In case there is a conflict, the provisions herein shall prevail over those in Section II: Instructions to Bidders. Instructions to Particulars Bidders Article Scope of Bid The goods include the Methadone Take Home Dose Container in one lot as further described (Article 1) in Section IV of this ITB. This ITB is conducted in accordance with the applicable provisions of UNOPS Procurement Interpretation of Manual (latest version of which can be accessed at: the ITB https://www.unops.org/english/Opportunities/suppliers/how-we-procure/Pages/default.aspx) (Article 2) and other relevant Organisational Directives and Administrative Instructions that are referred to in the Procurement Manual. In case of contradictions between this ITB and the UNOPS Procurement Manual, the UNOPS Procurement Manual shall prevail. Bidder Eligibility No nationalities are excluded from submitting a bid. (Article 4) Requests for clarification from bidders will not be accepted later than 17:00 Hr (Myanmar Clarifications Standard Time, GMT+ 6.30 hrs) on 22nd Feb 2017. (Article 7) and Amendments Responses to requests for clarification and/or amendments shall be communicated to bidders (Article 3) by posting responses on UNOPS’ website at https://www.unops.org/english/Opportunities/suppliers/Pages/Business-opportunities.aspx under ITB Case No. MYA/17/MMOC/PR/GF-NFM/ITB-ICB/0011. Clarification or Pre-bid Meeting shall not be held. Pre-bid Meeting (Article 8) Site Inspection Deleted (Article 9) Bids shall remain valid for acceptance by UNOPS for 90 days from the Deadline for Bid Bid validity period Submission. (Article 12) Partial bids Partial bids shall not be allowed. Bidder must offer for the total requirement as provided in (Article 13) Section IV: Schedule of Requirements. Evaluation will be done for total requirement of the lot. Alternative bids Alternative bids are not accepted. (Article 14) 3 ITB Ref No: MYA/17/MMOC/PR/GF-NFM/ITB-ICB/0011 Bid Currency(ies) Prices shall be quoted in USD/MMK. (Article 16) UNOPS may accept bids submitted in another currency than stated above if the Bidder confirms during clarification of bids in writing that it will accept a contract issued in the mandatory bid currency and that for conversion the official United Nations operational rate of exchange of the day of ITB deadline shall apply. Regardless of the currency of bids received, the contract will always be issued and subsequent payments will be made in the mandatory bidding currency above. Duties and Taxes The offer shall be submitted net of any direct taxes, customs duties and indirect taxes, such as (Article 17) sales taxes, VAT, etc Bid Security Bid security is not required. (Article 18) Language of bids All bids, information, documents and correspondence exchanged between UNOPS and the (Article 20) bidders in relation to this bid process shall be in English. Deadline for Bid All bids must be submitted by 12:00 hrs, Myanmar Standard Time (GMT+ 6.30 Hrs) on Submission 28th Feb 2017. (Article 21) 4 ITB Ref No: MYA/17/MMOC/PR/GF-NFM/ITB-ICB/0011 Bids must be submitted as follows: Bid Submission Option 1 : By mail or personal delivery in sealed envelopes by the Deadline for Bid (Article 22) Submission. The sealed envelopes shall contain one soft copy and two hardcopies. The two hardcopies shall comprise one original hardcopy bid marked “Original”. One hardcopy of the bid marked “Copy" shall also be submitted. In the event of any discrepancy between the soft and/or hardcopies of the bid, the bid marked as “Original” shall govern. UNOPS shall not be responsible for any delays caused by network problems etc. It is the sole responsibility of Bidders to ensure that their Bid is received by UNOPS in the dedicated inbox on or before the prescribed tender deadline. Bid opening Time: 15:00 Hr, Myanmar Standard Time on 28th Feb 2017. Opening of Bids Public bid opening will not be held. (Article 24) Type of contract to UNOPS will sign the following contract with the awarded bidder(s): Purchase order be awarded (Article 33) UNOPS plans to award the contract by March 2017. Security (Article 34) Payment terms (Article 35) As provided in the Special Conditions of Contract (SCC) Advanced Advanced payment is not allowed. Payment (Article 35) Subject to the provisions of the GCC clause 16, UNOPS will deduct from the Contract price, as Liquidated liquidated damages, a sum equivalent to the percentage of 0.3% of the original total Contract damages price for each day of delay until actual delivery or performance, up to a maximum deduction (Article 36) of 10%.
