Note of action date of Order taken on Order. 1 Whereas, it appears that 16 [Sixteen] awardees of 22.12.2015 Simhat Mouza, J. L. No.15 under P.S.- Haringhata Dist.- Nadia have submitted petitions under the provisior.s of the National Highways Act, 1956 [48 of 1956] and The Arbitration and Conciliation Act, 1996 [26 of 1996] with a prayer for reconsideration of market value of land as acquired u/s 3D of the National Highways Act, 1956 and for re-determination of amount payable Dictated, Corrected as compensation in connection with and signed by me Aush/Aman, & Bari/Viti, class of land u/s 3G of the said Act. Now, I, Sri. Vijay Bharti, IAS, the District Magistrate, Nadia, being appointed as Arbitrator by the National Highways I Authority of India u/s 3(G)5 of the N.H / ct.- 1956 do, hereby, request the A.D.M [L.A], Nadia & Competent Authority under the said Act to arrange for issuance of notices to the petitioners District Magistrate, for appearing on 29.12.2015 at 1:00 P.M. at the Nadia Zilla Parishad Nadia, Conference Hall, Krishnagar, Nadia before me to participate in the arbitration hearing. & (94 L. Arbitrator u/s 3G[5] of N.H. [Vijay Bharti, IAS] Act, 1956 District Magistrote, Nadia & Arbitrator u/s 3G[5] uf N.H. Act, 1956 Serial number and Order and signature of Officer. Note of action taken date of Order on Order. 2 Notices are duly served. Service returns are filed with the 29.12.2015 case records. Dictated, Corrected and signed by me \g;kt_ ...........,„..4 PL --- [Vijay Bharti, IAS] District Magistrate, Nadia District Magistrate, & Nadia, Arbitrator u/s 3D[5] of N.H. Act, 1956 & Arbitrator u/s 36[5] of N.H. Act, 1956 nal number and Order and signature of Officer. date of Order Note of action taken on Order. Fifty Four [54 ] awardees in respect of Mouza Simhat J. L. No. 15, 29.12. 2015 P.S.- Haringhata are found present in hearing. General Manager (Tech.) & Project Director, N.H.A.I, Kgr., Nadia & Competent Authority & Additional District Magistrate (L.A), Nadia and A.D.S.R. ,Kalyani are also present. Ld. Advocate, Abhik Chakroborty is present on behalf of N.H.A.I. It is found that only Sixteen [16] awardees have submitted arbitration petitions praying for enhancement of rate of Aush/Aman & Bari/Viti, class of land, but during hearing all the petitioners and more 38 awardee were present. On verification of records, it reveals that the basic rate of Bari/Viti of this instant Mouza was fixed at Rs.11528294/- per acre, for Aush/Aman it is Rs.4104077/- per acre. I direct the Competent Authority & Additional District Magistrate Dictated, (L.A), Nadia to explain the process which is being followed to decide the Corrected and base rate of land and how the calculation is assessed. He states that the signed by me class wise sale data are collected from the concerned A.D.S.R. Office for a period of one year prior to the date of 3A Notification. If sufficient sale data are not found available, sale data of two or three years back are collected. From........5 the sales, ten sales of higher side are generally taken. When sufficient sale are not available in the concerned Mouza, sales from adjacent Mouzas L....are taken for consideration. Thereafter, average of the 10 sales are assessed, and 10% is added to the average value of each class for direct road District connectivity. For preparing the land value of Aman/Aush class of land 25% is Magistrate, further added to the same for double-crop nature of the agri land. Sum total Nadia, of the three are taken as base price. For calculation of total compensation, payable to each awardee, 30% Arbitrator u/s as Solatium is added to the base price and 12% Additional Compensation per 36[5] of N.H. year is further allowed for the period from date of Notification to the date of Act, 1956 Declaration of Award; i.e. date of payment. Advocate Subrata Poddar representing Awardee No. 98 states that as per New Act 2013 compensation may be 29.12.2015. allowed at the rate prevailing on the date of payment. Hence he prays for considering the assessed value of 2015 as fixed by ADSR. Ld. Advocate of NH states that the New Act,2013 will be applied for the land which has been /will be acquired after 1st Jan,2015.Therefore, in this instant case, it