<p> ORDINANCE NO. 492</p><p>AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF WILTON, IOWA BY UPDATING TITLE 14 UNDER SECTION 14.16, ENTITLED "WATER RATES "</p><p>Be it enacted by the City Council of Wilton, Iowa:</p><p>SECTION 1: This ordinance as amended is enacted is to add changes of rates in the portion of Title 14 of the Wilton Municipal Code pertaining thereto.</p><p>Title 14, Section 14.16 Water Rates Sections: 14.16.010 Schedule of rates. 14.16.011 Fuel and energy cost adjustment. 14.16.020 Due date - - Penalty for delinquency. 14.16.030 Existing dwelling units. 14.16.040 New and converted dwelling units.</p><p>14.16.010 Schedule of rates. The rates and charges for water supplied through the municipal waterworks system shall be as follows: (a) For the period of June 1, 2012 through June 30, 2013 (Fiscal Year 2013). (1) All customers will be charged a customer charge of nine dollars and fifty two cents per month which includes the first one thousand gallons of water. This is also the minimum bill per month; (2) For all usage over 1,001 gallons per month e next eight thousand gallons per month the sum of two dollars and ninety seven cents per one thousand gallons; (b) For the period of July 1, 2013 through June 30, 2014 (Fiscal Year 2014). (1) All customers will be charged a customer charge of ten dollars and forty seven cents per month which includes the first one thousand gallons of water. This is also the minimum bill per month; (2) For the next eight thousand gallons per month the sum of three dollars and twenty seven cents per one thousand gallons; (c) For the period of July 1, 2014 through June 30, 2015 (Fiscal Year 2015). (1) All customers will be charged a customer charge of eleven dollars and fifty one cents per month which includes the first one thousand gallons of water. This is also the minimum bill per month; (2) For the next eight thousand gallons per month the sum of three dollars and fifty nine cents per one thousand gallons; (d) For the period of July 1, 2015 through June 30, 2016 (Fiscal Year 2016). (1) All customers will be charged a customer charge of twelve dollars and sixty six cents per month which includes the first one thousand gallons of water. This is also the minimum bill per month; (2) For the next eight thousand gallons per month the sum of three dollars and ninety five cents per one thousand gallons; 14.16.011 Fuel and energy cost adjustment. The foregoing rates for each gallon of water shall be increased by dividing the total gallons of water sold each month into the fuel and energy purchased by the combined water and wastewater departments. The resulting number will be the “fuel factor.” The total gallons consumed monthly by a customer shall be multiplied factor to generate the fuel and energy cost adjustment. Adjustments for the cost of fuel and energy purchased shall be charged monthly and shall be based on the average cost of fuel and energy purchased during the preceding month. The monthly “fuel factor” shall be transferred each month from the water fund to the general fund. </p><p>14.16.020 Due date - - Penalty for delinquency . All water bills payable under the rates set forth in Section 14.16.010 shall be due and payable monthly and on the first day of each month following and shall be delinquent on the twentieth day of that month. In the event of failure to pay any such bill prior to its becoming delinquent, an additional charge of five percent per month shall be added to the bill and the entire bill, including such additional charge shall be immediately due and payable. The city may discontinue service to any consumer whose bill remains unpaid on the twenty-fifth day of the month. </p><p>14.16.030 Existing dwelling units. Where an existing dwelling house, multiple-dwelling unit, building, trailer court or other like structure or premises is now occupied by more than one consumer and is not now separately metered, the total gallons of water used shall be divided by the number of consumers and monthly billing to each consumer shall be based upon the number of gallons so determined computed at the rates set forth in this chapter. </p><p>If any such consumers shall default in the payment of his/her portion of the monthly billing, the owner of the structure or premises shall become responsible for payment of all delinquent billings. If the owner does not pay the delinquent bill by the twenty-fifth day of the month following the default, the city may discontinue water service to the entire structure or premises. If service is discontinued in such circumstances, all prior bills and delinquencies must be paid and all future water service must be separately metered and billed to each consumer before service is restored. </p><p>14.16.040 New and converted dwelling units, Any dwelling house, multiple-dwelling unit, building, trailer court or other like structure or premises which is hereafter constructed or converted and is occupied by more than one owner, tenant or consumer, the water service shall be separately metered and billed to each such consumer. </p><p>SECTION 2: REPEALER. All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed.</p><p>SECTION 3: SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional such adjudication shall not affect the validity of this ordinance as a whole or any section, provision, or party thereof not adjudged invalid or unconstitutional. SECTION 4: WHEN EFFECTIVE.
