1 HOUSE OF REPRESENTATIVES - FLOOR VERSION 2 STATE OF OKLAHOMA 3 1st Session of the 58th Legislature (2021) 4 HOUSE RESOLUTION 1009 By: Steagall 5 6 7 8 9 AS INTRODUCED 10 A Resolution asserting sovereignty under the Tenth Amendment to the United States Constitution; serving 11 notice to federal government of certain intent; and directing distribution. 12 13 14 WHEREAS, the Oklahoma House of Representatives recognizes 15 Article I, Section 4 of the Constitution of the United States, "The 16 times, places, and manner of holding elections for Senators and 17 Representatives, shall be prescribed in each state by the 18 legislature thereof; but Congress may at any time by law make or 19 alter such regulations, except as to the places of choosing 20 Senators"; and 21 WHEREAS, the Oklahoma House of Representatives recognizes that 22 Article I, Section 4 of the Constitution of the United States is 23 wholly silent on the matters of voter registration and Congressional 24 redistricting; and HR1009 HFLR Page 1 BOLD FACE denotes Committee Amendments. 1 WHEREAS, Division A-Voting, Title I-Election Access of H.R. 1, 2 also known as the "For the People Act of 2021", First Session of the 3 117th Congress, introduced January 4, 2021, concerns the State's 4 processes of voter registration and Congressional redistricting; and 5 WHEREAS, the Tenth Amendment to the Constitution of the United 6 States specifically provides that, "The powers not delegated to the 7 United States by the Constitution, nor prohibited by it to the 8 States, are reserved to the States respectively, or to the people"; 9 and 10 WHEREAS, the Tenth Amendment limits the scope of federal power; 11 and 12 WHEREAS, the Tenth Amendment was part of the original Bill of 13 Rights, which was proposed on September 25, 1789, ratified by three- 14 fourths of the states, and went into effect on December 15, 1791; 15 and 16 WHEREAS, when taking the oath of office, all members of the 17 Oklahoma House of Representatives solemnly swear that they will 18 support, obey, and defend the Constitution of the United States and 19 the Constitution of the State of Oklahoma. 20 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES 21 OF THE 1ST SESSION OF THE 58TH OKLAHOMA LEGISLATURE: 22 THAT Oklahoma hereby asserts sovereignty under the Tenth 23 Amendment to the Constitution of the United States over all powers 24 HR1009 HFLR Page 2 BOLD FACE denotes Committee Amendments. 1 not otherwise enumerated and delegated to the federal government by 2 the Constitution of the United States. 3 THAT this resolution shall serve notice to the federal 4 government that Division A-Voting, Title I-Election Access of H.R. 5 1, also known as the "For the People Act of 2021", First Session of 6 the 117th Congress, introduced January 4, 2021, concerning the 7 State's voter registration processes, is hereby declared, by the 8 Oklahoma House of Representatives, to lie beyond the authority 9 delegated to the United States Congress in Article I, Section IV of 10 the Constitution of the United States. 11 THAT the authorities reserved by the states, as prescribed in 12 the Tenth Amendment of the Constitution of the United States, shall 13 include the states' prerogative to legislate and regulate their own 14 voter registration processes, as well as the states' right to 15 determine its own Congressional boundaries. 16 That suitable copies of this resolution be delivered to the 17 President of the United States, the President Pro Tempore of the 18 United States Senate, the Speaker of the United States House of 19 Representatives, and each member of the Oklahoma Congressional 20 Delegation. 21 22 DIRECT TO CALENDAR. 23 24 HR1009 HFLR Page 3 BOLD FACE denotes Committee Amendments. .
