Agenda/Ordre du jour</p><p>Page 1 of 6 The agenda was unanimously approved with the following additions:</p><p>Point 4:  Update on the letter-response from Michel Laurier about the Health Sciences Review </p><p>New business:  Signage at 1 Stewart  New uO alert  Public transportation</p><p>2. Approval of the minutes of July 6, 2016 The minutes were unanimously approved.</p><p>3. Matters arising from the minutes of July 6, 2016</p><p> Updates on the Policy on Violence Prevention M. Histed indicated that the unions/associations were invited to review the Policy and to provide comments. It was then sent to the Administrative Committee and was approved. It will be posted on the University Website within the next two weeks. </p><p> Updates on the Policies on the Prevention of sexual violence and the Prevention of harassment. S. Nigam, Director of Human Rights Office, indicated that at the last meeting she indicated that the Policy on prevention of sexual violence was adopted by the Board of Governors on June 24th, 2016 and is now available on the uO governance website. </p><p>S. Nigam indicated that that there is a work force team working on the harmonization of the Prevention of Harassment and Discrimination and the Prevention of Sexual Violence policies. The first draft is completed and will be sent shortly to the unions/associations. </p><p>4. Matters arising from Michel Laurier’s response-letter about the discussion on the review of the Health Sciences. A member was questioning the statement about the limitations of the mandate of the health and safety committee to recommendations on the policy and procedures. </p><p>S. Nigam indicated that when an issue arises it has to be reported to the institution for proper actions to be taken. Should this be reported also to another committee, it could be counterproductive to have multiple parties addressing the issue. </p><p>M. Histed provided a brief history of legislation, communiqué provided by the Ministry of Labour and the mandate of the Health and Safety Committee when there is a harassment and/or violence situation. Following the new component to this effect under the Occupational Health and Safety Act, a legal opinion was provided to universities to provide </p><p>2 direction on the roles of the health and safety committee and the institution. The mandate of the Committee is much more defined and larger for hazards such as physical, biological and chemical than it is for psychological hazards. A recent communication from the Ministry of Labour establishes the limits of the H&S Committee’s role to that of making recommendations on policies and procedures, except in the case of harassment where it limits the role to that of procedural recommendations. </p><p>The Committee has the power to recommend actions. It is at the discretion of the management to implement, to modify or reject the proposed recommendations. However, a formal response must be provided to the Committee. </p><p>The question was raised on how committee members should deal with a similar situation in future, i.e., harassment complaint. M. Histed indicated that because of the sensitivity of those issues, it has to be kept confidential and the internal process must be properly followed. The Human Rights Office is dealing with this. </p><p>The Ministry of Labour Inspector has a limiting role on what they can investigate. Their mandate related to harassment complaint is limited to assessing if the protocol:  is in place;  is followed; and  is communicated to the community in question.</p><p>S. Nigam indicated that unions/associations were sent a draft for their review on the additional component to the protocol. This will assist to provide directions for dealing with anonymous complaint in line with legislative limitations. Committee members will also be sent a copy of the draft for their comments. </p><p>5. JHSC Inspector Position C. Clément indicated that, during the summer, Christine Robson, the Official Joint Health and Safety Inspector, indicated that she will not be returning to her position after her leave. Therefore, the position was posted during the summer time and the selection committee will shortly be proceeding with the interview process. . 6. Updates on the certified members C. Clément indicated that additional members recently received their certification from the Ministry of Labour as certified members under the OH&S Act. All certified members’ names are listed on the ORM website and on the first page of the UJOHSC minutes. As a reminder, these members are the first to be contacted in case of a work refusal, MOL Inspector investigation, etc. If they are not available, then a worker committee member will be contacted. Certified members have additional rights, such as the possibility to initiate bilateral work stoppage.