The Council has been working hard in drafting the amendment to the Medical Regulations 1974 in order for the Regulations to be gazetted by 2015. With advent of the gazzettement of both the amended Medical Act and Medical Regulations, there will be a period of transition for the MMC in implementing the proposed changes. I would like to extend my warmest welcome to the newly elected members who joined the Council in 2013 following the election for the Peninsular Malaysia and urge every Council member to uphold their responsibilities entrusted upon them by their professional colleagues. I would also like to congratulate the secretariat for successfully organizing the election of new Council members for the current term. Out of 24 candidates, 9 candidates with the highest number of votes were elected to fill the vacancies in the Council. To ensure the transparency of the election process, a new Committee was formed i.e. the Election of Malaysian Medical Council Members (Peninsular) Committee chaired by Prof. Dr. Norlijah binti Othman. During the counting of the ballots, I was present as President of the Council to ensure that the protocol was followed and inspired the confident of the public. The Council suffered a great loss with the demise of Dr. Zaiton binti Ahmad, nominated member of Council and Dr. Abdul Rahim bin Omar, member of Preliminary Investigation Committee II toward the end of 2012. They had respectively contributed tremendously to the Council during their tenure. The MMC is entrusted with the responsibility of registering and regulating medical practitioners as well as the practice of medicine in this country. Members of the Council must play an active role in the pursuance of these noble objectives. One of the main role and function of the Council is to register qualified graduate, issues annual practicing certificates, certificates of good standing, processes application for waiver of compulsory services, advises public and practitioners on matters related to ethic, ethic related to the profession and ensures the continues adherence to high standards of medical education. It has been a busy year as MMC had processed more than 8,584 registration applications and renewed 30,043 Annual Practicing Certificates (APC) for medical practitioners. There has been an increase in the number of graduates registering in the Council. In 2013, 4,472 medical graduates were given provisional registration compared to 2011 which is 3,710 and in 2012, there were 4,086. MMC has issued 30,043 APC in 2013 as compared to 27,214 in 2012. The Council continued to make progress in the processing of complaints including the formation of an additional Preliminary Investigation Committee (PIC VI). To ensure greater transparency in the disciplinary process, the Council has been publishing charges and the 4 punishment of the convicted cases. In the future, the Council will be implementing the changes to the disciplinary process as according to the amended Medical Regulations 1974. The number of new complaints received in 2013 were 43 as compared to 66 cases in 2012 which mark a decrease in the number of complaints received. With the corporatization of MMC to be a financially independent statutory body and there are plan changes in the organization which includes an increase in the fees for the various services provided. In the past year, the Council has been under scrutiny by various factions and there has been much publicity garnered in the mass media on various issues. However the MMC has always maintained their professional stance. This Annual Report provides a useful overview of all the activities undertaken by the Council in fulfilling its objective in ensuring proper registration of medical practitioners, maintaining the standard of profession and public confidence in medical profession. Thank you. Datuk Dr. Noor Hisham bin Abdullah President 5 CHAPTER 1: THE MALAYSIAN MEDICAL COUNCIL INTRODUCTION The Malaysian Medical Council (MMC) is governed by the Medical Act 1971. Over the years, the number of doctors has been increasing and this has raised the role of the MMC as one that is just not monitoring but one that has now to play the role of a Regulator. Subpara 2(1) of the First Schedule of the Medical Act 1971 mandates the Council to meet at least twice in a year whereas subpara 2(2) stipulates that the quorum for a meeting shall be nine and the decision shall be by a simple majority. Power: Medical Act 1971 & Medical Regulations 1974 Duties & Functions: 1. To register all eligible medical practitioners. 2. To maintain a Register of medical practitioners. 3. To accredit medical institutions; both locally and abroad. 4. To regulate the conduct and ethics of registered medical practitioners. 5. To empanel a Medical Review Panel to consider cases of mental illness or physical disabilities. 6. To evaluate and register foreign medical practitioners. 7. To publish and update relevant guidelines on the practice of medicine in the country. 8. To advise and make recommendations to the Minister of Health on matters relating to the practice of medicine in Malaysia 9. To carry out such other acts so as to give effect to the Medical Act 1971.
