<p>TASMANIAN INDUSTRIAL COMMISSION</p><p>Industrial Relations Act 1984 s55 application for approval of an industrial agreement</p><p>Minister administering the State Service Act 2000 (T14383 of 2015) and Australian Nursing and Midwifery Federation (Tasmanian Branch)</p><p>NURSES AND MIDWIVES WORK VALUE AGREEMENT 2015</p><p>PRESIDENT T J Abey HOBART, 8 JANUARY 2015</p><p>Industrial agreement – application approved – operative from 21 December 2015 until 30 November 2016 – forwarded to Registrar for registration</p><p>DECISION</p><p>[1] On 21 December 2015, the Minister administering the State Service Act 2000 (MASSA) and the Australian Nursing and Midwifery Federation (Tasmanian Branch) (ANMF) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, an application for filing of the Nurses and Midwives Work Value Agreement 2015.</p><p>[2] At the hearing in Hobart on 21 December 2015, Mr Kerryl Grey appeared with Ms Madeline Brady and Ms Kendra Strong for MASSA, and Ms Jenny Thomas appeared with Mr Andrew Brakey for ANMF.</p><p>[3] Mr Grey explained that this agreement represented the end point of a commitment entered into in the Nurses and Midwives Heads of Agreement 20101 and subsequently modified in the 20132 and 2014 Agreements.3 </p><p>[4] The work value is settled and resolved in accordance with the clauses in the two previous Agreements and no further claims regarding work value for any grade, other than through normal bargaining process at a future date, will be made.</p><p>[5] Details of the salary adjustments and changes to progression points are found in clause 7.</p><p>[6] Ms Thomas advised the ANMF supported the application and confirmed that the agreement will not disadvantage employees covered by the agreement.</p><p>[7] The parties advised that the Health Services Union, Tasmania Branch (HSU) had been party to the negotiations but had indicated that it would not be signing the</p><p>1 T13746 of 2010 - Nurses and Midwives Heads of Agreement 2010 2 T14119 of 2013 - Australian Nursing And Midwifes (Tasmanian State Service) Interim Agreement 2013 3T14277 of 2014 - Nurses And Midwives (Tasmanian State Service) Agreement 2014 2 agreement. This position has been confirmed in correspondence from the HSU dated 21 December 2015.</p><p>[8] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.</p><p>[9] Pursuant to s55(4) the agreement is approved operative from 21 December 2015 and shall remain in force until 30 November 2016.</p><p>[10] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.</p><p>Tim Abey PRESIDENT</p><p>Appearances: Mr K Grey with Ms M Brady and Ms K Strong for MASSA Ms J Thomas with Mr A Brakey for ANMF</p><p>Date and place of hearing: 2015 21 December Hobart</p>
