<p>Supply Management</p><p>April 12, 2017 </p><p>Mr. Sukhwinder (Sukhi) Lamba Vice President, Sales OpsHub, Inc. 1000 Elwell Court, Suite 101 Palo Alto, CA 94303-4306</p><p>RE: Supplier Disagreement Resolution No. SDR17TI-07</p><p>Dear Mr. Lamba:</p><p>This correspondence responds to the submission that you lodged on behalf of OpsHub, Inc., with the Supplier Disagreement Resolution (”SDR”) Official on February 7, 2017. Your submission requests cancellation of the current award and a reevaluation of the responses received by the Postal Service resulting from Solicitation No. 1B-16-A-0006, Lifecycle Management Tool Integration Systems Testing and Support (ST&S) Solution. </p><p>I have reviewed your letter that was received on February 7, 2017, along with the supporting documents you provided. I also reviewed the contracting officer’s resolution letter dated January 24, 2017 provided in response to your initial business disagreement submitted on behalf of OpsHub, Inc., on December 26, 2016.</p><p>Before the SDR Official may consider a supplier disagreement, the supplier must first timely lodge an initial disagreement with the responsible contracting officer within 10 days of the date the supplier received the notification of award or 10 days from the date of debriefing, whichever is later. See 39 C.F.R. §§ 601.107(b); 601.108(a). A review of all file documentation shows that you lodged a timely initial disagreement with the contracting officer on December 26, 2016, after receiving a debriefing on December 21, 2016. The record further shows that you received the contracting officer’s resolution of your initial business disagreement on January 24, 2017.</p><p>However, the regulations further state that where a supplier is dissatisfied with the contracting officer’s resolution of a disagreement under 39 C.F.R. § 601.107, the supplier must lodge the disagreement with the SDR Official within 10 days after the supplier first receives notification of the contracting officer’s resolution. See 39 C.F.R. § 601.108(d)(3). The regulations define “lodge” as follows: “A disagreement is lodged on the date it is received by the contracting officer or the Supplier Disagreement Resolution Official, as appropriate.” See 39 C.F.R. § 601.107(a)(4). Your disagreement to the SDR Official was required to be received by this office on or before February 3, 2017; however, it was not received by this office until February 7, 2017.
