Pla/2/5/15 Appointment of Vice Chairman Nomination by Councillor Mrs E Martin Seconded by Councillor I Chambers that Councillor J Thompson be appointed Vice-Chairman of the Planning Committee for the 2015-2016 municipal year. Nomination by Councillor H Sawrey-Cookson Seconded by Councillor Miss M Clark that Councillor J Tompkins be appointed Vice-Chairman of the Planning Committee for the 2015-2016 municipal year. A vote was taken when there were: For Councillor Thompson – 5 For Councillor Tompkins – 4 1 RESOLVED that Councillor J Thompson be appointed Vice-Chairman of the Planning Committee for the 2015-2016 municipal year. Pla/3/5/15 Declarations of Interest 1. Councillor Sawrey-Cookson declared a registrable interest in that he had met the objector in relation to application 4 on agenda item 4 (Planning application No 15/0229), however that had been some years previously. 2. Councillors Mrs Holden, Mrs Kendall, Mrs Martin, Patterson, Sawrey-Cookson, Thompson and Tonkins all declared that they had been lobbied by the Ward Councillor in relation to items 2 and 3 on agenda item 4 (Planning application Nos 15/0250 and 15/0265). Pla/4/5/15 Appeal Decision Letters The Committee considered report CD43/15 of the Head of Planning Services which detailed a decision letter received since the last meeting. Application Applicant / Appeal Appeal Number(s) Decision 14/0014 Mrs Ann Overton The appeal is Sycamore Barn, Thistlewood, High dismissed Bridge, Dalston, Carlisle CA5 7DS The appeal is made under section 78 of the Town and Country Planning Act 1990 against a refusal to grant planning permission. The development proposed is an extension of existing barn conversion to provide additional sunroom, dressing room, laundry room and utility/storage space. RESOLVED that the report be noted. Pla/5/5/15 Planning Services Performance Report The Committee considered report CD42/15 of the Chairman of the Planning Committee 2014/15 which had been presented at the Annual Council on 21 May 2015. Members were provided with an overview of the performance of the planning service between April 2014 and March 2015 and considered performance in relation to Key Performance Indicators, Planning Enforcement and customer satisfaction. Members were also provided with information on future projects, most importantly the production of the Draft Local Plan. RESOLVED that the report be noted. 2 Pla/6/5/15 Planning Issues RESOLVED that: 1. applications determined under officer delegated powers for the month of April 2015; 2. reasons for refusal on delegated decisions for the month of April 2015; 3. decisions of the Lake District National park Authority in respect of applications for planning permission for the month of April 2015; and 4. application recommendations made under officer delegated powers for county matters for the month of April 2015 be noted. Pla/7/5/15 Planning Issues - Applications for Debate (Green Papers) The Committee was advised of the applications requiring a decision by Members as detailed in a report of the Head of Planning Services. RESOLVED that: 1. the following applications for planning permissions ("those applications") are determined as indicated hereunder; 2. those applications which are approved be approved under the Town and Country Planning Act, 1990, subject to any detailed conditions set out in the Report, to any conditions set out below and to any conditions as to time stipulated under Sections 91 and 92 of the Act; 3. those applications which are refused be refused for the reasons set out in the report and/or any reasons set out below; 4. those applications which the Head of Planning Services is given delegated powers to approve under the Town and Country Planning Act, 1990, be approved by him subject to any detailed conditions set out in the Report, to any conditions as to time stipulated under Sections 91 and 92 of the Act, to the receipt of satisfactory replies. Pla/8/5/15 Installation of a 500kW Wind Turbine on a 46.9m Monopole Mast (77m to Blade Tip) and Associated Infrastructure Including Foundation, Crane Pad, Access Track and Underground Cabling at Barrockend Farm, Armathwaite, Carlisle for Harmony Energy Limited (Planning Application No 14/1019) 3 Members were advised that this application had been withdrawn from the agenda. Pla/9/5/15 Variation of Condition No 2 Attached to Planning Approval 87/0880 Comprising A1 Retail trading With no Exclusions at Former Wickes Store, Ullswater Road, Penrith for District Estates Limited c/o Smith Nicholas (Planning Application No 15/0250) The Committee received a presentation from Councillor V Taylor, Ward Councillor, objecting to the application. The Committee received a presentation from Mr J Paul, the applicant’s agent, in support of the application. Moved by Councillor J Thompson Seconded by Councillor I Chambers that the application be approved. A vote was taken when there were: For the motion – 4 Against it – 4 Abstentions – 1 The Chairman used his casting vote in favour of the application when it was RESOLVED that the application be approved. Pla/10/5/15 Proposed Alterations to Extend Parking layout and Servicing Reconfiguration at Former Wickes Store, Ullswater Road, Penrith for District Estates ltd c/o Smith Nicholas (Planning Application No 15/0265) The Committee received a presentation from Mr J Paul, the applicant’s agent, in support of the application. RESOLVED that the application be APPROVED subject to the following conditions: 1. the development permitted shall be begun before the expiration of three years from the date of this permission. 2. The development hereby granted shall be carried out strictly in accordance with the details and plans hereby approved (location plan P4186_001 and proposed site plan P4186_003 received 19 March 2015) and shall not be varied other than by prior agreement in writing by the Local Planning Authority. 3. Prior to the operation of the development a landscaping scheme, providing details of the boundary treatment along the north-western boundary of the site, will be submitted to and approved in writing by the Local planning Authority and this scheme shall be carried out as approved in accordance with the programme agreed by the Local Planning Authority. Any trees or other plants which die or are removed within the first 4 five years following the implementation of the landscaping scheme shall be replaced during the next planting season. Reasons 1. In order to comply with the provisions of the Town and Country Planning Act 1990. 2. To ensure a satisfactory development and to avoid any ambiguity as to what constitutes the permission. 3. To ensure that the north-western boundary, adjacent to the station carpark, is appropriately screened in the interest of the visual character and appearance of the area. Pla/11/5/15 Proposed Installation of a Flue Pipe and Retrospective Application for the Siting of a Satellite Dish at Old Dufton Hall Farmhouse, Dufton for Mr Parkin (Planning Application No 15/0229) The Committee received a presentation from Mr Spence objecting to the application. The Committee received a presentation from Mr G Norman, the applicant’s agent, in support of the application. RESOLVED that: 1. listed building consent be APPROVED subject to the following conditions: 1. the development permitted shall be begun before the expiration of three years from the date of this permission Reason – in order to comply with the provisions of Section 18 of the Planning (Listed Buildings and Conservation Areas) Act 1990 2. the development hereby granted shall be carried out strictly in accordance with the details and plans hereby approved below and shall not be varied other than by prior agreement in writing by the Local Planning Authority .
