A.C. Behera Superintending Engineer(N.C) OLIC, Sambalpur</p><p>Other terms and Condition :</p><p>Tender papers will be sold at L.I. Division, Office Sundargarh / L.I. Subdivision Bonai / Rourkela during office hours on working days from 21.11.2007 to 26.11.2007 on payment of requisite tender paper cost as mentioned above. The tender box will be made available for dropping of tender simultaneously at LI Division Office, Sundargarh and LI Sub-Division Office Bonai/ Rourkela from 11a.m. to 1 p.m. on 27.11.2007. The contractors may drop any package at any of the above places during the time mentioned at his convenience. </p><p>The tenders will be opened on 28.11.2007 at 11.30 a.m. at L.I. Division Office, Sundargarh in the presence of the bidders who wish to attended or their authorized representative if any, after collecting all tender boxes from different places and total tender paper received by the division office. If the office happens to be closed on the date of dropping & opening as mentioned above, the tenders will be received & opened on next working day at the same time and same venue. The cost of tender paper may be deposited in shape of cash at above three offices or by deposit of a demand draft issued by any nationalized bank in favour of Executive Engineer, Lift Irrigation Division, Sundargarh payable at Sundargarh. A party who wants to purchase more than one packages may deposit cost of those packages in shape of one draft.</p><p>The tender papers requested by mail will be despatched by Registered Post/Speed Post on payment of an extra amount of Rs. 500.00 over the cost of tender paper. Tender papers may be submitted by Registered Post/Speed Post addressing to Executive Engineer, Lift Irrigation Division, At-Old Central School Building, Sundargarh and the postal tenders must reach at Division Office on or before 5 P.M. of Dt.27.11.2007. The tenders received through Post will be opened on date & time as fixed above. However the department will not be responsible for any lapses or delay in postal movement on both the cases.</p><p>The tenders must be accompanied with attested copies of valid H.T. license, PAN Card, valid VAT clearance in form no. 612 and E.M.D. as mentioned above in shape of A/c Payee Demand Draft issued by any nationalized bank, in favour of Executive Engineer, L.I. Division, Sundargarh Payable at Sundargarh. A tenderer who wants to participate in more than one packages may deposit E.M.D. of those packages in shape of one draft as mentioned above, but however a statement mentioning the EMD deposited package wise should be enclosed along with the tender.</p><p>Tender papers will also be made available for downloading from official website of Govt. of Orissa (www. Sundargarh.nic.in/tender.htm) with effect from 21.11.2007 to 26.11.2007. The tenderers who have downloaded the tender papers from official website of Govt. of Orissa are required to deposit the cost of tender papers of those packages for which they will submit their bids, in shape of A/c Payee Bank Draft issued by any nationalized bank in favour of Executive Engineer, L.I. Division, Sundargarh payable at Sundargarh. This draft must be prepared on or before the last date of selling tender papers as mentioned above and this draft should be enclosed in a separate envelope superscribing “ Cost of tender paper downloaded from website” on the top of the envelope and mentioning the package no. for which draft has been submitted. This envelope should be enclosed along with the tender paper & other documents in another sealed envelope. B to Annx.H for power supply to proposed Lift Irrigation Projects under different Blocks of different districts as mentioned in Part IV </p><p>2.2 Eligibility</p><p> a. The contractor should have valid H.T. license issued by the Electrical Lessening Board, Orissa and validity of the license should be for a period of at least 3 months from the date of opening of the tender. b. The contractor should have valid VAT clearance certificate (Form No. 612) and PAN issued by I.T. Department.</p><p>2.3 Cost of Tender documents The cost of tender paper for different packages has been mentioned in tender call notice (please refer Part VI) 2.4 Date of Sale of Tender Documents The tender papers can be purchased during the period and in the manner as mentioned in the tender call notice (Part – VI) 2.5 Receipt and Opening of Tender Paper The tender shall be received and opened on the day and time as stipulated and mentioned in tender call notice (Part-VI). The tenderers or their authorized agents are advised to witness the opening of the tenders. </p><p>2.6 Postal Tender & Downloading from Website Tender papers can be purchased through Postal mail and can be submitted through Post as per the manner mentioned in the tender call notice (Part – VI)</p><p>Tender paper can also be downloaded from Govt. Website and can be submitted as per the manner mentioned in the tender call notice (Part – VI) 2.7 Document to be Submitted The tender papers should be submitted with following documents: i) Original tender papers as received from the Department with signature on each page or tender papers downloaded from website with signature on each page. The department will not be responsible in case there is any missing of any page or article in the website. The original copy available at L.I. Division Office will be the final in this case. ii) EMD in shape of A/c Payee Bank Draft/ Banker’s Cheque issued by any Nationalized Bank in favour of Executive Engineer, L.I. Dvn., Sundargarh payable at Sundargarh. The amount of EMD to be deposited for different packages has been mentioned in the tender call notice. A Contractor participating in more than one packages may deposit E.M.D. of those packages in shape of one Bank Draft issued in favour of E.E. L.I. Dvn., Sundargarh, payable at Sundargarh. In this case, a sheet mentioning the package No. and corresponding amount deposited for that package must be enclosed. iii) Attested copies of H.T. License, VAT clearance certificate in form No. 612 and PAN issued by I.T. Departments. iv) The attested copy of articles of association registration of the firm/company, in case the tenderer is a firm/company.