is not applicable, as because the concerned land was acquired in2009-2010. He is informed that the Arbitration hearing is being conducted as per sec 3F(5), 3F(6) & 3F(7) of the NHAI Act,1956 and therefore the reference of New Act,2013 is not allowable. Dictated, Corrected and signed by me Ld. Advocate, Asit Saha intimates that in some cases rate of Viti has been allowed for physically DOKAN Class of land. 1 \L„...... He requests for physical verification and to allow the rate of Dokan in such cases. District Both Land Acquisition Officials and the Project Director Magistrate, Nadia, of NHAI are requested to take necessary action and allow the rate of Dokan if found entitled after physical verification. & Ld. Advocate further states that the sale data of interior Arbitrator u/s 3G15] Area has been considered to assess the market value which is of N.H. Act, 1956 not at all justified . He appeals to allow rate of 5 lakh per dec. for Bari/Viti Class of land . Ld. Advocate for NH informs that 81 sale data have duly 5 been considered by the Competent Authority ( Land Acquisition) and the highest sales have been taken up to assess the market 29.12.2015 price. Hence no further enhancement of rate should be considered. Utsaraj Mukherjee, Advocate, states that Ld. Arbitrator has increased the rates of different moujas in previous cases and so he appeals for reconsideration of the rate of this mouja sympathetically for the interest of the land loosers. He further states that the rate of Aush/Aman of the mouja is too low and should be enhanced for any raiyat. Ld. Advocate Soumen Biswas requests to allow shifting Dictated, Corrected charge to each awardee in reference to the consideration of shifting and signed by me charges for the commercial Tenants. It is stated that there is no specific provision in NHAI 1956 in favour of granting shifting charge for any raiyat. Jayanta Chatterjee, states that the rate of Simhat and Digha has been made the same, which is not at all justified. He argues District that the status of Mouja Simhat is far better than that of Digha and Magistrate, hence its rate should be fixed at a rate more than Digha. Nadia, & Verified the application, Rate Report, Plot Index, Sale Data Arbitrator u/s of ADSR concerned, Block Map, Comparative Chart, and other 3G[5] of N.H. related documents. Viewed the vediography of the locality of the Act, 1956 mouja to know the physical and social status of the mouja. 29.12.2015 Verified the Sale data as received from ADSR, in connection with the rate of 2008-2009 and found that average sale rate of BariNiti of this mouja is much lower than the sanctioned rate. Only one sale shows a rate higher than the rate approved by Competent Authority. It is found that .47667 dec. area of plot no. 4 Dictated, Corrected and signed by me (Class BariNiti) has been transferred @ Rs. 1,30,069 per dec. But the area being too tiny can not be considered, as because less than \L....410 1/2 dec.t acre of land can not actually be used as Bari. Hence, I find reason on supporting document for enhancement of the rate of BariNiti. District Now, I consider the Sale data of Aush/Aman Class Magistrate, of land which are received from ADSR Haringhata and as the rate Nadia, of Aush/Aman is found only 35.5% of the rate of BariNiti, I think, it should be revised to some extent. Hence, considering the following Registered Deeds for ascertainment of rate of Arbitrator u/s Aush/Aman. 3G[51 of N.H. Act, 1956 Regd.Deed Plot Area Value Rate per acre 1-01144 09.04.2008 85 9 409090 4545444 1-01209 13.4.2009 696 2.89 dec. 145000 5105634 Total of the two : Rs. 9651078 Now average of the two comes to Rs. 4825539.00 Hence rate of Aush/Aman per acre may be allowed at Rs. 4825539.00. In presence of the General Manager (Tech.) & Project Director, National Highways Authority of India, Krishnagar, Nadia and Ld. Advocate Abhik Chakraboty in favour of N.H.A.I the rate is announced and they did not give any objection about the arbitral rate, as declared. On the other hand, the applicants are found agreed with the rate also. 7 29.12.2015 Hence, it is ordered that :- 1] The rate of Aush /Aman class of land will be taken as Rs.4825539/- per acre instead of Rs.4104077/- per acre.
