<p> 102 Petty France, London SW1H 9AJ </p><p>E-Mail: [email protected] </p><p>News Sheet No: 05/2016</p><p>Date: 7th November 2016</p><p>CIRCULATED DIRECTLY TO ALL MEMBERS OF THE JUSTICES’ CLERKS’ SOCIETY</p><p>Dear Colleague,</p><p>Securing attendance of a young person for the purpose of a means enquiry</p><p>Following a recent Judicial Review, there has been national debate concerning the court’s powers to issue process to secure the attendance of a young person before the court with a view to enforcement of a sum they were ordered to pay on conviction. </p><p>Council has been asked to provide guidance in this respect and expects to be in a position to do so in the coming weeks. Until that advice is confirmed, enforcement teams nationally have been asked not to request the court to issue a summons or warrant to secure attendance at court in respect of a young person for non-payment. Should members receive such applications during this interim period, they may wish to refer to their Justices’ Clerk for further advice.</p><p>The position in respect of adults is not affected and enforcement teams will continue to secure the attendance of parents or guardians who were made responsible for payment of the order at imposition as appropriate. </p><p>Further guidance will issue shortly.</p><p>Yours sincerely, </p><p>The Justices’ Clerks Society</p>
