Edmonton, November 17, 1999 The Lieutenant Governor in Council (a) dissolves the Village of Wanham, (b) directs that the area of the Village of Wanham becomes part of Birch Hills County, and (c) makes the order in the Schedule, effective at the end of December 31, 1999. Schedule ORDER 1 In this Order, (a) "former area of Wanham" means the area of Wanham before its dissolution; (b) "receiving municipality" means Birch Hills County; (c) "Wanham" means the Village of Wanham. 2 The former area of Wanham is part of Ward No. 4 of the receiving municipality until the receiving municipality passes a bylaw pursuant to section 148 of the Municipal Government Act that provides otherwise. 3 All assets, liabilities, whether arising from under a debenture or otherwise, rights, duties, functions and obligations of Wanham are vested in the receiving municipality and may be dealt with in the name of the receiving municipality. 4 If the liabilities of Wanham vested in the receiving municipality exceed the assets of Wanham vested in the receiving municipality, the receiving municipality may impose an additional tax on property located in the former area of Wanham to pay for those excess liabilities. 5 Bylaws and resolutions of Wanham continue to apply within the former area of Wanham until the bylaws or resolutions are repealed, amended or replaced by the council of the receiving municipality. 6 A reference to Wanham in any order, regulation, bylaw, certificate of title, agreement or any other instrument is deemed to be a reference to the receiving municipality. 7 (1) The receiving municipality must take 2329 THE ALBERTA GAZETTE, PART I, DECEMBER 15, 1999 (a) money received from Wanham at its dissolution, and (b) money received from the sale of any of the assets vested in it under section 3 that the receiving municipality sells on or before December 31, 2002, and deposit it in a reserve fund established by the receiving municipality. (2) The amounts referred to in subsection (1) in the reserve fund may only be used (a) to pay or reduce any liability transferred to the receiving municipality from Wanham at its dissolution, or (b) for projects within the former area of Wanham. 8 (1) The employment of the employees of Wanham is terminated when Wanham dissolves.