</p><p>7. Roles of the Committee members It was discussed in the above section 4. </p><p>8. Critical Injury/ Occupational Disease report (updates) Page 3 of 6 C. Clément indicated that one critical injury was reported to the Ministry of Labour since the last Committee meeting. It took place on September 7, at a premise outside the University. The employee was on break at the time. It took place at the intersection of Laurier Avenue and Henderson. The person fell because the city manhole cover was not level to the ground. The University of Ottawa representative will recommend to the City of Ottawa to fix the hazard. </p><p>9. Inspection M. Bergeron, the Joint Occupational Health and Safety Inspector, reported on the status of inspections completed so far this year are;  82% for Office areas,  98% of Laboratory type areas, and  39% for the Facilities and Protection areas. </p><p>The total percentage of areas inspected for the University is about 75% at this point. The percentage includes the area of the residences that requires to be inspected. M. Bergeron indicated that she planned to complete all inspections by the end of October. </p><p>M. Bergeron indicated that there are inspections planned every week with Facilities and Protection Health and Safety Committee to ensure that inspections in their sector are completed before the end of the year. </p><p>M. Bergeron invited members who would like to take part in an inspection to contact her. A member asked if seats from classrooms or conference rooms are inspected on a regular basis. It was indicated that inspections are conducted by the Committee members and by management.</p><p>A member indicated that, the new inspection module software, which is linked with the University building plans, is not available at this point. As indicated previously, the previous inspection software is no longer available since the University moved to another company. Hence, when the module will be available, this will impact the JHSC Inspector workload since information will be required to be entered in the system. At last, the member indicated that the workload will also increase over time since more buildings are being constructed. Therefore, this means additional locations to inspect. </p><p>10. Review of the Functional Committees Minutes </p><p> The Office Committee (-) Last minutes reviewed were May 30th, 2016</p><p> The Facilities and Protection Services Health and Safety Committee (May 12, 2016) B. Beauseigle provided context to the item of the minutes related to earing testing. She indicated that a concern was raised to the effect of the validity of the hearing test conducted because of the noise taking place in the room at the same time of the test being performed. B. Beauseigle indicated that the concern was brought up to the 4 audiologist who indicated at the time that this is not an issue. Results will be adjusted accordingly. </p><p>A question was raised about information related to 3D printing. It was indicated that a safety sheet is available on the matter on the Office of Risk Management Website.</p><p>Discussions ensued on the number of slip and fall incidents. C. Clément indicated that this is under review and findings will be presented at the next meeting.</p><p> The Laboratory Committee (July 11, 2016) No particular item to discuss.</p><p>11. Case Law: employee convicted under the Criminal Code This is the case of an employee who was convicted under the Criminal Code for trying to scare his boss by driving toward him on the sidewalk on three consecutive times. This demonstrates that employees can be convicted under the Criminal Code when conducting activities at work. </p><p>12. New business  Public transport A member indicated having safety concerns over the number of buses peripheral to the campus. A large number of students are walking toward the buses, exiting the buses and walking on the street, while the cars are circulating. The member would like additional information on the situation and to find out the safety measures taken. This is a concern in addition to the construction taking place on the campus.</p><p>It was decided to invite, at the next meeting, the uO representative on the OLRT committee to present the plans for the upcoming year for traffic safety related to the OLRT and the safety plans related to the construction on the campus. </p><p>A member suggested having signage near Tabaret to inform and re-direct people with regards to the construction taking place on one side of the building and the route to follow to access other buildings nearby. </p><p> Signage at 1 Stewart A member indicated concern about the signage at 1 Stewart. The member indicated that there is no signage for that building to identify the Aboriginal Resources Center located on the first floor. The member would like to see a follow-up to assess if signage can be installed. Review of the situation will take place by the next meeting.</p><p> New uO alert A member requested a presentation from Protection Service about the uO alert reporting. The member presented a few cases where it was expected that the uO alert would be used to inform the uO Community and it was not. Therefore, the member would like to better understand the conditions of when this is used. It Page 5 of 6 was agreed that a representative from Protection Service will be invited at the next meeting to provide additional information on the uO Alert.</p><p> Accessibility S. Nigam indicated that if, the committee is interested, the Accessibility Officer can offer a presentation to the Committee. She also presented some information on gender neutral washrooms, potential human rights issues or concerns which may arise as a result and how they could be prevented or addressed. She indicated that there is a pilot project on the campus for neutral gender washrooms. The Committee indicated that they would like an update on this matter at the next meeting.</p><p> Information on health & safety A member indicated that information on health and safety including laboratory safety was presented to students during the orientation week. There was a clear interest to find out information on the matter, according to the member. </p><p>13.
