Harikrishnan No.1, Manikandan Avenue Ponneri Taluk Minjur-601 203, Tiruvallur District Public Authority: The Public Information Officer Office of the Executive Officer Minjur Town Panchayat, Minjur-601 203 ++++ The petitioner asked about the non-demolition of an unapproved Cinema Theatre and demolition of the house of a person to remove the obstruction to the alleged unapproved cinema theatre, about the non action against the removal of encroachment in the drainage channel in the poramboke and whether demolition notice have been given and action taken against the alleged unapproved cinema threatre in the layout road and how the construction work of the cinema theatre is still continuing despite the stop work notice given from their office, vide RTI petition dated 25-3-2009 to the Executive Officer, Minjur Town Panchayat, Tiruvallur District. 2. On 31-3-2009 he was given a reply stating that the encroachment removal is to be done by the Tahsildar and he should contact Tahsildar Office. Whereupon the petitioner made a complaint to the Commission on 9-6-2009 resulting in today's enquiry. The petitioner confirmed the issues and stated that the stop work and demotion notice are given only by the Executive Officer. The Executive Officer stated that his predecessor has issued the reply and he had not looked into the papers till date. 3. The Commission, therefore, rules that the Collector, Tiruvallur is directed to (a) ensure that a complete reply is given to the petitioner within a period of 10 days of this order and reported to the Commission. (b) the Information should be supplied free of cost under Section 7(6) and any amount has been paid by the petitioner must be refunded to him. 4. The Director of Town Panchayat, Chennai, is directed to obtain and file the personal explanation of the PIO concerned as to why the penal clause of the Act should not be invoked for failure to supply the information as per the Act and file it before the Commission within four weeks.