</p><p>2.8 Signature of tenderer Incase the tenderers is described as a proprietorship firm, the tender shall be signed by the proprietor in the name of the firm or by a person holding power of Attorney to do so on behalf of the proprietor. In case of the tenderer is a partnership firm, the tender shall be signed by each partner or by a person holding power of attorney authorizing him to do so on behalf of all the partners of the firm. In case the tenderer is a Company, the tender shall be executed in the manner laid down in the said Company’s Article of Association. For Liasioning with OLIC during execution of the work, receipt of payments on accounts of completion of work etc., the above procedure is to be followed. </p><p>2.9 Language of Tender & Use of Ball Pen The tenderer should fill up the documents in English Language only and should use ball pen for filling the tender paper. 2.10 Quoted Rates & Amount The tenderer shall quote rate per unit or work and amount (rate x scope of work) for each item clearly in the price bid format (Part – V) enclosed. The price bid format has been enclosed separately for each package. A tenderer should fill up the price bid format meant for those packages only, for which he wants to participate and has paid the cost of paper. Any other price bid filled by a tenderer for which he has not paid the paper cost will not be accepted. 2.11 Tenderer Address The tenderer shall enclose with the tender his Postal Address fully and clearly. 2.12 Conditional Tenders Conditional Tenders are liable for rejection 2.13 Eraser or Alternation No eraser or alternation in the text of the tender papers is permitted and any such eraser and / or alternation will either be disregarded or render the whole tender void at the option of the Executive Engineer, Lift Irrigation Division, Sundargarh. Any correction made by the tenderer must be authenticated duly by dated initials of the authorized signatory of the tenderer. 2.14 Validity of Tender The tender submitted shall remain valid for 90 days from the date of opening of the tender and may be extended at the discretion of the tenderer, if so needed by Orissa Lift Irrigation Corporation 2.15 Parts of Tender Tenders shall be submitted in sealed cover. 2.16 Incomplete Tenders Tenders received in incomplete shape are liable for rejection.</p><p>2.17 No Claim for Cancellation of Tenders No claim shall be entertained towards any expenses made by any tenderer for submission of the tender incase of cancellation, rejection or withdrawal of the tender.</p><p>2.18 Execution of Agreement An agreement in the prescribed form shall be executed by the successful tenderer with the Executive Engineer, L.I. Division, Sundargarh within 10 (ten) days from the date of issue of the letter of intent. The Tender Paper will also form part of the agreement. The agreement shall be on stamped paper of worth Rs. 21.00 (Rupees twenty one only) and the contractor shall pay the cost of stamps and legal expenses.</p><p>2.19 Time of Completion The Contractor has to complete the work within 45 days from the date of issue of the work order by Executive Engineer and within 30 days from the date of completion the contractor has to handover the S/S and Power Line to WESCO after obtaining inspection report from the Electrical Inspector. 2.20 Discrepancies In case of any discrepancy in the description of the items in the Tender Call Notice, the decision of the Executive Engineer / Superintending Engineer, OLIC shall be final, binding and conclusive for the purpose of this contract. 2.21 Site Inspection by Tenderer Before tendering, the contractor must satisfy himself fully on the site conditions, all information included herein, all limitations and official regulations at the site of work etc. Failure to comply to the above requirements, will not relieve a tendererof his obligations and no claim whatsoever shall be entertained on the ground of ignorance of site or other conditions prevailing in the area. Any further the data required during the execution of the scheme shall be ascertained by the contractor at his own cost. The offer should cover all cost required to suit to the site condition etc. 2.22 Supply of Materials The contractor shall make his own arrangements for procurement of all materials, equipments, tools and plants etc. The materials supplied by the contractor shall confirm to relevant latest editions of the specification and code of practices of the Bureau of India standards or in their absence to other specifications as may be specified by the OLIC. The contractor shall furnish necessary certificate in support of the quality of the materials as may be required by OLIC. The Engineer- in-Charge of OLIC shall have absolute authority to test the quality of materials any time though any reputed laboratory at the cost of the contractor. The contractor may be required to submit </p><p> original purchase bills of the materials before the Executive Engineer, Lift Irrigation Division, Sundargarh. 2.23 Construction Schedule The contractor shall submit a detailed work schedule (in duplicate) in the form of Bar Chart along with his tender indicating the detailed break –up of the job. This will include all operations from procurement of materials to final testing at site be indicated in details with reference to the time period for each. The construction schedule, submitted by the successful contractor will be approved by Executive Engineer, OLIC, Sundargarh with revisions and rectifications, if any, and the revised schedule shall be resubmitted by the contractor, duly signed, at the time of agreement. This approved schedule will form a part of agreement.