<p> RELEASE AND HOLD HARMLESS</p><p>I, the undersigned, for myself, my heirs, executors, administrators, and assigns, do hereby remise, release, quitclaim and forever discharge and hold harmless Pennsburg Borough, it agents, officers, employees and assigns, from any and all liability, known or unknown, potential or otherwise, arising from my/our use of the baseball fields which are owned by Pennsburg Borough, situate at Eighth Street, Pennsburg, Montgomery County, Pennsylvania. I/We fully understand that I/we are voluntarily participating in an organized baseball league at the fields and do hereby assume the risk of loss or personal injury or property damage resulting from the use of the ball fields or otherwise. I/We hereby fully understand and agree to use the equipment and supplies provided at the baseball fields only for the purposes for which they are intended and for no other purpose whatsoever. The equipment and supplies shall be used only at the baseball fields owned by Pennsburg Borough and shall not be used at any other location without the prior written consent of Pennsburg Borough Council. I/We understand that we shall be held responsible for reimbursing the Borough of Pennsburg for any damage to the equipment or supplies used at the baseball fields with the exception of damage caused by ordinary use and regular wear and tear of the items. I/We further agree that all equipment or supplies shall be cleaned and returned to the location from where it was obtained in the same or better condition as when it was obtained. All equipment and supplies used provided by the Borough of Pennsburg shall be locked or otherwise secured in the manner required by the Borough of Pennsburg.
