NO(S). 168437-0000), AS 9 DESCRIBED HEREIN, OWNED BY BRENDA P. BULL, 10 FROM PUD (PLANNED UNIT DEVELOPMENT) DISTRICT 11 TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT, AS 12 DEFINED AND CLASSIFIED UNDER THE ZONING CODE, 13 TO PERMIT COMMERCIAL USES, AS DESCRIBED IN THE 14 APPROVED WRITTEN DESCRIPTION AND SITE PLAN FOR 15 THE MAYPORT MARSHVIEW PUD; PROVIDING AN 16 EFFECTIVE DATE. 17</p><p>18 WHEREAS, Brenda P. Bull, the owner(s) of approximately 1.88 19acres located in Council District 11 on State Road A1A between 20Wonderwood Drive and Mayport Village (R.E. No(s). 168437-0000), as 21more particularly described in Exhibit 1, attached hereto (Subject 22Property), has applied for a rezoning and reclassification of that 23property from PUD (Planned Unit Development) District to PUD 24(Planned Unit Development) District, as described in Section 1 25below; and 26 WHEREAS, the Planning Commission has considered the 27application and has rendered an advisory opinion; and 28 WHEREAS, the Land Use and Zoning Committee, after due notice 29and public hearing, has made its recommendation to the Council; and</p><p>2 1 AMENDED 3/23/10</p><p>1 WHEREAS, the Council finds that such rezoning is: (1) 2consistent with the 2010 Comprehensive Plan; (2) furthers the 3goals, objectives and policies of the 2010 Comprehensive Plan; and 4(3) is not in conflict with any portion of the City’s land use 5regulations; and 6 WHEREAS, the Council finds the proposed rezoning does not 7adversely affect the orderly development of the City as embodied in 8the Zoning Code; will not adversely affect the health and safety of 9residents in the area; will not be detrimental to the natural 10environment or to the use or development of the adjacent properties 11in the general neighborhood; and will accomplish the objectives and 12meet the standards of Section 656.340 (Planned Unit Development) of 13the Zoning Code; now therefore 14 BE IT ORDAINED by the Council of the City of Jacksonville: 15 Section 1. Property Rezoned. The Subject Property is 16hereby rezoned and reclassified from PUD (Planned Unit Development) 17District to PUD (Planned Unit Development) District, as shown and 18described in the approved site plan dated April 11, 2000 and 19written description dated February 2, 2010 for the Mayport 20Marshview PUD. The PUD district for the Subject Property shall 21generally permit commercial uses, as more specifically shown and 22described in the approved site plan and written description, both 23attached hereto as Exhibit 2. 24 Section 2. Rezoning Approved Subject to Conditions. This 25rezoning is approved subject to the following conditions: 26 (a) Development shall proceed in accordance with the 27Development Services Division Memorandum dated February 11, 2010, 28or as otherwise approved by the Planning and Development 29Department. 30 (b) The site shall be developed per Part 12 of the Zoning 31Code. 2 - 2 - 1 AMENDED 3/23/10</p><p>1 (c) A landscaping plan and tree survey shall be submitted for 2the review and approval by the Planning and Development Department 3at the time of Verification of Substantial Compliance to the PUD. 4 (d) All sag lenses, drop lenses and convex lenses shall be 5prohibited. Illumination levels at all property lines shall not 6exceed one-half (.5) foot candles (“f.c.”) when the building or 7parking areas are located adjacent to residential areas, and shall 8not exceed one (1.0) f.c. when abutting other non-residential 9properties. All lighting lamp sources within parking and pedestrian 10areas shall be metal halide or compact fluorescent. The maximum 11light pole height in all parking areas should not exceed twenty 12feet (20’- 0”). An exterior lighting design plan for each project, 13including a photometrics plan, pole and fixtures schedules shall be 14submitted at the time of Verification of Substantial Compliance for 15review and approval by the Planning and Development Department. 16 Section 3. Owner and Description. The Subject Property 17is owned by Brenda P. Bull and is legally described in Exhibit 1. 18The agent is Brenda M.