</p><p>2.24 Site Order Book A site order book shall be issued to the contractor by the Executive Engineer, OLIC, Sundargarh or by Assistant Engineer (Elect), OLIC, Sundargarh. The contractor shall keep this book always at site and any special order or instruction to be issued to the contractor shall be recorded in this book by the Engineer-in-Charge or his representative. The contractor shall sign all orders and instructions as token in his knowledge about the same. The site order book shall be property of the department but will remain during the period of the progress of the work with the contractor. The safe custody of the site order book during this period shall be responsibility of the contractor. After completion of the work, the book shall be returned back by the contractor to the Engineer-in-Charge, which will be enclosed, in the final bill. 2.25 Transportation The contractor shall be responsible for the transportation of all materials, tool and plants, equipments, machinery etc. to the work site as may be required at site. 2.26 Custody of the Materials The contractor shall be responsible for safe custody of the materials at site and OLIC will not be responsible for any loss or damage of the property at site. 2.27 Guarantee The contractor shall furnish a guarantee to the effect that all items of the work constructed and supplied by him shall be free from any defect both in terms of materials and workmanship for a period of not less than 12 months from the date of the handling over to WESCO. During this period the contractor shall replace the defective materials if any or rectify the defect, if any, at his own cost as pointed out by the E.E. OLIC, Sundargarh to the satisfaction of the later within fifteen days of intimation. If the contractor fails to rectify the faults properly within the time period allotted by E.E. OLIC, for the larger interest of public utility, the E.E. OLIC, Sundargarh may appoint any other contractor to rectify the faults or may rectify departmentally and the cost so involve will be deducted from the security money of the original contractor. This cost of rectification will be decided by E.E., OLIC, as founded suitable by him and the original contractor will have no challenge to it. 2.28 Security Deposit The successful tenderer shall deposit 2% of the accepted tendered amount, deducting the E.M.D. earlier deposited, within a prescribed period from the date of issue of the letter in intent to him of acceptance of his tender and sign the agreement in the prescribed form.The total amount of security money deposited by the contractor shall be 7% of the accepted tender amount. The balance security amount will be made up by deducting 5% of the amount of the gross payment of the bill. The security amount shall be deposited in the shape of Bank Draft/ Banker’s Cheque issued by any Nationalised Bank in favour of the Executive Engineer, L.I. Division, Sundargarh payable at Sundargarh . 2.29 Release of Security Deposit The security deposit amount will be considered for refund to tenderer only after completion of guarantee period. 2.30 Unilateral Stoppage of Work Unilateral stoppage of work by the contractor without prior written permission of Executive Engineer shall be considered as breach of contract and OLIC reserves the right to take such actions as it may be deemed fit. 2.31 Force-majeure Neither the contractor nor OLIC shall be considered in default in delayed performance of its obligation if such performance is presented or delayed because work to hostilities, revolution, civil commotion , accident, fire, cyclone, flood. Earthquake or because of any law and order proclamation, regulations or ordinance of the Government thereof or because of any act of God or for any cause beyond reasonable control of the party affected should one or both the parties be prevented from fulfilling their contractual obligations a stage of force majeure lasting continuously for a period of 6 months, the two parties shall consult each other regarding the future execution of the contract for mutual settlement.</p><p>2.32 Damages to persons and property The contractor shall take every precaution not to damage or injure adjoining or other property of any person. He shall indemnify and keep indemnified the employee against all claims for injuries or damages to any person or any such property (including surface or land or crops in site)which may arise out of or in consequence of any negligence or default on the representatives and against all claim , demands proceedings damages, costs , charges and expenses what so ever in respect of or in relation thereto. The OLIC does not take any responsibility on this account. 2.33 Preventing public from accident No materials on any place of the sites shall be so stacked or placed as to cause danger or inconvenience to any person or public. The contractor shall provide all necessary fencing and light to protect the public from accident and shall be bound to bear expenses of defence or any suit action or other proceedings at law that may be brought by any person for injury sustained owing to neglect of the above precaution and to pay any damages and cost which may be awarded in any such suit action or proceedings to any such person or which may with consent of the contractor be paid to compromise any claim by any such person. 2.34 Scope of work The detail scope of work has been included at Para IV . The scope of work maybe altered by Executive Engineer/Assistant Engineer (Elect), OLIC depending on field situations. The Contractor shall execute all such works at the unit rates quoted after getting written order from Executive Engineer/ Assistant Engineer (Elect)of OLIC. Such order may also be given in the site order book by the Executive Engineer / Asst. Engineer (Elect) of OLIC Division, Sundargarh. 