Introduction 1.1 The proposed Harbin-Jiamusi Railway is located within the mid-east region of Heilongjiang Province and situated in Harbin City and Jiamusi City at the south bank of the Songhua River. The line starts at Harbin Station, passes by Binxian County, Fangzheng County and Yilan County, and ends at Jiamusi Station in Jiamusi City. The line is 343.344km long in total, including 179.435km main track subgrade, 154.064km bridge, and 9.845km tunnel, with bridge-tunnel ratio. 1.2 Harbin-Jiamusi Railway passes by 2 prefectural-level cities and their 7 districts and 3 counties, namely Daowai District, Acheng District, Xiangfang District, Binxian County, Fangzheng County and Yilan County of Harbin City and suburb of Jiamusi City. 1.3 Although route, station location and construction campsite have been designed according to current design phase, partial sections and construction position of the railway may be substantially changed in next phase. Thus the resettlement policy framework should cover all possible changes according to OP/BP4.12 of the World Bank. 1.4 Resettlement framework mainly refers to the resettlement policy framework that causes uncertain and unexpected impacts during project implementation. This framework applies to direct permanent occupancy scope and possible scope, like temporarily occupied land, construction and material campsite and constriction road. 2. Measures to Avoid and/or Alleviate Resettlement Impact 2.1 Project Planning and Design Phase During project planning and design, the design organization and the owner have adopted the following measures to reduce impact on social economy of local residents: World Bank Loan Project 2 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway • During scheme optimization and comparison & selection, try to consider the impact of engineering construction on local social economy and take it as a key factor for scheme optimization and comparison & selection; • To reduce land acquisition and resettlement, the railway section within the suburb areas is routed along the existing railway to decrease land acquisition and relocation and environmental impact; • Optimize construction design, shorten construction period and reasonably arrange housing demolition and construction periods. 2.2 Implementation Period In case that land acquisition and relocation are unavoidable, following measures should be adopted to alleviate impact of land acquisition and relocation on local residents: • Reinforce collection of fundamental data, analyze current situation of social economy and future development, formulate feasible Resettlement Action Plan based on local situations and guarantee that living standard of local residents will not be degraded; • Strengthen internal and external monitoring, establish efficient and smooth feedback mechanism and channel, and try to shorten information processing period to solve all problems in implementation in time; • Require construction organization to use effective measures during construction to reduce impact of engineering construction on local production. 3. Legal Framework The People's Republic of China has formulated a complete legal framework and policy framework according to standards on land acquisition, house demolition, resettlement and compensation. Since issuing in 1986, the Law on Land Management of the People's Republic of China has been modified for 3 times according to change in China's national conditions. On August 28, 2004, the 11th meeting of the 10th NPC Standing Committee made a latest modification to this law. Local governments at all levels have respectively issued and implemented relevant laws and policies that conform to local conditions within the national law and policy framework so as to manage and guide local land acquisition, house demolition, resettlement and World Bank Loan Project 3 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway compensation. Heilongjiang Province along the Harbin-Jiamusi Railway has established relevant local laws and policies according to national laws and policies to manage and guide local works. Relevant provisions of the provincial governments have been implemented by all cities, county-level cities, districts and counties. Land acquisition, demolition and resettlement of the project should follow relevant provisions and strictly abide by implementation measures of province and cities, social safety guarantee policies of World Bank and design document of the project (for some related policies, please refer to Appendix 9).
