Sufficiency Review Cover Sheet Elements Required of a Petition to Establish a Charter School Pursuant to the public charter school rules adopted by the Idaho State Board of Education on March 10, 2005, charter school petitioners are required to submit a draft charter school petition to the Idaho State Department of Education (SDE) for the purpose of determining whether the petition complies with statutory requirements (I.C. 33-5202). This review must occur prior to the petition being submitted to an authorized chartering entity (IDAPA 08.02.04. 200.03). Each section presents criteria for a response that meets the standard, and these criteria should guide the overall rating for the section. The Comments area provides space to identify data and other evidence that supports the rating. If the standard is not meet, comments for revisions or improvement are required. The rationale for each rating is important, especially if some of the data or evidence does not fit neatly into the criteria provided. The following definitions should guide the ratings: Meets the Standard: The charter and amendments reflect a thorough understanding of key issues. It addresses the topic with specific and accurate information that shows thorough preparation and presents a clear, realistic picture of how the school expects to operate. Does Not Meet the Standard: The charter and amendments do not meet statutory requirements, lacks information or raises substantial concerns about the applicant’s understanding of the topic and/or ability to meet the requirement in practice. After a sufficiency review has been conducted by the State Department of Education within thirty (30) days of receipt, the results of the review will be returned to the authorized representative submitting the amendments. If any of the amendment items do not meet the standard, those items need to be addressed and resubmitted to the Department for further review. Once all of the amendments meet the defined standards, the next step is to submit the amendments and sufficiency review findings to an authorized chartering entity for review and consideration for approval. Completion of the sufficiency review process does not ensure approval of the charter amendments, nor does it establish that the school cannot be challenged for failure to comply with state or federal statutes, rules or regulations at some future date. The budgets were submitted in a different format that was readable. The petition meets the current requirements and may be submitted to the potential authorizer. 1st Review: The submitted petition is organized and well presented. The reviewers provided comments for several items the need revision to increase clarity. Please review those comments and consider incorporating the changes as suggested. Additionally, there are several items that need to be addressed and weren’t or need to be corrected. For those items the petitioners have a couple of options: 1. Address the items, return the petition with the corrections/additions made for additional review 2. Wait until after July first and submit to the authorizer; however several of the items are required with the change to the law. If the school is a virtual school that must be indicated, as well as the location of the main office. Meets Standard Table of Contents – page 2 of the petition. Include accurate page numbers for tabs, subjects, 08.03.01.401.02 and appendices. Meets Standard Comment: The Table of Contents is not hyperlinked. Before the document is submitted to the authorizer it should be. Tab 1 – Vision, Mission Executive Summary – succinct description of school concept; how success will be defined; community need and interest; motivation and collective qualification of petitioning group. Meets Standard Vision and Mission Statements 08.02.04.202 08.03.01.401.03 Meets Standard Legislative Intent – include a description of which of the intent items the school will 33-5202 accomplish. Meets Standard Tab 2 – Proposed Operations, Legal Status 3 of 17 4/18/2017 Required Elements Idaho Code Describe the proposed operation and potential effects of the school, including, but not limited 33-5205(5) to: 33-5206(10) a. facilities to be utilized by the school; b. the manner in which administrative services of the school are to be provided; and if an Educational Service Provider (ESP) or Charter Management Organization (CMO) will be used; c. the potential civil liability effects upon the school and its chartering entity; and d. anticipated enrollment. Meets Standard Explanation of legal status of the school, including Local Education Agency (LEA) status. 33-5203(7) References to Articles of Incorporation and Bylaws must be included in the body of the 33-5204(1) petition. Meets Standard Describe the proposed location of the school. Also provide the specific attendance area of the 33-5205(3)(j) school. If the attendance area uses boundaries other than school district or county boundaries include a detailed description of the attendance area and a map showing the boundary. Meets Standard – 2nd Review Comments: 2nd Review: Description was included in the body of the petition and the map was clarified. 1st Review: The attendance area description and boundaries should be specifically discussed in the body of the petition, not just in the appendix. The map that is included should specifically align with the description. The western description references Ten Mile Road/Hwy 16, but the line includes area West of Ten Mile. This may be confusing for potential applicant families. Commitment to secure property and liability insurance. Errors and Omissions insurance is not 33-5204(4) required by statute but is recommended. Meets Standard Tab 3 – Educational Program and School Goals Describe what it means to be an “educated person” in the 21st century. 33-5205(3)(a) 33-1612 Meets Standard Explain how learning best occurs. 33-5205(3)(a) Meets Standard 4 of 17 4/18/2017 Required Elements Idaho Code Note: On the top of page 28 has the following statement: “Standardized test scores show significant improvement”. Significant improvement in what – growth, proficiency, what subjects, what student population. Providing more clarity to this statement will help make the case for the model. Describe the school’s educational program and goals. Include how the program and goals 33-5205(3)(a) relate and support the vision and mission. Meets Standard Comments: References to the “Common Core Standards” should be changed to “Idaho Content Standards.” Idaho has standards for all content areas. (See page 30) Describe how the educational program goals will be measured and the related data that will 33-5205(3)(a) be collected. Meets Standard Describe how each of the education thoroughness standards as defined in Idaho Code 33-5205(3)(a) Section 33-1612 shall be fulfilled. 33-1612 Meets Standard If the school will have grades 9-12, describe how the graduation requirements will align with 33-5205(3)(a) the state requirements. Not Applicable Describe the manner by which special education services will be provided to students who are 33-5205(3)(r) eligible for such services pursuant to the federal Individuals with Disabilities Education Act, to include a disciplinary procedure for such students. Include the manner by which eligible students from the public charter school shall 33-203 be allowed to participate in dual enrollment in non-charter schools within the same district as the public charter school, as provided for in Idaho Code Section 33-203. 5 of 17 4/18/2017 Required Elements Idaho Code Meets Standard Tab 4 – Measurable Standards, Accreditation, and Accountability Identify measurable student educational standards (MSES) that describe the extent to which 33-5205(3)(b) all students of the charter school will demonstrate they have attained the skills and knowledge specified as goals in the school’s educational program. Meets Standard – 2nd Review Comments: 2nd Review: Measurable education standards are included for English/Language Arts, math, and science. Additional Mission specific measures were also included. 1st Review: Measurable Student Educational Standards are not included in the petition. While these will be thoroughly worked out with the authorizer for the performance certificate, the current requirement of the law is to include them in the petition.
