The Register in Probate office cannot give legal advice; please contact an attorney if you have legal questions.</p><p>If a guardian dies, is removed by the Court, or resigns, a Successor Guardian needs to be appointed for the ward.</p><p>The following is a list and brief explanation of the necessary forms one would file in order to secure the appointment of a Successor Guardian without a court hearing: </p><p>► Resignation of Guardian or Conservator</p><p>If the need for a Successor Guardian is due to a resignation of the current guardian, the current guardian must complete Resignation of Guardian or Conservator, Form GN- 3400.</p><p>If the need for a Successor Guardian is due to the death of the current guardian, a representative for the deceased guardian shall notify the Register in Probate, in writing, of said guardian’s death.</p><p>► Petition for Appointment of Successor Guardian (without hearing)</p><p>The proposed Successor Guardian shall complete the Petition for Appointment of Successor Guardian (without hearing), Form GN-3410, and file it with the Register in Probate.</p><p>The petitioner’s signature on the petition shall be notarized.</p><p>► Statement of Acts by Proposed Guardian and Consent to Serve as Guardian</p><p>The proposed Successor Guardian shall complete the Statement of Acts by Proposed Guardian and Consent to Serve as Guardian, Form GN-3140, and file it with the Register in Probate at the time the above-referenced petition is filed.</p><p>Lincoln County Successor Guardianship Pro Se Guidelines Revised 02-2011 The proposed guardian’s signature on the Statement of Acts…shall be notarized. The following three (3) forms shall be completed by the proposed Successor Guardian and submitted for signature by the judge with the rest of the paperwork:</p><p>► Order for Appointment of Successor Guardian of the Person ► Order for Appointment of Successor Guardian of the Estate ► Letters of Guardianship of the Person Due to Incompetency ► Letters of Guardianship of the Estate Due to Incompetency</p><p>After the judge has signed the Order for Appointment of Successor Guardian of the Person (without hearing), Form GN-3420, Order for Appointment of Successor Guardian of the Estate (without hearing), Form GN-3423, Letters of Guardianship of the Person Due to Incompetency, Form GN-3200, and Letters of Guardianship of the Estate Due to Incompetency, Form GN-3210, the Register in Probate will provide a copy of each to you.</p><p>► Notice of Appointment of Successor Guardian (without hearing) Upon receipt of the copies of Order for Appointment of Successor Guardian (without hearing), Letters of Guardianship of the Person Due to Incompetency, and Letters of Guardianship of the Estate Due to Incompetency you must complete and personally serve or mail to the guardian the Notice of Appointment of Successor Guardian (without hearing), Form GN-3430, no later than ten (10) days from the date appointed. </p><p>You will receive an Invoice from the Register in Probate for the cost of copies of the above-referenced documents. Payment must be made to the Register in Probate, 1110 E.
