: NPCA Policy Document Report No: 60-18 Date: September 19, 2018 RECOMMENDATION: 1. That Report No. 60-18 respecting the NPCA Policy Document BE RECEIVED; 2. That the NPCA Policy Document attached to Report No. 60-18 BE APPOVED as presented; and 3. That the NPCA Policy Document BE ENACTED commencing November 1st, 2018. PURPOSE: The purpose of this report is to gain approval by the NPCA Board of Directors for the enactment of the NPCA’s revised Policy Document, formerly “The Living Landscape” Document, and to get direction, for staff, to implement the new policy document starting November 1st, 2018. BACKGROUND: The NPCA Policy Document, formerly “The Living Landscape”, is the name given to the project with its primary objective being to review and complete a fundamental rewrite of the NPCA’s primary development guidance document entitled, “Procedures and Guidelines for the Administration of Ontario Regulation 155/06 and Land Use Planning Policy Document”. The original Policy Document was written and approved by the NPCA Board of Directors in December of 2007 with housekeeping amendments in December of 2009, September of 2010, and finally, October of 2011. In 2015, due to commitments within the 2014 – 2017 NPCA Strategic Plan, “the NPCA Policy Document should clearly distinguish between broader planning guidance and regulatory/permit requirements”, the Director of Watershed Management for the NPCA issued a Request for Proposal (RFP) for a Comprehensive Policy Review and rewrite of the document. Dillon Consulting was awarded the project which was originally set to be completed, approved (by NPCA Board of Directors), and enacted by staff, by September of 2016. Report No. 60-18 NPCA Policy Document Page 1 of 2 The product document has been vetted through a number of external and internal stakeholders including: The NPCA Watershed Floodplain Committee, the Welland River Floodplain Association, The NPCA Advisory Committee (now, and previously the Community Liaison Advisory Committee - CLAC), Planning Staff at the Niagara Region, Planning Staff at the City of Hamilton, Planning Staff at Haldimand County, The North and South Federations of Agriculture, Staff at the Niagara Escarpment Commission, Staff at the Ministry of Natural Resources - MNRF (Guelph), NPCA Staff, and the general public (through a series of seven pop-up style consultation booths set up at various community events). The response deadline for stakeholders to respond and give feedback was extended twice by the current Board of Directors to accommodate all parties. The Policy Document has undergone five (5) revisions since the beginning of the project. DISCUSSION: Since 2015, NPCA staff and Dillon Consulting have done extensive Public and Stakeholder Consultation with a number of versions being drafted to incorporate feedback and suggestions. All feedback and suggested changes were vetted against the NPCA’s mandated and regulatory obligations, passed down by the Province of Ontario, through the Conservation Authorities Act and its supporting regulations. Feedback and suggested changes were also vetted against The Planning Act, the Provincial Policy Statement, and Best Management Practices (BMPs) set out by Conservation Authorities across the Province. This Policy Document shall be reviewed and reported upon on annual basis or as required by changes to legislation. The final version was supported unanimously by the NPCA Watershed Floodplain Committee, at its June 2018 meeting. FINANCIAL IMPLICATIONS: There are no direct financial implications.
