H.B.ANo.A1333 Substitute the following forAH.B.ANo.A1333: By:AAHerrero C.S.H.B.ANo.A1333 A BILL TO BE ENTITLED 1 AN ACT 2 relating to the designation of certain synthetic compounds to 3 Penalty Group 2 or 2-A of the Texas Controlled Substances Act. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTIONA1.AASections 481.002(5) and (6), Health and Safety 6 Code, are amended to read as follows: 7 (5)AA"Controlled substance" means a substance, 8 including a drug, an adulterant, and a dilutant, listed in 9 Schedules I through V or Penalty Group [Groups] 1, 1-A, [or] 2, 2-A, 10 3, or [through] 4. The term includes the aggregate weight of any 11 mixture, solution, or other substance containing a controlled 12 substance. 13 (6)AA"Controlled substance analogue" means: 14 (A)AAa substance with a chemical structure 15 substantially similar to the chemical structure of a controlled 16 substance in Schedule I or II or Penalty Group 1, 1-A, [or] 2, or 17 2-A; or 18 (B)AAa substance specifically designed to produce 19 an effect substantially similar to, or greater than, the effect of a 20 controlled substance in Schedule I or II or Penalty Group 1, 1-A, 21 [or] 2, or 2-A. 22 SECTIONA2.AASection 481.103(a), Health and Safety Code, is 23 amended to read as follows: 24 (a)AAPenalty Group 2 consists of: 83R13830 JSC-F 1 C.S.H.B.ANo.A1333 1 (1)AAany quantity of the following hallucinogenic 2 substances, their salts, isomers, and salts of isomers, unless 3 specifically excepted, if the existence of these salts, isomers, 4 and salts of isomers is possible within the specific chemical 5 designation: 6 alpha-ethyltryptamine; 7 alpha-methyltryptamine; 8 5-(2-aminopropyl)benzofuran (5-APB); 9 6-(2-aminopropyl)benzofuran (6-APB); 10 5-(2-aminopropyl)-2,3-dihydrobenzofuran 11 (5-APDB); 12 6-(2-aminopropyl)-2,3-dihydrobenzofuran 13 (6-APDB); 14 5-(2-aminopropyl)indole (Trade or other names: 15 5-IT, 5-API); 16 6-(2-aminopropyl)indole (Trade or other names: 17 6-IT, 6-API); 18 Benzothiophenylcyclohexylpiperidine (BTCP); 19 4-bromo-2, 5-dimethoxyamphetamine (some trade or 20 other names: 4-bromo-2, 5-dimethoxy-alpha-methylphenethylamine; 21 4-bromo-2, 5-DMA); 22 4-bromo-2, 5-dimethoxyphenethylamine; 23 8-bromo-alpha-methyl-benzo[1,2-b:4,5-b ']difuran- 24 4-ethanamine (Trade or other name: Bromo-DragonFLY); 25 Bufotenine (some trade and other names: 3-(beta- 26 Dimethylaminoethyl)-5-hydroxyindole; 6 C.S.H.B.ANo.A1333 1 Etaqualone and its salts; 2 Etorphine Hydrochloride; 3 Fenethylline and its salts; 4 Lisdexamfetamine, including its salts, isomers, 5 and salts of isomers; 6 Mecloqualone and its salts; 18 N,N,alpha-trimethylphenethylamine), its salts, optical isomers, 19 and salts of optical isomers; and 20 (4)AAany compound structurally derived from 21 2-aminopropanal by substitution at the 1-position with any 22 monocyclic or fused-polycyclic ring system, including: 23 (A)AAcompounds further modified by: 24 (i)AAsubstitution in the ring system to any 25 extent (including alkyl, alkoxy, alkylenedioxy, haloalkyl, 26 hydroxyl, or halide substituents), whether or not further 27 substituted in the ring system by other substituents; 7 C.S.H.B.ANo.A1333 1 (ii)AAsubstitution at the 3-position with an 2 acyclic alkyl substituent; or 3 (iii)AAsubstitution at the 2-amino nitrogen 4 atom with alkyl, [or] dialkyl, benzyl, or methoxybenzyl groups, or 5 inclusion of the 2-amino nitrogen atom in a cyclic structure; and 6 (B)AAby example, compounds such as: 7 4-Methoxymethcathinone (Also known as 8 Methedrone); 9 4-Methylmethcathinone (Also known as 10 Mephedrone); 11 3,4-Dimethylmethcathinone (Also known as 12 3,4-DMMC); 13 3-Fluoromethcathinone (Also known as 3-FMC); 14 4-Fluoromethcathinone (Also known as 15 Flephedrone); 16 3,4-Methylenedioxy-N-methylcathinone (Also 17 known as Methylone); 18 3,4-Methylenedioxypyrovalerone (Also known 19 as MDPV);
