<p> MINUTES OF THE BOARD OF ADJUSTMENT</p><p>April 20, 2015 Ventura, Iowa</p><p>A meeting of the Board of Adjustment of Ventura, Iowa was held on April 20, 2015. The meeting was called to order by Chairman Tom Taylor at 6:00 p.m. at Ventura City Hall. The following board members were present: Andy Carter, Tom Taylor, Jim Cash, Jim Black and Bob Formanek. Also present, Zoning Administrator John Marino, City Administrator Else Taylor and City Attorney Michael Moeller. Absent: none. </p><p>This meeting is being called to address the appeal for variance by Jodi Ames Peterson for property located at 2 Hillcrest Street. At the March 17, 2015 Board of Adjustment meeting, Harry and Janet Roenfanz filed a written complaint regarding the accessory structure within the five foot set-back from the north property line. The neighbor to the west, Wade Kittner, made it known he did not have a problem with the structure being within the five foot set-back or up to the property line. The Board asked Ms. Ames Peterson to make another plan that included a five foot set-back from the north property line.</p><p>Item #1 - Jodi Ames Peterson, 2 Hillcrest Street, Ventura, IA.</p><p>DESCRIPTION OF VARIANCE: Applicant requests a variance from Ordinance 170.03, section 4 and section 6. Each detached private garage or accessory building shall not be less than five feet from a party lot line or alley line. Section 6, If any portion of a detached garage or other accessory building is within a side yard of a principal building on the same lot, such garage or building shall not be nearer to the side lot line than would be required for the building wall of a principal building on the same lot. Each 12 feet in height of the accessory building shall be considered a story. Applicant is requesting to place an accessory building two feet from the west property line and has agreed to move the structure five feet off the north property line.</p><p>Mrs. Jodi Peterson presented the Board with a diagram of the proposed set-back from the foundation posts to the north and west property lines. The proposal included moving the structure posts back five feet from the north property line and two feet back from the west property line. </p><p>Zoning Administrator, John Marino, clarified that the overhang of the building can extend over into the five ft. set-back and that the wall of the structure, or in this case, the posts of the structure are where the measurements are determined from. Andy Carter inquired about any rights the next owner of the property had and if they did not like where the structure was placed. Zoning Administrator, John Marino, explained that once a variance is granted, then the new owner is bound by the decision that this board makes or until the structure is torn down.</p><p>Motion by Cash and seconded by Carter, to approve the 2ft set-back on the west property line for the 16x20 accessory structure for Jodi Ames Peterson at 2 Hillcrest Street, Ventura, Iowa. Passed unanimously.