2.35 Approval of Electrical Inspector The contractor on completion of work shall arrange for inspection of the Electrical Inspector and obtain the formal approval for energisation of the sub station and one copy of approval shall be submitted to the Executive Engineer. The fees payable for the above work shall be initially borne by the Contractor, which will be reimbursed by OLIC as per Govt norms. 2.36 Liaison with WESCO The Contractor shall also do liaison with WESCO for connection or short down for charging the sub-station and handing over the project to WESCO after completion. Fees/ expenses, if any, for the above work shall be borne by the Contractor. </p><p>2.37 Request to EI/ WESCO The Executive Engineer /Assistant Engineer (Elect) OLIC will furnish the required letters to Electrical Inspector & WESCO for the work as mentioned in Column 2.35 and 2.36. 2.38 The tenderer may be required to produce labour license as per Govt. norm. </p><p>PART – III</p><p>CONDITIONS OF CONTRACT 3.1 All compensation or other sums of money payable by the contractor to OLIC under the terms of his contract may be deducted from, or paid by, the sale of a sufficient part of his security deposit or from the interest arising there from, or from any sums which may be due or may become due to the contractor by OLIC on any account whatsoever and in the event of his security deposit being reduced by reason of any such deduction or sale as aforesaid, the contractor shall within ten days there after make good in cash or Government securities endorsed as aforesaid any sum or sums which may have been deducted from, or raised by, sale of the security deposit or any part thereof.</p><p>3.2 Compensation for delay:</p><p>The time allowed for caring out the work as entered in the tender shall be strictly observed by the contract and shall be reckoned from the date on which the written order to commence work is given to the contractor. The work shall throughout the stipulated period of the contract be carried on with all due diligence (time being deemed to be of the essence of the contact on the part of the contractor) and the contractor shall pay as compensation and amount equal to ½ percent on the amount of the estimated cost if the whole work as shown by the tender for every day that the work as shown by the tender for every day that the work remains uncommented , or unfinished after the proper dates . The work should not be considered finished until such date as the Executive Engineer shall certify as the date on which the work is finished after necessary rectification of defects as pointed out by the Executive Engineer or his authorised agent are fully compiled with by the contractor to the Executive Engineers satisfaction . And further to ensure good progress during the execution of the contractor shall bound , in all cases in which the time allowed for any work exceeds one month , to complete one-forth of the whole work before one-forth of the whole time allowed under the contract has clasped has , one-half of the work before one-half of such time has elapsed , and three forth of the work , before three forth of such time has elapsed , in the event of the contractor failing to comply with the condition , he shall be liable to pay as compensation an amount equal to one third percent on the said estimated cost of the whole work for every day that the due quantity of this clauses shall not exceed 5% on the estimated cost of the work as in the tender .</p><p>3.3 Action when whole security deposit is forfeited :</p><p>In any case in which under any clause or clauses of this contract the contractor shall have rendered himself liable to pay compensating amounting to the whole of his security deposit in the hands of OLIC (whether paid in one sum or deducted by installments ) the Executive Engineer , OLIC shall have power to adopt any of the following course , as he may deem best suit to the interest of OLIC . a. To rescind the contract ( of which rescission notice in writing to the contractor under the hand of the Executive Engineer shall be conclusive evidence) and in which case, the security deposit of the contractor shall stand forfeited, and be absolutely at the disposal of OLIC.</p><p> b. To employe labour paid by the OLIC and to supply materials to carry out the work, or any part o the work, debiting the contractor with the cost of the labour and the price of the materials (of the amount of which cost and price certificate of the Executive Engineer shall be final and conclusive against the contractor) and crediting him with the value of work done in all respects in the same manner and at the same rates as if it had been carried out by the contractor under the terms of his contract; the certificate of the Executive Engineer as to the value of the work done shall be final and conclusive against the contractor.</p><p> c. To measure the work of the contractor, and to take such part of the work of the contract as shall be unexecuted out of his hands and to give it to another contractor to complete. In which case any expenses which may be incurred in excess of the sum which would have been paid to the original contractor if the whole work had been executed by him (of the amount of which excess the certificate in writing of the Executive Engineer shall be final and conclusive) shall be borne and paid by the original contractor and may be deducted from any money due to him by OLIC under the contract and may be deducted from any money due to him by OLIC under the contract or otherwise from his security deposit or the proceeds of sale thereof, or a sufficient part thereof.</p><p> d. In the event of any of the above course s being adopted by the Executive Engineer, the contractor shall have no claim to compensation for any loss sustained by him by reason of his having purchased or procured any material, or entered in to any engagement or made any advances on account, or with a view to, the execution of the work or the performance of the contract. And in case the contract shall be rescinded under the provision aforesaid, the contractor shall not be entitled to recover or be paid any sum for any work thereto for actually performed under this contract, unless and until the Executive Engineer shall have certified in writing the performance of such work and the value payable in respect thereof, and he shall only be entitled to be paid the value so certified.