<p> Podcasting Artist Release Form </p><p>Artist agrees to allow SUNY Fredonia to record the following live event(s) or performance(s): ______on audio and/or video media, and to allow SUNY Fredonia make a digital form, a "podcast", of the recording freely available for public download on the SUNY Fredonia web site, www.fredonia.edu. The recording will be fully attributed to the participants of the event(s) listed above.</p><p>The Artist warrants and represents that he or she is the sole legal owner of all right, title and interest in all poetry and other work comprising his performance, hereinafter the “work”, including all related intellectual property interests such as trademarks and the sole and exclusive copyright in all work, and has the full right and authority to enter this Agreement and grant the rights granted in this Agreement. </p><p>The Artist also warrants and represents that the presentation of this work does not and will not infringe or violate the rights of any other party, including any copyright interests. The Artist shall indemnify, defend and hold SUNY Fredonia harmless from any losses, claims, damages, awards, penalties or injuries incurred, including reasonable attorney's fees, which arise from any claim by any third party of an alleged infringement of copyright or any other property right arising out of the presentation of the work. </p><p>The Artist grants to SUNY Fredonia a nonexclusive, royalty free, perpetual license to display his/her work.
