<p> California Community Colleges Chancellor’s Office Terms and Conditions Governing Use and Access to Early Assessment Program (EAP) Student Data</p><p>For individual student EAP information: https://ept-elmsr.ets.org (the "Site")</p><p>To download datafile of all 11th grade student EAP test results and information for the college’s feeder high schools (for students who released their results to CCC): webprod.cccco.edu/ccccoeap/login.aspx</p><p>Access and use of Early Assessment Program (EAP) student data is conditioned upon You (defined below) agreeing to the following terms and conditions. </p><p>1. Consent to Terms. "You" or "User" shall refer to you, the individual user, or EAP Data Administrator, of the EAP student data. </p><p>2. Representations. By accessing and using Early Assessment Program (EAP) student data and records, you hereby acknowledge and agree to comply with the Terms and Conditions set forth herein. You represent that you: are currently a duly authorized employee of a California Community College ("CCC") and have been authorized by the Chancellor’s Office to access the EAP data; have a need to access the EAP data and agree to use the data for a legitimate educational purpose. In addition, You hereby acknowledge users added by You are duly authorized employees of the California Community College you represent and have a need to access the EAP data and to know the data provided through the Site for a legitimate educational purpose.</p><p>3. Credentials. You have been assigned user credentials (i.e, set password and security questions/responses) for access and use of the EAP data websites. You may not share such credentials or use any other party's credentials.</p><p>4. Restricted Access. The content, layout and other features and functionality of the site may have restricted access rights and are subject to change without notice. Your access rights may be modified at any time as requested by your employer or the Chancellor’s Office, including suspending or terminating such rights without notice.</p><p>5. Data Protection. You shall treat all data and information received through the websites and from or about individual students as confidential information; and shall access and use such data in compliance with all applicable data protection, privacy, and security laws and regulations, including, but not limited to, FERPA. You will immediately notify your employer if you know of any unauthorized access to any portion of the websites.</p><p>6. Consents. The Chancellor’s Office may verify, process, disclose, store, and transfer all personally identifying information submitted by You or for You. 7. EXCLUSION OF CERTAIN DAMAGES. EXCEPT AS OTHERWISE SET FORTH IN A WRITTEN AGREEMENT SIGNED BY THE CHANCELLOR’S OFFICE AND YOUR COLLEGE, THE CHANCELLOR’S OFFICE WILL NOT BE LIABLE TO YOU OR ANY OTHER USER OR PERSON FOR ANY DAMAGES ARISING OUT OF YOUR ACCESS, INABILITY TO ACCESS OR USE OF THE SITE, WHETHER DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL DAMAGES, OR PUNITIVE DAMAGES.</p><p>8. EAP Data College Administrator Roles and Responsibilities: As the EAP Data College Administrator for your community college, you agree to the following roles and responsibilities:</p><p> a. Administrator Privileges: You have the ability to create, change, and delete College Users. College User assignments are limited to other college employees who have a legitimate educational purpose in accessing EAP student data with user access to the websites to download EAP student data.</p><p> b. Management of Secondary College User Access Privileges: Identify other college users who have a legitimate educational reason for accessing student EAP data. Legitimate reason is defined as the use of student EAP data for institutional research purposes, outreach, and/or course placement. As the EAP Data College Administrator for your college, you have administrator privileges and can assign secondary users at your college and privileges, and modify or delete secondary user access to the student EAP data. If a secondary user is no longer employed by your college or no longer has a legitimate educational reason to access the student EAP data, you agree to delete the secondary user’s access immediately.</p><p> c. Confidentiality of Student Information: Each user agrees to treat all student EAP data confidentially and will not release this data outside of the users approved within your college. Ensure confidential destruction of records or data no longer needed to satisfy a legitimate educational purpose, such as institutional research, outreach, and/or course placement.</p><p> d. Notification Status Change: If your role and/or relationship with your employer (your college) changes such that you no longer represent the college or have a legitimate reason for accessing student EAP data, you agree to notify the Chancellor’s Office immediately so that your access privileges can be terminated. </p><p>By clicking on “I Accept” button, you agree to the above terms and conditions.</p>
