NORTH DAKOTA LOTTERY Administrative Rules Committee Meeting September 15, 2020 Mr. Chairman, and members of the Committee, my name is Randy Miller. I am the director of the North Dakota Lottery, a division of the Office of Attorney General. Today, I will be providing information describing the procedure followed by the North Dakota Lottery in adopting the rules published in the October 2020 supplement to the North Dakota Administrative Code. I will begin by addressing the questions listed in the Legislative Council’s August 27, 2020 email. Please feel free to ask questions at any time. 1. The rules do not result from statutory changes made by the Legislative Assembly. 2. The rules do not relate to any federal statute or regulation. 3. The Lottery drafted the rules that the Lottery Advisory Commission approved on April 14, 2020. A notice of public hearing was filed with the Legislative Council on April 16, 2020. Notifications on the public hearings and availability of the proposed rules were publicized in 52 daily and weekly newspapers during April 22 to May 2, 2020. The rules were available at the public hearing, Lottery’s office, Lottery’s website, and to the public upon request. A terminal message was sent to retailers. NOTE: An April 16, 2020 notification of a public hearing and availability of proposed rules was scheduled to be publicized in 52 daily and weekly newspapers during April 22 – April 28, 2020. The North Dakota Newspaper Association notified the Lottery that the Jamestown Sun missed running the notice on April 22 and rescheduled to run it on May 2 which only allowed for 17 days between the latest publication and the date of the public hearing, rather than the 20 days required by law. The Lottery conducted one public hearing on May 19, 2020 in Bismarck - no one attended the hearing. The Office of Attorney General examined and approved the proposed rules as to their legality. The Lottery filed the rules with the Legislative Council. 4. There were no written or oral public comments received on the rules. 5. The approximate cost of giving public notice, holding a hearing, and developing and adopting the rules (excluding staff time) is: Administrative Rules Committee Meeting September 15, 2020 Page 2 Publishing notices of public hearings $1,847 Holding public hearings 0 Developing and adopting the rules 0 Total $1,847 6. The amendments addressing changes to the Powerball® Game expected prize pool percentages and odds; Mega Millions® Game expected prize pool percentages and odds; and Lotto America® Game expected prize pool percentages and odds are emergency rules with effective dates of April 8, 2020 and April 9, 2020. The emergency rules are necessary to meet the Multi-State Lottery Association game changes to Powerball, Mega Millions, and Lotto America. 7. A regulatory analysis was not required by NDCC Section 28-32-08 and was not issued. 8. A regulatory analysis or economic impact statement of impact on small entities was not required by NDCC Section 28-32-08.1 and were not issued. 9. The rules do not have a fiscal effect on state revenues and expenditures. 10. A constitutional takings assessment was not required by NDCC Section 28-32-09 and was not prepared. 11. The rules were adopted as emergency rules. NDCC Section 53-12.1-13 allows the North Dakota Lottery to adopt emergency rules as necessary without the grounds otherwise required under NDCC Section 28-32-03. Notifications on the public hearings and availability of the proposed rules were publicized in 52 daily and weekly newspapers during April 22 to May 2, 2020. A copy of the proposed rules was provided to each member of the Lottery Advisory Commission and to Representative Bill Devlin, Chairman of the Administrative Rules Committee. Copies of the proposed rules were available at the public hearing, Lottery’s office, Lottery’s website, and to the public upon request. A terminal message was sent to retailers.
