<p> Montana Judicial Branch Personnel Policies & Procedures</p><p>Subject: Nursing Mother Accommodation Policy No.: 212 Chapter: 39-2-215-217, MCA Pages: 2 Section: Human Resources Revision Date: Effective Date: June 17, 2008</p><p>1 POLICY</p><p>This policy is adopted in compliance with Sections 39-2-215, -216 and -217, MCA. The Judicial Branch supports and encourages women who wish to breastfeed or express milk. The Judicial Branch has adopted the following procedure to provide nursing mothers with adequate space to breastfeed or express milk. The Judicial Branch is an equal employment opportunity employer and prohibits discrimination of employees who request accommodation under this policy. An employee who believes she has been subjected to discrimination under this policy may contact the Human Resource Office, Office of Court Administrator.</p><p>2 DEFINITIONS</p><p>“Judicial Branch” means the Montana Supreme Court, District Courts, and Water Court. All boards, commissions, and related staff attached to the Judicial Branch for administrative purposes are considered part of the Judicial Branch for the purpose of this policy.</p><p>“Rest break” means one 15-minute break for each four hours of work. Rest breaks are considered part of the normal work day. </p><p>“Adequate space” means a room or area with adequate facilities.</p><p>3 PROCEDURE</p><p>Upon request of an employee, the Judicial Branch shall make reasonable efforts to provide adequate space for the employee to breastfeed or express milk. An employee shall provide her supervisor with advance notice to allow ample time to secure the space.</p><p>The space shall:</p><p> a. provide privacy, lighting, and electrical outlets for related equipment; b. be in close proximity to the work area; and c. be readily available during the term in which the employee needs the space for breastfeeding or expressing milk.</p><p>The employee shall, if possible, coordinate nursing or pumping with her scheduled rest breaks. If it is not possible to use the scheduled break, the supervisor and employee will establish a mutually agreeable schedule. The supervisor shall make a reasonable adjustment to the number and length of rest breaks, if necessary, to minimize disruption to Judicial Branch operations. A rest break is not guaranteed under this policy if providing the break causes undue disruption to operations.</p><p>1 - - Supervisors are encouraged to provide storage facilities for breast milk upon the employee’s request.</p><p>While conducting Judicial Branch business, a nursing infant may be a passenger in a state vehicle, in accordance with ARM 2.6.204(1)(b)(v).</p><p>4.0 CLOSING</p><p>Questions about this policy may be directed to Office of Court Administrator at the following address:</p><p>Montana Supreme Court Office of Court Administrator 301 South Park Avenue, Room 328 PO Box 203005 Helena, Montana 59620-3005 Phone: (406) 841-2950</p><p>2 - -</p>
