That Members confirmed Tree Preservation Order 2012/1 at High View, Spaunton in its modified form, excluding T7, a sycamore. Resolved: That the report be noted. 38/12 Applications for Planning Permission The following members of the public addressed the meeting regarding the Plans List Items indicated: Plans List Item 1 – Mr Carr spoke in favour of the application. Plans List Item 2 – Mr Reeve spoke in favour of the application and Mr Hollingworth spoke on behalf of the Parish Council. Plans List Item 3 – Liz McCormack spoke against the application. Plans List Item 5 – Mr Kelly spoke in favour of the application. Plans List Item 6 – Mr Kelly spoke in favour of the application. Plans List Item 7 – Mr Griffith spoke in favour of the application. Members also considered further information circulated on the Members’ Update Sheet at the meeting including; updated recommendations from the Director of Planning and comments received after the agenda was printed from: consultees, objectors and supporters. Resolved: (a) That with regard to all applications listed in the report and subject to: (i) the amendments specified below; and (ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above; decisions be given in accordance with the Director of Planning’s recommendations: Planning Minute/2 List Plan No and Description of Proposal No 1. NYM/2011/0787/FL – Conversion of redundant agricultural barns and timber workshop to form 2 No. holiday letting cottages at Orchard Farm and No.7 The Orchards, Orchard Lane, Goathland for Mr & Mrs Carr, Orchard Farm, Goathland, Whitby, North Yorkshire, YO22 5JX. Decision A vote was taken on the Officer recommendation of approval with conditions which was lost. Following on from the vote, reasons for refusal were set out by Members relating to the detrimental impact the conversion of the timber workshop would have on the residential amenity of neighbouring properties by means of noise and activity levels due to a more intense level of use than normal residential enjoyment of the property. A vote was taken on refusal for these reasons and the application refused contrary to Officer recommendation. 2. NYM/2011/0813/FL – Alterations and extensions to provide additional floorspace to café & shop along with additional storage rooms. Provision of a separate shower and toilet facilities together with use of land for the siting of tents and 5 no. camping pods at Lordstones, Chop Gate for Mr John Reeve, Urra Estate, Cold Moor Cote Farm, Chop Gate, Middlesbrough, TS9 7JJ. Decision Caroline Seymour and David Hugill both declared a personal interest in this item due to their attendance at a meeting concerning parking issues where the applicant was present. Malcolm Bowes declared a personal interest in this item as he lives opposite the applicant and chaired a recent meeting concerning parking issues at the site. Consideration deferred to enable a site visit to be undertaken to enable Members to fully assess the visual impact the development would have on the character of the area and its tranquillity, with the attendance of Members being regarded as an approved duty for the purposes of the payment of Members’ allowances. 3. NYM/2012/0124/FL – Construction of single storey rear extension at St Stephens’s Church Rooms, Thorpe Lane, Robin Hoods Bay for Mrs Samantha Glaysher, Red House, Thorpe Lane, Fylingthorpe, Whitby, North Yorkshire, YO22 4TH. Decision Approved as recommended with an amendment to condition 2 as set out on the Members Update Sheet: 2. Original plans amended by email received on 22 May 2012. 4. NYM/2012/0159/FL – Construction of single storey rear extension, increase in roof height, siting of a septic tank and creation of a new access at East Farm, Cold Kirby for Mr & Mrs Cyril Bainbridge, East Farm, Cold Kirby, Thirsk, North Yorkshire, YO7 2HL. Decision Approved as recommended. 5. NYM/2012/0217/FL – Permission for temporary exploratory potash borehole and associated plant, equipment including drilling rig (max height 33 metres) and access arrangements at land at Newton House Plantation, Littlebeck for York Potash Ltd, fao; Mr Niall Kelly, 2 Langley Court, Wykeham Business Centre, Wykeham, Scarborough, North Yorkshire, YO13 9QP. Decision Tim Lawn declared a personal and prejudicial interest in this item as a landowner with mineral rights and left the room. Herbert Tindall chaired this application in Tim Lawn’s absence. The Authority’s solicitor Richard Smith declared a conflict of interest in this item due to his connections with Scarborough Borough Council and left the room. Planning Minute/3 Approved as recommended with an amendment to condition 2 to include the ‘Report Measures Noise’ dated 22 May 2012, removal of condition 3 which relates to the Drilling Method Statement and associated reason and subsequent renumbering of the remaining conditions and reasons together with the addition of three conditions as set out on the Members Update Sheet: 5. Prior to the clearing of the site in preparation for the installation of equipment or cabins etc a species survey shall be conducted to check for the presence of Nightjar. The proposed scope for the survey shall be submitted to and approved in writing by the Local Planning Authority prior to the survey taking place. The survey shall then be conducted in accordance with the approved details. Should Nightjar be found to be impacted upon by the proposed development the survey shall include appropriate mitigation measures which must be adhered to in the course of development. 6. Facilities for precautions to prevent the deposit of mud, grit and dirt on public highways by vehicles travelling to and from the site similar to that used on the nearby site (application NYM/11/756/FL), agreed with the Highway Authority shall be in place. These facilities shall include the provision of wheel washing facilities where considered necessary by the Local Planning Authority in consultation with the Highway Authority. These precautions shall be made available before any excavation or depositing of material in connection with the construction commences on the site and be kept available and in full working order and used until such time as the Local Planning Authority in consultation with the Highway Authority agrees in writing to their withdrawal. 7. Unless otherwise approved in writing by the Local Planning Authority, there shall be no establishment of a site compound, site clearance, demolition, excavation or depositing of material in connection with the submitted details of temporary warning signs are erected. Thereafter the approved signs shall be maintained until the completion of construction works on the site. 6. NYM/2012/0216/FL – Permission for temporary exploratory potash borehole and associated plant, equipment including drilling rig (max height 33 metres) and access arrangements at land at Mortar Hall Farm, Sneaton for York Potash Ltd, fao; Mr Niall Kelly, 2 Langley Court, Wykeham Business Centre, Wykeham, Scarborough, North Yorkshire, YO13 9QP. Decision Tim Lawn declared a personal and prejudicial interest in this item as a landowner with mineral rights and left the room. Herbert Tindall chaired this application in Tim Lawn’s absence.
