Darland v. Snoqualmie Pass Utility Dist. County: Kittitas Case Summary: In the late 1970s, Michael Von Holnstein, a German national, purchased property near Snoqualmie Pass in Kittitas County, Washington. Because he intended to develop the land, he obtained a twenty foot access easement. In the early 1980s, the Snoqualmie Pass Utility District (District) approved creation of a utility local improvement district (ULID) to improve the sewer system. Mr. Holnstein’s property was assessed under the ULID, requiring him to pay a share of the improvement costs so that he could receive credits for later sewer hook-ups. In the late 1980s the District created another ULID to improve the water service, and Mr. Holnstein’s property was assessed again. Mr. Holnstein never paid the assessments, instead selling the undeveloped land to Miller Shingle Company, an investment group organized by Louis Leclezio. Miller Shingle paid nearly $500,000 to the District for the assessments, including penalties and interest. The District never extended the sewer or water lines to the property and Miller Shingle sold the property to Myrna and Michael Darland. The Darlands requested that </p><p>1 the District guarantee water and sewer service, and it declined. The Darlands have not developed the property because it lacks water, a sewer, and the required sixty foot access road. In 2004, the Darlands sued the District, attempting to compel utility and access road installation by the District. After much litigation, the trial court granted the District’s motion for summary judgment, dismissing their case. Cooley County: Kittitas Case Summary: Roy Cooley was convicted of one count of first degree rape of a child. The victim was R.B., the then five-year-old son of Mr. Cooley’s ex-girlfriend. On appeal, he alleges improperly-admitted evidence, prosecutorial misconduct, and ineffective assistance of counsel. </p><p>View briefs in Acrobat format by clicking the link below and entering the case number. Division Three Briefs</p><p>3) No.: 338746 Case Name: State of Washington v. Joel Matthew Groves County: Kittitas Case Summary: Joel Groves was pulled over for speeding and his motorcycle was impounded because he did not have a motorcycle endorsement on his license. During an inventory search of the motorcycle, the police discovered methamphetamine, oxycodone, and drug paraphernalia. Mr. Groves was charged with possession of a controlled substance with intent to deliver, and possession of a legend drug without a prescription. Mr. Groves sought to suppress the evidence seized during the search, but his motion was denied. A jury found Mr. Groves guilty on both counts.
