PROPOSAL 1.1 In the interest of orderly and proper development, it is recommended that Cabinet endorse the City of Playford Heritage Plan Amendment Report to come into operation on an interim basis pursuant to section 28(1) of the Development Act 1993. 1.2 The Plan Amendment Report be referred to the Governor for declaration by notice published in the Gazette that the Plan Amendment Report has come into operation, pursuant to section 28 of the Development Act 1993. 1.3 That the file subsequently be referred to the office of the Minister for Urban Development and Planning so that a report can be laid before both Houses of Parliament for notification under section 28(3) of the Development Act 1993. 2. BACKGROUND The City of Playford has submitted the Heritage Plan Amendment Report (PAR) requesting that it be approved for public consultation, and brought into operation on an interim basis in accordance with section 28(1) of the Development Act 1993. The former City of Elizabeth and City of Munno Para, prior to amalgamation, each commissioned heritage surveys that were completed in 1996 and 1997, respectively. The aims of the surveys were to: . make recommendations for the entry of places in the State Heritage Register and for the declaration of State Heritage Areas . identify areas which could be declared Historic Conservation Zones or Policy Areas for inclusion in the Development Plan . provide a local heritage register of land, buildings and structures for inclusion in the Development Plan. Due to the lapse in time since these surveys were completed, Council engaged McDougall and Vines, Conservation and Heritage Conspltants, to review the recommendations of the surveys. These revised recommendations form the basis of this PAR, which intends to identify heritage places in the Development Plan and introduce policies to assist in the assessment of development which affects places of State or local heritage significance. 3. DISCUSSION 3.1 Main Policv Chanqes 3.1.1 The intent of the PAR is to identify State and local heritage places In the Development Plan and introduce policies to assist in the assessment of development which affects these places. The PAR proposes to: . review existing Metropolitan, Mount Lofty Ranges and Council-wide policies to identify outdated, duplicated or conflicting policies and amend as appropriate . embellish existing zone provisions andlor incorporating new objectives and principles as appropriate to identify and protect those areas with a distinctive character . introduce a table of local heritage places, and a separate table of existing State heritage places identified underthe Heritage Act . introduce public notification categories affecting local heritage places and State heritage places with particular regard to minor development, demolition, land division and additions and extensions . exempt development affecting heritage places from a complying classification in a number of zones. 3.1.2 State Heritage Places The Munno Para Heritage Survey recommended a three places for entry in the State Heritage Register, two of these places were successful nominations, while the third was unsuccessful. The Elizabeth Heritage Survey did not identify places for the State Heritage Register. The McDougall and Vines review did not identify any additional places of State Heritage significance. 3.1.3 Local Heritage Places The McDougall and Vines review of the heritage surveys re-assessed each proposed listing with regard to the criteria contained within section 23(4) of the Development Act. The review also found that a number of listings recorded in the original surveys have since been either demolished or rejected, and accordingly have been omitted from the list. 3.1.4 Potential Heritage Areas & Historic (Consef'IJation)Zones A number of areas within the City of Playford in the original heritage surveys for Munno Para and Elizabeth were identified for potential areas as Historic (Conservation) Zones. These areas included Elizabeth South, Elizabeth Town Centre, the early villages of One Tree Hill Village Centre, Smithfield Early Village Centre and Virginia Village Centre. In reviewing these areas, McDougall and Vines concluded and recommended that these areas do not warrant such a level of control, however some items within these areas may still be included and considered as local heritage places. 3.2 Strateqic Issues 3.2.1 The PAR Is in accordance with the Planning Strategy for the Development of Metropolitan Adelaide, January 1998, which supports the conservation and management of places of cultural heritage and local importance. 3.3 Consultation 1.3.1 Public and agency consultation on the PAR has not occurred, therefore formal agency comments have not yet been sought. A copy of the PAR was forwarded to Heritage SA, no comments were received at this time. Heritage SA have been included as an agency to be consulted during the formal agency consultation period. 1.3.2 The Member for Napier, Mr Michael O'Brien, Member for Elizabeth, Hon Lea Stevens, Member for Taylor, Hon Lea Stevens and the Member for Light, Mr Malcolm Buckby have been sent a copy of the PAR, no concerns were raised by these members. 1.3.3 I have granted approval for the PAR to be released for public consultation. 3.4 Interim Effect 3.4.1 In the interest of orderly and proper development of the area, the PAR can now be brought into interim effect, pursuant to section 28 of the Development Act 1993. 3.4.2 Council has requested that the PAR be allowed to operate on interim operation in order to ensure that development prejudicial to the proposed objectives of the Heritage PAR, such as demolition and inappropriate alterations, cannot oc ur while the merits of the policies are being considered. In this instance, interim operation is in the interests of the orderly and proper development of an area as it will establish controls that ensure the protection and conservation of heritage places. 3.5 Cabinet Issues 3.5.1 Economic. financial and budqet implications There are no capital and recurrent costs or revenue implications associated with the proposal. 3.5.2 State development. social. environmental and other impacts The proposal will not have an adverse impact on families. (Regard has been given to the Cabinet decision on 25/7/94 concerning FAMILY IMPACT STATEMENTS. 3.5.3 Staffinq implications Interim operation for this PAR will not have an effect on public sector employment levels. 3.5.4 Executive Council This proposal will forward the PAR to the Governor in Executive Council for declaration that the PAR be brought into interim operation. 4. Signature Date jt",,,, (("~.(.--7(.u~,~ Development Act 1993 CITY OF PLAYFORD - PLAYFORD (CITY) DEVELOPMENT PLAN Heritage Plan Amendment Report by the Council Explanatory Statement E" lanatory Statement City o~ Playford - Hernage Plan Amendment Report 1 INTRODUCTION The City of Playford (the "Council") has reviewed its Development Plan to determine whether there are appropriate policies in place to ensure the protection and management of the many heritage assets in the Council area. For Council, it is a goal to make a positive commitment to the concept of heritage conservation and development within its boundaries. In doing so, the City of Playford is seeking to recognise the need of the general communily for some sense of place and connection with the early development of the area in which they live. As a consequence of this investigation Council will be reinforcing the objectives of the State Planning Strategy which includes a commitment to the retention and care of places of heritage significance within South Australia. The long-term management of heritage presents the need to incorporate heritage policies that. introduce legal controls over heritage places and areas. The approach being sought focuses on setting a framework for Council and community involvement in the recognition of the value of heritage within the City of Playford. It is appropriate that this investigation and Plan Amendment be undertaken separately from other investigations and Plan Amendment Reports (PARs)as there are additional legislative procedures which must be followed when dealing with proposed heritage places and areas. The former Elizabeth and Munno Para Councils each commissioned a Heritage Survey which were completed in 1996 and 1997 respectively.