</p><p>3.4 Contractor remains liable to pay compensation if action not taken : In any case in which any of the powers, conferred upon the Executive Engineer by Clause 3.3 hereof shall have become exercisable and the same shall not be excerised, the non exercise thereof shall not constitute a waiver of any of the conditions hereof and such powers shall not withstanding be exercisable in the event of any feature case of default by the contractor of which by any clause or clauses hereof he is declared liable to pay compensation amounting to the whole of his security deposit, and the liability of the contractor for past and future compensation shall remain unaffected. In the event of the Executive Engineer putting in force the power vested in him under the preceding clause he may, if he so desire, take possession of all or any tools, plants, materials and stores, in or upon the works, or the site there of or belongin to the contractor, or procured by him and intended to be used for the execution of the work or any part thereof, paying or allowing for the same in the account at the contract rates, or. In case of these not being applicable, at current market rates to be certified by the Executive Engineer, whose certificate thereof shall be final, otherwise the Executive Engineer may be notice writing to the contractor or his clerk of the works, foreman or other authorised agent require him to remove such tools plants, materials or stores from the premises (within a time to be specified in such notice); and in the event of the contractor failing to comply with ; any such requisition, the Executive Engineer may remove them at the contractor’s expense or sell them by auction or private sale on account of the contractor and at his risk in all respects and the certificate of the Executive Engineer as to the expense of any such removal and the </p><p> amount of the proceeds and expense of any such sale shall be final and conclusive against the contractor.</p><p>3.5 Time Extension :</p><p>If the contractor shall desire an extension of the time for completion of work, on the ground of his having been unavoidably hindered in its execution or any other ground, he shall apply in writing to the Executive Engineer before the end of time period allotted in work order for which he desires such extension as aforesaid and the Executive Engineer shall, if in his opinion (which shall be final) is on reasonable grounds, be shown therefore, authorise such extension of time, if any, as may in his opinion, be necessary or proper. The Executive Engineer shall at the same time inform the contractor whether he claims compensation for delay.</p><p>3.6 Final Certificate :</p><p>On completion of the work the contractor shall be furnished with a certificate by the Executive Engineer (hereinafter called the Engineer-in-Charge) of such completion, but no such certificate be given nor shall the work be considered to be complete until the contractor shall have removed from the area of the premises on which the work shall be executed all scaffolding, surplus materials, and rubbish, and cleaned off the dirt. If the contractor shall fail to comply with the requirements of this clause as to removal of scaffolding, surplus materials and rubbish, and cleaning off dirt on or before the date fixed for the; completion of the work, the Engineer-in-Charge may at the expense of the contractor remove; such scaffolding surplus materials and rubbish, and dispose of the same as he thinks fit and clean off such dirt as aforesaid; and the contractor shall forthwith pay the amount of all expenses incurred, and shall have no claim in respect of any such scaffolding or surplus materials as aforesaid, except for any sum actually relaxed by the scale thereof.</p><p>3.7 Payment :</p><p>Payment to the Contractor shall be made as per “first and final bill” basis. The contractor shall not submit any monthly bill/running bill to the Executive Engineer. The bill shall be paid after complete handing over the project to WESCO as per Clause No. 2.39.</p><p>3.8 Work Execution :</p><p>Work to be executed in accordance with specification, drawing and orders etc. The contractor shall execute the whole and every part of the work in the most substantial and workman like manner, and both as regards materials and otherwise in every respect instruct accordance with the specifications. The contractor shall also conform exactly, fully and faithfully to the designs, drawings, and instructions in writing relating to the work signed by the Engineer-in-charge and lodged in his office and to which the contractor shall be entitled to have access at such office, for the purpose of inspection during office hour and the contractor shall, if so he require, be entitled at his own expense to make or cause to be made copies of specifications, and of all such designs drawings, and instructions as aforesaid.