Policy Regarding Incidental Uses and Disclosures

<p> Policy 16 Health Plan Policy re Human Resources Health Insurance Portability and Accountability Act Incidental Uses and Disclosures Effective April 14, 2003 </p><p>Policy Regarding Incidental Uses and Disclosures</p><p>POLICY: The HIPAA Privacy Rules permit certain incidental uses and disclosures of protected health information. Accordingly, it is the policy of the Western Michigan University Group Health Plan (“Plan”) to comply with the limitations set forth in the Rules, as follows: PROCESS:</p><p>1. Incidental disclosures are disclosures of protected health information that: </p><p>(a) occur as a by-product of a permissible use or disclosure; </p><p>(b) are limited in nature; and </p><p>(c) cannot be prevented through the use of reasonable measures. </p><p>2. Incidental disclosures do not violate the Privacy Policies as long as:</p><p>(a) reasonable safeguards were taken to prevent the incidental disclosure; and</p><p>(b) the disclosure resulted from a use or disclosure that is otherwise permissible under the Plan’s privacy policies, including the Minimum Necessary Policy (Policy 15).</p><p>3. The provisions regarding incidental use and disclose were adopted to ease the day-to-day functioning of persons who deal with protected health information on a regular basis, but do no provide license for employees to disregard privacy obligations. The rules that must be followed are grounded in common sense. Employees must take all reasonable measures to avoid use or disclosure of protected health information to persons who have no Plan responsibilities or duties that require access to PHI. For example, employees must:</p><p>(a) speak quietly when discussing protected health information in connection with plan administration;</p><p>(b) to the extent possible, avoid using individuals’ names, claims histories, treatment histories and diagnoses when discussing protected health information within the work place; </p><p>(c) avoid leaving work papers on desks or other surfaces in plain view of others;</p><p>(d) keeping records, papers and other materials in file cabinets or drawers when not in immediate use.</p><p>4. The following measures are considered reasonable with respect to the prevention of incidental disclosures and shall be followed when applicable:</p><p>(a) Compliance with the Minimum Necessary Policy. </p><p>(b) Compliance with the Policy Regarding Physical and Technical Safeguards. </p><p>1 of 1 Regulatory Authority 45 C.F.R. 164.502(a)(1)(iii) AALIB:385032.1\095924-00103 </p>
