<p> 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 41-18-30 OF THE 1976 CODE, 12 RELATING TO THE APPLICABILITY OF AND EXCEPTIONS 13 TO THE “SOUTH CAROLINA AMUSEMENT RIDES SAFETY 14 CODE,” TO EXCLUDE OPEN-WHEEL MOTORSPORT 15 VEHICLES, KARTS, SUPERKARTS, GEARBOX OR SHIFTER 16 KARTS, OR GO KARTS USED FOR RACING AT SPEEDS IN 17 EXCESS OF FIFTY MILES PER HOUR. 18 19 Be it enacted by the General Assembly of the State of South 20 Carolina: 21 22 SECTION 1. Section 41-18-30 of the 1976 Code is amended to 23 read: 24 25 “Section 411830. (A) This chapter applies to amusement 26 devices at carnivals, fairs, and amusement parks where an 27 admission or fee is customarily or usually charged located within 28 the State or at other places open to the public and to the managers 29 of these devices, to the persons employed in connection with these 30 devices, and to their employees. 31 (B) This chapter does not apply to single passenger, 32 coinoperated, manually, mechanically, or electrically operated 33 rides, except where admission is charged for the use of the 34 equipment, and this chapter may not be construed so as to limit the 35 right of a person to conduct any hotel, restaurant, or eating place at 36 an amusement park. 37 (C) This chapter does not apply to airsupported structures. 38 (D) This chapter does not apply to open-wheel motorsport 39 vehicles, karts, superkarts, gearbox or shifter karts, or go karts 40 used for racing at speeds in excess of fifty miles per hour.” 41</p><p>[567] 1 1 SECTION 2.