</p><p>3.9 Alterations in specification and designs :</p><p>The Engineer-in-Charge shall have power to make any alterations in or additions the original specifications, drawings, designs and instructions that may appear to him to be necessary or advisable during the progress of the work, and the contractor shall be bound to carry out the work in accordance with any instructions which may be given to him in writing signed by the Engineer- in-charge, and such alteration shall not invalidate the contact, and any additional work which the contractor may be directed to do in the manner above specified as part of the work shall be carried out by the contractor on the same conditions in all respects on which he agreed to do the main work and at the same rates as are specified in the tender for the main work. The time for the completion of the work shall be extended in the proportion that the additional work bears to the original contract work and the certificate for the Engineer-in-charge shall be conclusive as to such proportion. And if the additional work includes any class o work, for which no rate is specified in this contract, then such class of work shall be carried out at the approved of rates of OLIC and in case there is no schedule of rate, then the contractor shall within seven days of the date of his receipt of the order to carry out of the work inform the engineer-in-charge of the rate which it is his intention to charge for such class of work, and if the Engineer-in-charge does not agree to this rate he shall serve notice in writing and be at liberty to cancel his order to carry out such class of work and arrange to carry it out in such manner as he may consider advisable, provided always that if the contractor shall commence work order of any expenditure in regard there of before the rates shall have been determined </p><p> as lastly herein before mentioned, then and in such case he shall only be entitled to be paid in respect of the work carried out or expenditure incurred by him prior to the date of the determination of the rate as aforesaid according to such rate or rates as shall be fixed by the Engineer-in-charge. In the event of a dispute, the decision of the Superintending Engineer of the Circle will be final provided always that the contractor shall not be entitled to any payment for any additional work done unless he has received an order in writing from the Engineer-in-charge for the addition work that the contractor shall be bound to submit his claim for any additional work done during any month or before the 15th day of the following month accompanied by a copy of the order in writing of the Engineer-in-charge for the additional work, and that the contractor shall not be entitled to any payment in respect of such additional work if he fails to submit his claim within the aforesaid period.</p><p>3.10 No compensation for alteration in or restriction of work to be carried out :</p><p>If at any time after the commencement of the work the OLIC shall for any reason whatsoever not required the whole thereof as specified in the tender to be carried out the Engineer-in-charge shall give notice in writing of the fact to the contractor who shall have no claim to any payment or compensation what so ever on account of any profit or advantage, which he might have derived from the execution of work in full but which he did not derive in consequence of the full amount of the work not having been carried out, neither shall he have any claim for compensation by reason of any alterations having been made in the original specification, drawings, designs and instruction which shall involve any curtailment of the work as originally contemplated.</p><p>3.11 Action and compensation payable in case of bad work : If it shall appear to the Engineer-in –Charge or his subordinate in charge of the work, that any work has been executed with unsound, imperfect or unskillful workmanship or with materials of any inferior description, or that any materials or articles provided by him for the execution of the works are unsound or of a quality inferior to that contracted for or otherwise not in accordance with the contract, the contractor shall on demand in writing from the Engineer-in-Charge specifying the work materials or articles complained of notwithstanding that the same may have been inadvertently passed certified and paid for, forthwith rectify or remove and reconstruct the work so </p><p> specified in whole or in part, as the case may require, or as the case may be, remove the materials or articles so specified and provide other proper and suitable materials or articles at this own charge and cost and in the event of his failing to do so within a period to be specified by the Engineer-in-charge in his demand aforesaid, then the contractor shall be liable to pay compensation at the rate of one percent on the amount of the estimate for every day not exceeding ten days, while his failure to do so shall continue and in the case of any such failure the Engineer- in-charge may rectify or remove, and re-execute the work or remove and replace with others, the materials or articles complained of as the case may be at the risk and expense in all respects of the contractor.</p><p>3.12 Works to be open to inspection :</p><p>All work under or in course of execution of executed in pursuance of the contract shall at all times be open to the inspection and supervision of the Engineer-in-charge and his subordinate and the contractors shall all times during the usual working hours, at all other times at which reasonable notice of the intention of the Engineer–in–charge or his subordinate to visit the work shall have given to the contractor either himself be present to receive order and instruction, or have a instruction, or have responsible agent duly accredited in writing be present force as if they had been given to the contractor himself .</p><p>3.13 Notice to be given before is covered up :</p><p>The contractor shall give not less than five days notice in writing to the Engineer-in-charge or his subordinate in charge of the work before convening up otherwise placing beyond the reach of measurement any work in order that the same may be measured and correction dimensions thereof be taken before the same is so covered up or placed beyond the reach of measurement and shall not cover up or place beyond the reach of measurement and shall not cover up place beyond the reach of measurement , any work with out the consent in writing of the Engineer –in- charge or his subordinate in charge of the work and if any work shall be convened up or placed beyond the reach of measurement without such notice having been given or consent obtained , the same shall be uncovered at the contractors expense or in default there of no payment or allowance shall be made for such work or the materials with which the same was executed .