<p>ZONING BOARD OF APPEALS Tuesday, February 23, 2016 Regular Meeting Council Chambers 5:00 P.M.</p><p>Present: Chairman Bankoski, Commissioners: Collier, Galardo, Helwig and Rice.</p><p>Also Present: Housing, Building and Zoning Officer Zurawski.</p><p>The reading of the minutes of the previous meeting was dispensed with, same having been approved in writing by a majority of the Board.</p><p>The meeting was held for the purpose of hearing the following appeals:</p><p>APPEAL #2016-01 Appeal of Candy Paredes, 118 Plover Street for permission to construct an addition to the rear of her place of residence. Not in compliance with Article VI, Section 79-6020(1) and Article V, Section 79-5060 (in part) of the Zoning Code of the City of Dunkirk, New York.</p><p>Candy Paredes, 118 Plover Street, Dunkirk, New York was sworn in and testimony was taken in favor of the Board granting this appeal.</p><p>William York, 118 Plover Street, Dunkirk, New York was sworn in and testimony was taken in favor of the Board granting this appeal.</p><p>No one appeared in opposition to the Board granting this appeal.</p><p>APPEAL #2016-02 Appeal of Jennifer N. Enser, 23 N. Zebra Street for permission to remove the existing 5’ x 8’ enclosed porch and replace with a new 8’ x 16’ wood framed enclosed porch at the rear of her place of residence. Not in compliance with Article IV, Section 79-4060 (in part) of the Zoning Code of the City of Dunkirk, New York.</p><p>Jennifer Enser, 23 N. Zebra Street, Dunkirk, New York was sworn in and testimony was taken in favor of the Board granting this appeal.</p><p>No one appeared in opposition to the Board granting this appeal.</p><p>DETERMINATION</p><p>APPEAL #2016-01 In the appeal of Candy Paredes it was the unanimous decision of the Board that this appeal be granted with the following stipulation:</p><p>1. The appellant must comply with all testimony and information presented at the Zoning Board of Appeals meeting held Tuesday, February 23, 2016.</p><p>The Board stated the following findings of fact in their determination:</p><p>1. No undesirable change will occur in the neighborhood.</p><p>2. The 20’ setback was already infringed upon with the residence.</p><p>3. The request is not a substantial variation from the area or dimensional standard set in the zoning law. </p><p>4. The variance with not have an adverse effect on the physical or environmental conditions in the neighborhood. </p><p>5. It will enhance the character of the neighborhood.</p><p>APPEAL #2016-02 In the appeal of Jennifer Enser it was the unanimous decision of the Board that this appeal be granted with the following stipulation:</p><p>1. The request is not a substantial variation from the area or dimensional standard set in the zoning law. </p><p>4. It will enhance the character of the neighborhood.</p><p>Commissioner Galardo moved to adjourn to a workshop session, seconded by Commissioner Helwig.
