GNR-E-02-2 COMMISSION TO DETERMINE A POLE ) ATTACHMENT RATE FORMULA ) PURSUANT TO IDAHO CODE § 61-538. ) NOTICE OF WORKSHOP )</p><p>On April 29, 2002, the Commission issued a Notice of Proceeding to Determine Pole Attachment Formula to open this docket. The purpose of the case is “to review pole attachment rate formulas and consider the adoption of a formula and/or formulas for resolution of pole attachment disputes between a public utility and cable television company.” Notice and Order No. 29010 p. 1. Idaho Code § 61-538 grants the Commission jurisdiction to establish and regulate the rates, terms and conditions for pole attachments “whenever a public utility and a cable television company are unable to agree upon rates, terms or conditions for pole attachment or for the terms, conditions or costs of production of space needed for pole attachments.” The Notice stated the case would initially proceed as an informal proceeding and that one or more workshops would be scheduled for parties to discuss and recommend pole attachment formulas. YOU ARE HEREBY NOTIFIED that a workshop will convene on TUESDAY, AUGUST 27, 2002 AT 1:30 P.M. IN THE COMMISSION HEARING ROOM, 472 W. WASHINGTON STREET, BOISE, IDAHO. The purpose of the workshop is for interested parties to present proposals for pole attachment formulas and attempt to reach consensus on an appropriate formula for the Commission to use in resolving pole attachment disputes between a public utility and a cable television company. YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act (ADA). Persons needing the help of a sign language interpreter or other assistance in order to participate in or to understand testimony and argument at a public hearing may ask the Commission to provide a sign language interpreter or other assistance at the hearing.
