<p> NATIONAL CONFERENCE OF INSURANCE LEGISLATORS</p><p>Resolution in Support of Federal Legislation to Protect American Investors </p><p>Adopted by the NCOIL Executive Committee on November 21, 2003.</p><p>WHEREAS, the confidence of investors in the U.S. mutual fund industry is critical for the continuation of a stable economy; and </p><p>WHEREAS, more than 95 million Americans own mutual funds, which have become the primary investment vehicle for both individual and institutional investors; and </p><p>WHEREAS, recent allegations of wrongdoing by mutual funds range from inconsistent treatment of investors to violations of law; and</p><p>WHEREAS, current industry practices, including “late trading” and “market timing,” disadvantage small, long-term investors; and </p><p>WHEREAS, such misconduct in the mutual fund industry has recently been exposed as pervasive, extending beyond a few rogue operators; and </p><p>WHEREAS, enactment of strong legislation will ensure that American investors will not be subject to disparate treatment; and</p><p>NOW, THEREFORE, BE IT RESOLVED THAT NCOIL supports federal legislation that:</p><p> Provides for transparency of mutual fund fees, costs, expenses, and operations  Provides adequate disclosures to consumers so that they may make informed investing decisions  Ensures that individual investors will participate on a level playing field with large institutional investors  Requires strong mutual fund leadership free of conflicts of interests</p><p>NOW, THEREFORE, BE IT FURTHER RESOLVED THAT NCOIL urges Congress and the States to enact such reform legislation expeditiously and will forward a copy of this resolution to the House and Senate leadership and to members of the House Financial Services Committee and the Senate Banking, Housing and Urban Affairs Committee.</p>