</p><p>3.14 Contractor is payable for damage done and for imperfection for 3 month after certificate</p><p>If the Contractor of his work people, or servants shall break deface, injure destroy any part of structure in which they may be working or any building, road, fence enclosure or grassland, or cultivated ground contiguous to the premise on which the work or any part of it is being executed, of if any damage shall happen to the work, while in progress, from any cause whatsoever or any imperfection become apparent in it within six months from the date of final certificate of its completion shall have been given by the Engineer – in – charge as aforesaid, the contractor shall make good the same at his own expenses or in default, the Engineer-in-Charge may cause the same to be made good by other workman, and deduct the expenses (of which the certificate of the engineer-in-charge shall be final) from any sums that may be then or at any time thereafter may become due to the contractor, or from his security deposit or the proceeds of sale thereof, or of a sufficient portion thereof and the contractor shall be liable to pay any part of the expenses not so recovered by the Engineer-in-charge.</p><p>3.15 Contractor to supply plant, ladders, scaffolding etc.</p><p>The Contractor shall supply at his own cost all materials (except such special materials, if any as may accordance with the contracts, be supplied from the Engineer-in-Charge’s stores), plant, tools appliances implements, ladders, carder, tackle, scaffolding and temporary works requisite for the proper execution of the work, whether original, altered or substituted, and whether included in the specification or other documents forming part of the contract or referred to in these conditions or not or which may be necessary for the purpose of satisfying or complying with the requirements of the Engineer-in-charge or his subordinate as to any matter as to which under this conditions be is entitled to be satisfied, which he is entitled to require together with carriage thereof to any from the work. The contractor shall also supply without charge the requisite number of person with the means and materials necessary for the purpose of setting out works, and counting, weighting assisting in the measurement or examination at any time and iron time to time of the work or materials. Failing his so doing the same may be provided by the Engineer-in-charge at the expense of; the contractor and the expense may be deducted from, any money due to the contractor under the contract, or from his security deposit or the proceeds of sale thereof or of a sufficient portion thereof. The contractor shall also provide all necessary fending and lights required to protect the public from accident, and shall be bound to bear the expenses of defence of every suit. Action or other proceedings at law that may be brought by any person for damages and cost which may be awarded in any such suit, action or proceedings to any such person or which may with the consent of the contractor be paid to compromise any claim by any such person.</p><p>3.16 No female labour shall be employed within the limits of a cantonment :</p><p>The Contractor shall not employ for the purpose of this contract any person who is below the age of eighteen years and shall pay to each labourer for the work done by such labourer, wages not less than the wages as prescribed by Government of Orissa. </p><p>The Executive Engineer shall have the right to enquire in to and decide any complaint alleging that the wages paid by the contractor to any labourer for the work done by such labourer is less than the wages prescribed by the Government of Orissa. </p><p>The Officer-in-Charge of the work shall have the right to decide whether any labour employed by the contractor is below the age of eighteen years and to refuse to allow any labourer whom he decides to be below the age of eighteen years, to be employed by the contractor.</p><p>3.17 Work not to be sublet :</p><p>The Contractor shall not sublet the work without the written approval of the Executive Engineer, And if the contractor shall assign or sublet his contract, or attempt to do so or become insolvent or commence any insolvency proceedings or make any composition with his creditor, or attempt to do so, or if any bribe, gratuity, gift, loan, perquisite rewards or advantage, pecuniary or otherwise, shall either directly or indirectly be given, promised, or offered by the contractor, or any of this servants or agents to any public officer or person in the employment of OLIC in any way relating to his officer of employee or if any such officer or person shall become in any way directly or indirectly interested in the contract, the Executive Engineer may thereupon by notice in writing rescind the contract and the security deposit of the contractor thereupon stand forfeited and be absolute at the disposal or OLIC and the same consequences shall ensure as if the contract had been rescinded under Clause 3.3 hereof, and in addition the contractor, shall be entitled to recover or be paid for any work thereto actually performed under the contract.</p><p>3.18 Sum payable by way of compensation to be considered as reasonable compensation without reference to actual loss. All sums payable by way of compensation under any of these conditions shall be considered as reasonable compensation to be applied to the use of OLIC without reference to the actual loss or damage sustained, and whether or not any damage shall have been sustained.</p><p>3.19 Changes in constitution of the firm :</p><p>In the case of a tender by partners, any change in the constitution of the firm shall be forthwith notified by the contractor to the Engineer-in-Charge for his information.