<p> HOUSE OF REPRESENTATIVES</p><p>KENTUCKY GENERAL ASSEMBLY AMENDMENT FORM</p><p>2004 REGULAR SESSION</p><p>Amend printed copy of HOUSE COMMITTEE SUBSTITUTE TO SENATE BILL NO. 106</p><p>On page 2, between lines 15 and 16, insert the following new section: "SECTION 2. A NEW SECTION OF KRS CHAPTER 189 IS CREATED TO READ AS FOLLOWS: In addition to the penalties prescribed under KRS 189.990 and 189.993, an operator of a motor vehicle who violates the yielding of right-of-way provisions of KRS 189.310, 189.330, 189.338, 189.345, 189.378, subsection (8) of KRS 189.570, KRS 189.575, 189.930, or 189.960 and is involved in an accident may be subject to the following additional penalties: (1) If the accident results in the physical injury, as defined by KRS 500.080, of a motorcyclist, bicyclist, or pedestrian, the motor vehicle operator may be fined up to two hundred dollars ($200) and his or her operator's license may be suspended for a period of thirty (30) days; (2) If the accident results in the serious physical injury, as defined by KRS 500.080, of a motorcyclist, bicyclist, or pedestrian, the motor vehicle operator may be fined up to five hundred dollars ($500) and his or her operator's license may be suspended for a period of thirty (30) days; or (3) If the accident results in the death of a motorcyclist, bicyclist, or pedestrian, the motor</p><p> vehicle operator may be fined up to one thousand dollars ($1,000) and his or her operator's license may be suspended for a period of thirty (30) days."; and</p><p>Amendment No. Rep.
