<p> Germantown Planning Board Minutes August 28, 2014</p><p>Planning Board members present: Neal Burger, Margaret della Cioppa, Rao Gaddipati and acting Chairperson Kerrie Abela.</p><p>4 People in Audience.</p><p>On a motion by Margaret and seconded by Rao meeting was opened at 7:00 p.m. and minutes were approved with all in favor and none opposed.</p><p>Margaret made a motion to appoint Kerrie Abela as “Acting Chairperson”, seconded by Rao with all in favor and none opposed.</p><p>Otty Mr. Otty and Mr. Sharp appear before the board for a Lot Line Adjustment between their properties at 28 and 38 Cheviot Road, Germantown. Mr. Otty states he is not in favor of a Right of Way and would like to have a Lot Line Adjustment and the deed be rewritten to show this after approval. Mr. Otty explains to the board that the requested Lot Line Adjustment does not create an additional lot. It merely modifies the property lines of two bordering properties. The request consists of a conveyance of a portion of land from one property owner to another, in return for deleting a portion of a “right of way” and conversion of the remaining “right of way” to benefit both property owners. Both properties are currently conforming land use and will continue following this adjustment to be conforming without changing use type.</p><p>The board reviewed the general criteria for a Lot Line Adjustment Waiver and Part 2 of the Short Form EAF, making a Negative Declaration. It was found to not have any significant adverse impacts. A motion was made by Margaret to approve the Lot Line Adjustment and seconded by Neal with all in favor none opposed.</p><p>Hayes Mr. Hayes appeared before the board for a Minor Subdivision at 367 Viewmont Road, Germantown in an AR zone. Parcel A to 5.544 acres and Parcel B to 7.224 acres. The board reviewed the maps for completeness. All utilities were listed, there were no deed restrictions, driveways were shown. All adjoining parcels are shown and listed with neighbor’s names. On a motion by Margaret and seconded by Neal with all in favor and none opposed this is declared a Minor Subdivision .</p><p>Margaret made a motion to open Public Hearing for Minor Subdivision seconded by Roa with all in favor and none opposed. Acting Chairperson Kerrie opened the Public Hearing asking for any questions or objections from audience. Mr. Schmitz asked to state that as a neighbor he has no objections to this subdivision. The board reviewed Part 2 of the Short form EAF, making a Negative Declaration. It was thus determined that there was no evidence of a significant negative environmental impact. Motion was made by Rao and seconded by Kerrie with all in favor and none opposed to approve Minor Subdivision.</p><p>Motion was made by Margaret to close Public Hearing seconded by Neal with all in favor none opposed.</p><p>Mr. Hayes presented to the board his Lot Line Adjustment at 367 Viewmont Road, Germantown. This Lot Line Adjustment on map is indicated as parcel C . 268 acres tax lot 26 to parcel A 5.544 acres tax lot 25 5.812 acres in total, after approval of Subdivision on the same date. After review of the map to completeness, Margaret made a motion to declare this a Lot Line Adjustment seconded by Rao with all in favor and none opposed. The board reviewed the general criteria for a Lot Line Adjustment Waiver and Part 2 of the Short Form EAF, making a Negative Declaration. It was found to not have any significant adverse impacts. A motion was made by Rao and seconded by Kerrie to approve the Lot Line Adjustment with all in favor and none opposed.</p><p>Mr. Hayes presented to the board for a Special Use Permit for a Bed and Breakfast at 367 Viewmont Road, Germantown in an AR zone. Mr. Hayes explained to the board to use an existing farmhouse for a three bedroom Bed and Breakfast and will change his application to state four bedroom Bed and Breakfast as allowed by Zoning Law Manual.</p><p>The board reviewed the sketch plans and map for this Bed and Breakfast finding them to be complete. All tax maps, wells, neighbors’ driveways and dwellings are listed with sufficient parking. Acting Chairperson Kerrie Abela opened the Public Hearing after motion by Margaret seconded by Rao with all in favor none opposed. Mr. Schmitz, neighbor to Mr. Hayes stated that he had no objections to this Bed and Breakfast. The board reviewed Part 2 of the Short Form EAF, making a Negative Declaration. It was thus determined that there was no evidence of a significant negative environmental impact. Motion was made by Margaret and seconded by Rao with all in favor and none opposed to approve this Bed and Breakfast.</p><p>Motion was made by Rao seconded by Kerrie to close the Public Hearing.</p><p>At 8:15 a motion was made by Margaret and seconded by Kerrie to close the meeting with all in favor and none opposed.</p><p>Jami L.
