<p> Form 7</p><p>VICTORIAN FARM DEBT MEDIATION ACT 2011</p><p>SECTION 9(2) NOTICE TO CREDITOR REQUEST FOR FARMER-INITIATED MEDIATION CONCERNING FARM DEBT</p><p>This is a Form authorised by the Secretary to the Victorian Department of Economic Development, Jobs, Transport and Resources pursuant to Section 9(4) of the Victorian Farm Debt Mediation Act 2011.</p><p>This is a notice under Section 9(2) of the Farm Debt Mediation Act 2011 requesting you ______[the creditor] to enter into farmer-initiated mediation with______[the farmer] regarding the undermentioned farm mortgage(s) and farm debt(s). Details of security instrument:______Details of property over which security is held______</p><p>FACILITY</p><p>Other relevant information ______</p><p>CREDITORS' RIGHTS UNDER THE FARM DEBT MEDIATION ACT Under the Farm Debt Mediation Act 2011, a creditor who has received a request from a farmer for farmer- initiated mediation, may agree or refuse to mediate, in respect of the farm debt involved. A refusal by a creditor to mediate does not, of itself, give rise to any claim or other consequence under this Act, if the farmer is not in default.</p><p>If the farmer is in default, a refusal by a creditor to mediate may result in the issuance of a prohibition certificate.</p><p>ACTION REQUIRED BY A CREDITOR RECEIVING A REQUEST FOR FARMER-INITIATED MEDIATION WHO WISHES TO ENTER INTO MEDIATION You have 21 days in which to give notice to the farmer of your intention to participate in farmer-initiated mediation with the farmer. If you do not respond within this time frame, where the farm debt is in default, the farmer will be entitled to apply to the Victorian Small Business Commission for the issue of a prohibition certificate.</p><p>Victorian Department of Economic Development, Jobs, Transport and Resources Version 4, 07/17 1 HOW TO RESPOND TO THE SECTION 9(2) NOTICE Response to this notice should be in the form of a Notice under section 10(1) Farm Debt Mediation Act 2011. Attached is a Section 10(1) Notice (form 8).