</p><p>In case of failure to notify the change in the constitution within fifteen days the Engineer-in-Charge may by notice in writing rescind the contract and the security deposit of the contractor shall thereupon stand forfeited and be absolutely at the disposal of OLIC and the same consequences shall ensure as if the contract had been rescinded under clause 3.3 hereof and in addition the contractor shall not be entitled to recover or be paid for any works therefore actually performed under the contract.</p><p>3.20 All works to be executed under the contract shall be executed under the direction and subject to the approval in all respects of the Superintending Engineer of the Circle for the time being who shall be entitled to direct at what point or points and in what manner they are to be commenced and from time to time carried on.</p><p>3.21 Lump sums in estimates</p><p>When the estimate on which a tender is made includes lump sums in respect of the work, the contractor shall be entitled to payment in respect of the items of work involved or the part of the work in question at the same rates as are payable under this contract for such items, or if the part of the work in question is not, in the opinion the Engineer-in-Charge capable of measurement, the Engineer-in-Charge may be at his discretion pay the lump, sum amounts entered in the estimate, and the certificate in writing of the Engineer-in-charge shall be final and conclusive against the contractor with regard to any sum of sums payable to him under the provisions of this clause.</p><p>3.22 In the case of any class of work for which there is no such specification as mentioned such work shall be carried out in accordance with the standard specification of WESCO and in the event of there being no specification, then in such case the work shall be carried out in all respects in accordance with the instructions and requirements of the Engineer-in-Charge.</p><p>3.23 Definition of work </p><p>The expression “works” or ‘work’ where used in these conditions shall unless there be something either in the subject or context repugnant to such construction, be construed and taken to mean the works by or by virtue of the contract contracted to be executed, whether temporary or permanent, and whether original, altered, substituted or additional. 3.24 OLIC shall be entitled to recover in full from the contractor any amount that the OLIC may be liable to pay under Workman’s Compensation Act VIII of 1923, to any workmen employed in course of execution of any part of the work covered by these contract.</p><p>3.25 That, the purpose of jurisdiction in the event of dispute if any, the contract should be deemed to have been entered into within the State of Orissa and it is agreed that neither party to the contract or agreement will be competent to bring a suit in regard to the matters covered by this contract at any place out side the State of Orissa. </p><p>3.26 the department will have the right to inspect the scaffolding and centering made for the work and can reject partly or fully such structure if found defective in their opinion.</p><p>3.27 Sanitary arrangements will be made by the Contractor at his own cost for his labour camp.</p><p>3.28 The contractor shall bear all taxes including sales tax, income tax, royalty, fair weather charges where necessary.</p><p>3.29 After the work is finished all surplus materials and debris are to be removed by the contractor and preliminary work such as vats, mixing platforms, etc. are to be dismantled and all materials removed from site. The ground up to 100’ wide from the structure should be cleared and dressed.</p><p>3.30 Fair wage </p><p>The contractor shall abide by the fair wage clause as introduced by the State Government of Orissa and amended from time to time. Orissa PWD/Electricity Department Contractor’s labour regulations shall also be applicable to the contractor.</p><p>PART – IV </p><p>SCOPE OF WORK 4.1 GENERAL</p><p>The work is to erect 11 K.V. H.T. line, L.T. line and commissioning of 11/0.4 KV sub- stations ranging from 25 KVA to 100 KVA.</p><p>Besides this in some projects erection of 11 KV line D.P., Cut Point on 11 KV line, conversion of 2 phase 11 KV line to 3 phase 11 KV line, erection of guarding for road crossing / river crossing/power line crossing etc. are to be done.</p><p>For all the above works, the materials required, as mentioned in Annx. B to H are to be supplied by the contractors. The scope of works for each package has been mentioned in the tender call notice and respective price bid format.</p><p>4.2 ERECTION OF 11 KV LINE</p><p>In Annx. B, the list of materials to be used for 1 km of 11 KV line has been given. For different length of 11 KV line, as mentioned in tender notice, for different packages, materials to be used proportionately. </p><p>For all the packages, the size of conductor to be used is 55 mm 2 A.A.A.C. The length of span is to be 0.1 km, which may vary according to field situation as per the direction of Engineer-in-charge of OLIC.</p><p>4.3 ERECTION OF A. B. CABLE (L.T. LINE)</p><p>In Annx. D the materials to be used for 1 km of L.T. line with A.B. conductor of 50 mm2. For different length of L.T. line required for different packages as mentioned in tender call notice, materials to be used proportionately. The length of span of L.T. line with A.B. conductor is 0.03 km. The length may vary according to field situation as per the direction of Engineer-in-charge of OLIC.</p><p>L.T. line for package no. 1 & 2 AB cable of 50mm2 are to be used</p><p>4.4 SUB – STATIONS </p><p>Materials to be used for 11/0.4 KV, 25 KVA, 63 KVA and 100 KVA S/S has been mentioned in Annx. C and in its parts. The scope of S/S for each package has been mentioned in the tender call notice.</p><p>The technical specifications of transformer, transformer oil, lightening arrester etc have mentioned in the part of Annx C.
