On October 26, 2009, you filed on behalf of Entergy Arkansas, Inc. a Settlement Agreement between Entergy Arkansas, Inc. (Entergy Arkansas) and the City of Osceola, Arkansas (Osceola). The Settlement Agreement reflects the parties’ agreement to resolve all issues set for hearing in the above-captioned proceeding, regarding the 2009 Wholesale Formula Rate Update for Osceola. Entergy Arkansas, Inc., 128 FERC ¶ 61,133 (2009). On November 23, 2009, Trial Staff and Osceola submitted comments supporting the Settlement Agreement. On December 8, 2009, the Settlement Judge certified the Settlement Agreement to the Commission as an uncontested settlement. Entergy Arkansas, Inc., 129 FERC ¶ 63,022 (2009).</p><p>2. The Settlement Agreement resolves all issues set for hearing in Docket No. ER09- 877-000. The Settlement Agreement is fair and reasonable and in the public interest, and therefore, is hereby approved. The Commission’s approval of the Settlement Agreement does not constitute approval of, or precedent regarding, any principle or issue in this proceeding. The Commission retains the right to investigate rates, terms, and conditions under the just and reasonable and not Docket No. ER09-877-000 2</p><p> unduly discriminatory or preferential standard of section 206 of the Federal Power Act, 16 U.S.C. § 824e (2006).</p><p>3.
