Whereas, January 2, 1997, marks the two hundredth anniversary of the death of Dr. John de la Howe, a prominent South Carolina citizen; and Whereas, Dr. John de la Howe bequeathed his entire estate for the purpose of establishing a rural school to serve poor and orphaned children; and Whereas, the South Carolina General Assembly, in 1918, recognizing the value of the school’s mission, assumed responsibility for the school; and Whereas, the programs of John de la Howe School have stood the test of time and continue to serve South Carolina families well; and Whereas, John de la Howe School is in the midst of a year- long bicentennial celebration of the school’s founding. Now, therefore, Be it resolved by the Senate, the House of Representatives concurring: That the members of the South Carolina General Assembly hereby congratulate the John de la Howe School on the occasion of its two hundredth anniversary and pause to honor Dr. John de la Howe and the hundreds of South Carolinians who have made his school successful. HARRISON asked unanimous consent to amend the Bill on third reading with technical amendments, if necessary, which was agreed to.RECORD FOR VOTING I voted against H. 3002 because it fails to comply with the terms of Smith vs. Beasley, et. al. As we are at the remedial stage of this litigation, we must work carefully to comply with all of the terms of this Order. The Order found that the current redistricting plan improperly splits the City of Greenwood along racial lines (see page 45 of Order). Within the City of Greenwood, the total population is 21,039, of which 42.7% is African-American. The proposed plan continues to divide Greenwood along racial lines, with 57% of residents in District 12 African-American, and only 23% of residents in District 13 African-American. The explanation offered by the committee for this racial split is that a railroad track bisects the city into distinct communities of interest. The first evidence of these distinct communities was at the remedial stage of litigation, after the court had found a similar split in the current plan violative of law. THURSDAY, JANUARY 16, 1997 I also have concerns about whether the proposed plan continues to divide the City of Beaufort along racial lines. The Order indicated such a split was improper. We have an obligation to ensure that the plan complies with the law and the terms of the Order. Rep. JAMES H. HODGES Rep. ROBERT J. SHEHEENRECORD FOR VOTING Let it be known that Representative Bowers opposes the reapportionment plan approved by the Judiciary Committee because it does not provide for a House District wholly-contained within Colleton County. The people of Colleton County were clear at the public hearing held in Walterboro: They want their own District! Furthermore, the cities of Walterboro and Hampton are two separate economic, social and cultural units which do not have any natural patterns of work, school, civic, religious, or governmental units. Furthermore, an arbitrary rule contrary to established practice for drawing lines was instituted to keep the City of Walterboro whole. While the keeping of cities whole is a credible criteria, it was arbitrarily applied to District 120; thus, it should not be used as a criteria in this case. Or otherwise, the criteria should be applied consistently across the State. Furthermore, the proposed plan for District 120 radically changes the geographic make-up of the District. The District is totally and completely removed from Beaufort County where there exists natural patterns of work, recreation, and shopping with the traditional areas of the District. Furthermore, the proposed plan for District 120 removes the Jasper County precincts of Gillisonville, Ridgeland I and II where there exists natural patterns of work, recreation, and shopping with the traditional areas of the District. The proposed District 120 hardly resembles the original District 120 and includes two county seats, Walterboro of Colleton County and Hampton of Hampton County, which have no common interests. The general character and integrity of community interests throughout traditional District 120 are destroyed by the new proposal. The Cities of Hampton and THURSDAY, JANUARY 16, 1997 Walterboro should not be contained within the same House District. The proposed District is too radical of a change from the traditional district. The District should be redrawn to reflect the natural patterns of work, travel, recreation and shopping in such a manner that restores the traditional areas of District 120. These have included rural Colleton County, Hampton County, and parts of Jasper and Beaufort Counties. I am privileged to have the honor of representing District 120. Personally, I shall continue to, at all times, represent the interests of Hampton, Colleton, Beaufort and Jasper Counties. If the plan I oppose today becomes the "new" District for 120, I shall strive to represent it and please all citizens therein for as long as they give me the privilege to serve. I cannot, however, vote in favor of this plan today because it flies in the face of the desires of my Colleton County constituents. Their voices were clear at the public hearing. As their representative, I shall always see that their voices are reflected in the way I vote on any bill. To do otherwise would be a disservice to this honorable position. Rep. WILLIAM K.
