<p>Memorandum </p><p>To: NAIC Property and Casualty Reinsurance Study Group and Interested Persons </p><p>From: Mike Moriarty New York Insurance Department</p><p>Date: May 5, 2005</p><p>Subject: Proposal to Revise SSAP # 62 – Property and Casualty Reinsurance</p><p>I am attaching a proposal to revise SSAP #62 that will be discussed at the P&C Reinsurance Study Group’s (“Study Group”) interim meeting in Chicago, IL on May 10th. Following are some issues that I ask you to consider:</p><p> The proposal is a "discussion draft." NY will be asking the Study Group to receive this proposal and expose it for comments in order to begin the process of identifying the issues that need to be addressed in order to connect the concept of bifurcation of accounting treatment with the practical application of such a framework.</p><p> NY is open to alternatives to the bifurcation concept contained in the attached proposal. However, we believe the issue is a priority that needs to be addressed. It remains New York’s position that the current statutory accounting guidance fails to recognize the economic substance of certain reinsurance transactions. The disconnect between the financial reporting and the economic substance of these transactions can: (1) lead to the improper use of reinsurance transactions to manipulate financial reporting results; and (2) hinder the analysis of financial statements by regulators and other users of the reports. Accordingly, NY believes revision to the current guidance is necessary.</p><p> The Casualty Actuarial Task Force (“CATF”) is reviewing the issue of “transfer of insurance risk” and is slated to respond back to the Study Group by the end of the summer.
