Section 404386(P) of the 1976 Code is amended to 25 read: 26 27 “(P) If a pharmacist receives a request for a prescription refill 28 and the pharmacist is unable to obtain refill authorization from the 29 prescriber, the pharmacist may dispense, a onetime emergency 30 refill once within a twelve month period, of up to a seventytwo 31 hour an emergency refill of up to a th irty day supply of the 32 prescribed medication if: 33 (1) the prescription is not for a controlled substance; 34 (2) the medication is essential to the maintenance of life or 35 to the continuation of therapy; 36 (3) in the pharmacist’s professional judgment, continuing the 37 therapy for seventytwo hours up to thirty days will produce no 38 undesirable health consequences or cause physical or mental 39 discomfort; 40 (4) the pharmacist properly records the dispensing; and 41 (5) the dispensing pharmacist notifies the prescriber of the 42 emergency dispensing refill and the amount of the refill, not to</p><p>[243] 2 1 exceed a thirty day supply, within seventytwo hours a reasonable 2 time, but no later than thirty days after the onetime emergency 3 once in twelve months refill dispensing.” 4 5 SECTION 2.
